I am the owner of a small and micro enterprise engaged in cross-border export of household goods. I have just developed 3 new European customers this year. Previously, I handled paid customs declaration export on my own, which brought thin and unstable profits. I just negotiated cooperation with an agent this week, and what confuses me most is whether the payment should be transferred to me or to the agent.
If the payment is transferred to the agent, I am afraid I cannot get the money back; if it is transferred to my personal account, I am afraid it will not comply with regulatory provisions and affect tax refund. Last month, my peer was subject to tax bureau correspondence verification due to foreign exchange collection issues, and hundreds of thousands of tax refund could not be obtained. Please tell me clearly who shall collect the payment for agent export, and what specific requirements apply to different situations?

First of all,it shall be clarified that under the current foreign exchange and tax supervision requirements in 2026,the core basis for identifying the foreign exchange recipient of agent export is the operator indicated on the customs declaration form,If the operator on the customs declaration form is marked as the agency company, the agency company must complete the public account foreign exchange collection. Before cooperation, you shall sign a standardized agent export agreement with the agent, clarifying the time limit for payment transfer after foreign exchange collection, the proportion of handling fees and fallback clauses. In the early stage, you shall synchronize the overseas payment path and remitter information of your cooperative customers to the agent for pre-audit,so as to avoid the inconsistency between the remitter information and the buyer on the contract, which will affect the efficiency of foreign exchange settlement.
After receiving the foreign exchange, the agent will complete the foreign exchange settlement within 3 working days. You need to provide the special VAT invoice of the corresponding amount, inland transportation and port miscellaneous fee vouchers, which shall be matched with the customs declaration form, contract and logistics bill in terms of information,After the four-flow consistency verification is passed, the private/public account payment transfer can be completed within 1-2 working days. If you have import and export rights and only entrust the agent to provide single services such as customs clearance and logistics, you can fill in your own entity as the operator on the customs declaration form, and your company can collect the foreign exchange by itself. You only need to synchronize the foreign exchange receipt slip to the agent for tax refund filing.
In case of delayed payment by overseas customers or incorrect remittance information, you shall communicate with the agent immediately, and do not privately agree with the customer to change the collection account,so as to avoid the suspicion of capital return triggering tax early warning. If the customer requires to transfer the payment to your personal account, you can negotiate with the agent to use the small-value foreign exchange collection green channel of the cross-border RMB CIPS channel. For compliant small-value orders with a single amount less than 50,000 US dollars, you can apply for direct foreign exchange collection by the entrusting party, which will not affect the subsequent tax refund application.

The operator indicated on the customs declaration form is the core customs voucher for determining the foreign exchange recipient. In 2026, the national integrated customs clearance system has realized real-time data synchronization with the State Administration of Foreign Exchange and the tax bureau. Within 3 working days after the customs declaration form is submitted, the data will be automatically synchronized to the foreign exchange monitoring system.
If the actual foreign exchange recipient is inconsistent with the operator on the customs declaration form, the State Administration of Foreign Exchange will directly trigger an early warning. Those who fail to complete the abnormal explanation within 90 days will be listed as Class B supervised enterprises, and all subsequent customs declaration business shall be subject to document review one by one.
In serious cases, the customs declaration authority will be suspended for 6 months. If you really need to change the foreign exchange recipient, you shall submit the agency agreement and the explanation of foreign exchange recipient change to the customs before customs declaration, complete the filing before carrying out customs declaration operation, and do not privately adjust the foreign exchange collection path after the completion of customs declaration.

The agent export foreign exchange collection mode directly affects the calculation of VAT refund amount. If the agency company collects the foreign exchange, you need to issue a special VAT invoice with a tax rate of 13% to the agency. After deducting the handling fee according to 13% of the face value of the invoice, the agency will transfer the tax refund and the payment to you together. Under this mode, you do not need to handle the tax refund declaration by yourself, and all tax risks shall be borne by the agency company.
If you collect the foreign exchange by yourself, you need to complete the tax refund declaration on your own. You shall keep the complete set of agency agreement, logistics vouchers and foreign exchange receipt slips, and complete the declaration within 90 days after export. If the foreign exchange collection time is later than the tax refund declaration time, you shall submit the delayed foreign exchange collection filing to the tax bureau in advance, so as to avoid the recovered issued tax refund, and you shall also pay the VAT and additional taxes as deemed domestic sales.

In 2026, both SWIFT and CIPS systems have realized penetrating connection with domestic foreign exchange supervision systems, and the source of overseas funds will be automatically verified. If the foreign exchange recipient is the agency company, you need to submit the overseas registration information and trade background materials of the buyer to the agency in advance, and the agency will conduct pre-audit of trade background with the bank in advance to avoid the funds being intercepted and suspended by the bank.
If the buyer pays through an offshore account, note that the registration place of the offshore account shall not be in the FATF blacklist area, otherwise the funds will be directly returned in the original way, and the resulting exchange loss shall be borne by the entrusting party. For a single foreign exchange collection amount exceeding 100,000 US dollars, the bank will require a full set of trade documents for manual verification. Preparing the corresponding materials in advance can shorten the foreign exchange settlement time by 2-3 working days.

When signing the agent export agreement, you shall clearly stipulate the division of rights and responsibilities related to foreign exchange collection, and clarify that the agency company shall not intercept or embezzle the payment without permission after receiving it, and stipulate the proportion of liquidated damages for overdue payment. Generally, it can be agreed that 0.1% of the unpaid amount shall be paid as liquidated damages for each overdue day.
If the overseas buyer refuses to pay the payment, it shall be clearly stipulated whether the agency company or the entrusting party is responsible for collection. If the agency company has audit errors leading to the failure to recover the payment, the compensation proportion borne by the agency company shall be stipulated, and you can require a maximum compensation of 80% of the unrecovered payment. Do not agree on foreign exchange collection related clauses orally, and all agreements shall be implemented in the written agreement, so as to avoid no basis for rights protection in case of subsequent disputes.

The foreign exchange collection path is the core link of the four-flow verification for export tax refund. If the foreign exchange recipient is inconsistent with the operator on the customs declaration form, the tax bureau will directly trigger correspondence verification, requiring a full set of trade documents, agency agreements and situation explanations.
The verification cycle is generally 1-3 months, and the tax refund will not be issued before the verification is passed. If valid supporting materials cannot be provided, it will be identified as export tax refund fraud. Not only will the issued tax refund be recovered, but also a fine of 1-5 times the tax refund amount will be imposed.
In serious cases, criminal responsibility will be investigated. The latest 2026 tax refund verification rules require that the remitter on the foreign exchange receipt slip must be consistent with the buyer on the trade contract. In case of payment on behalf, the buyer shall provide a payment on behalf explanation, otherwise the verification cannot be passed.

You can select the optimal foreign exchange collection mode according to the order amount and customer stability. If the single order amount is less than 50,000 US dollars and the customer is a small customer cooperating for the first time, you can choose the self-collection mode, use your own entity as the operator when declaring customs, and the agent is only responsible for customs clearance and logistics, which can reduce the risk of capital occupation.
If the single order amount exceeds 200,000 US dollars and the customer is a stable large customer with long-term cooperation, you can choose the mode of foreign exchange collection by the agency company. The agency can provide exchange rate locking service to lock the settlement exchange rate in advance, avoid losses caused by exchange rate fluctuations, and also provide up to 80% of the payment advance service, so you can get the payment within 3 working days after shipment, improving the capital turnover efficiency.

The foreign exchange collection mode is directly related to cargo right control. If the agency company collects the foreign exchange, it is generally required that the shipper on the bill of lading be marked as the agency company, and the cargo right will not be released before the full payment is received. If the customer refuses to pay the payment, the agent can assist in handling return or resale, reducing the risk of cargo right loss.
If you collect the foreign exchange by yourself, the shipper on the bill of lading can be marked as your company, and you can control the cargo right by yourself, but you shall arrange to telex release the bill of lading only after receiving the full payment, so as to avoid the situation of cargo release without bill of lading. For FCL export by sea, you can apply for a 14-day free storage period to leave enough time for foreign exchange collection and avoid additional expenses such as port detention fee and container detention fee.

If the exported goods need on-site inspection, the customs will verify whether the actual value of the goods is consistent with the declared value. If the deviation between the declared value and the foreign exchange collection amount exceeds 5%, you will be required to provide the foreign exchange receipt slip and trade contract as evidence. If the foreign exchange recipient is inconsistent with the operator on the customs declaration form, it will be identified as false declaration.
In minor cases, the declaration will be deleted and re-declared, and in serious cases, a fine of 5%-30% of the cargo value will be imposed, which will also affect the credit rating of the enterprise, and the subsequent inspection rate will be increased to more than 80%. If you need to provide foreign exchange collection related vouchers during inspection, you shall communicate with the agent in advance to ensure that the provided vouchers are completely consistent with the customs declaration information, and do not submit vouchers that do not meet the requirements at will.
