I am a business handler at a foreign trade company. We recently received an agent export order from an overseas purchaser, and we are only responsible for arranging shipment for the factory. Now the purchaser asks who shall bear the taxes and fees related to foreign exchange receipt, and I am completely confused about this.

I only knew that agent export services charge service fees before, but I have never sorted out the tax and fee part clearly. I also heard that foreign exchange supervision will be stricter in 2026.

If we allocate the taxes and fees incorrectly, will we be inspected by the foreign exchange authority? Will it also affect our export tax rebate? Can you explain this in detail? We are very afraid of falling into compliance traps right now.

In agent export business, the liability for taxes and fees related to foreign exchange receipt shall first be clarified with core rights and responsibilities specified in the agency agreement. Cross-border payment and receipt supervision will become stricter in 2026,and vague agreements can easily trigger compliance risks.

First of all,it is necessary to clarify the boundaries of two types of taxes and fees: first, exchange gains and losses and cross-border bank handling fees in the foreign exchange receipt link, second, tax and fee costs related to export tax rebates. As the nominal holder of the foreign exchange receipt account, the entrusted agent is only responsible for collection and payment on behalf of the principal. The party bearing the taxes and fees shall be clearly specified in the agreement in advance to avoid subsequent capital disputes.

In full-chain practical operation, the details of the agency agreement shall be reviewed in the pre-link,such as agreeing on the adjustment mechanism for exchange rate fluctuation and the issuing party of tax and fee invoices. At core nodes, the consistency of SWIFT messages, customs declaration forms and foreign exchange receipt vouchers shall be checked to ensure that the foreign exchange receipt amount matches the declared cargo value and meets the four-flow consistency requirements.

Plans for handling abnormal situations shall be made in advance: if an overseas purchaser directly pays the payment for goods to the principal's account,it shall be filed with the foreign exchange authority in advance to avoid triggering an early warning of inconsistent foreign exchange receipt entities. If VAT deferral is involved, the party sharing the taxes and fees shall be confirmed simultaneously to ensure that tax declarations are consistent with actual expenditures.

Export tax rebate audits in 2026 will be linked with foreign exchange revenue and expenditure data. If foreign exchange receipt taxes and fees are not recorded in accordance with the agreement,it will lead to abnormal tax rebate letter verification. Therefore, all tax and fee related vouchers and agreements shall be retained to ensure compliance implementation.

Taxes and fees for foreign exchange receipt in agent export shall be determined in combination with customs valuation rules and payment and receipt requirements. First, it is necessary to confirm whether the tax and fee sharing clauses are clearly specified in the agency agreement. The integrated customs valuation system in 2026 will be linked with foreign exchange revenue and expenditure data.

If the foreign exchange receipt amount does not match the amount on the customs declaration form, a valuation warning will be triggered. Note that the agency service fee is the business cost paid by the principal, and shall be accounted for separately from taxes and fees in the foreign exchange receipt link, such as exchange gains and losses and cross-border handling fees. If the entrusted agent collects taxes and fees on behalf of the principal, a separate compliant invoice shall be issued to avoid confusion with the cargo value.

In case of tax and fee disputes, the declared amount can be adjusted by deleting the original declaration and re-submitting, but this shall be completed before the goods depart. The agency agreement and foreign exchange receipt vouchers shall be retained as supporting evidence at the same time.

For agent export across different ports, it is necessary to ensure that the payment and receipt data of all ports are synchronized to avoid inspection risks caused by inconsistent data.

Fees such as container detention charges and free storage period in the international logistics link may be related to foreign exchange receipt taxes and fees, as these fees need to be included in the cost accounting of agent export. Note that when the bill of lading is endorsed and transferred, the corresponding relationship between cargo ownership and taxes and fees shall be clarified.

If the port of destination is changed or the container is rolled over, the party sharing the additional costs incurred shall be agreed in the agency agreement. Freight rates in the global shipping market fluctuate frequently in 2026, and exchange rate differences may affect the actual expenditure of logistics costs. It is necessary to lock the exchange rate in advance or agree on a tax and fee adjustment mechanism to avoid tax and fee disputes caused by exchange rate changes.

In addition, the consignee information on the marine bill of lading shall be consistent with the foreign exchange receipt entity. If the principal appoints a third-party consignee, a written guarantee shall be issued to ensure that the payment and receipt data are consistent with the customs declaration form and bill of lading, so as to avoid compliance inspection by the foreign exchange authority.

International tax structure design shall pay attention to the cross-border compliance of foreign exchange receipt taxes and fees. BEPS supervision will become stricter in 2026.

If the tax and fee sharing of agent export involves related party transactions, the pricing shall comply with the arm's length principle. Note that the party paying the withholding tax for non-resident enterprises shall be clearly specified in the agreement to avoid missing tax payment or double taxation.

For agent export to the European market involving VAT deferral, it is necessary to confirm whether the VAT number of the consignee is valid. The pre-payment and deduction of taxes and fees shall be included in the foreign exchange receipt cost accounting simultaneously.

If the principal bears the VAT, it shall be transferred separately during foreign exchange settlement to avoid being declared together with the agency service fee.

If the entrusted agent uses an offshore account to collect taxes and fees on behalf of the principal, it shall ensure that the capital flow of the account matches the trade background, so as to avoid triggering the abnormal transaction warning of the foreign exchange authority.

At the same time, regular foreign exchange settlement and reconciliation operations shall be carried out to ensure the accuracy of tax and fee accounting.

International trade legal risks and foreign exchange receipt tax and fee disputes shall be avoided through contract clauses. A force majeure clause shall be added to the agency agreement as a fallback, to clarify the tax and fee adjustment mechanism caused by exchange rate fluctuations and policy changes.

Note that soft clauses of the letter of credit may affect the accounting of foreign exchange receipt taxes and fees. If the party sharing taxes and fees is not clearly specified in the letter of credit, it shall communicate with the overseas purchaser in time to modify the clause.

The transfer of cargo ownership and the issuance of Letter of Intent (LOI) shall clarify the relevant liability for taxes and fees.

If the principal requires the entrusted agent to issue a cargo ownership transfer guarantee, the party sharing the taxes and fees shall be agreed at the same time, so as to avoid the situation that no one bears the taxes and fees after the transfer of cargo ownership. All legal documents shall be retained at the same time to cope with subsequent tax and foreign exchange inspections.

On-site port inspection shall pay attention to the authenticity of seals and the consistency of cargo declaration information. If the inspection finds that the declared cargo value does not match the foreign exchange receipt amount, it will directly affect the compliance of tax and fee accounting.

Note that the packaging and declaration information of the goods shall be sorted out in advance before X-ray inspection, so as to avoid the increase of port detention fees caused by inspection delay, which will further affect the cost accounting of foreign exchange receipt taxes and fees.

The interpretation of the inspection notice shall be combined with customs policies and the provisions of the agency agreement. If the inspection requires supplementary payment of taxes and fees, it shall be confirmed whether the paying party complies with the agreement.

The inspection records and supplementary payment vouchers shall be retained at the same time as supporting materials for export tax rebate and foreign exchange compliance.

Agent export of dangerous goods shall pay attention to the preparation of Material Safety Data Sheet (MSDS) and packaging compliance. Taxes and fees for UN dangerous goods packaging shall be included in the foreign exchange receipt cost accounting.

Customs will impose stricter valuation and tax supervision on dangerous goods in 2026, so it is necessary to ensure that the declaration of packaging costs is consistent with the actual expenditure.

The cost of moisture-proof reinforcement schemes shall be accounted for separately to avoid being declared together with the cargo value. If cross-border transportation of dangerous goods is involved, it shall be confirmed whether the party sharing the taxes and fees meets the compliance requirements for dangerous goods transportation.

At the same time, the packaging appraisal report and MSDS documents shall be retained to cope with the inspection of customs and tax authorities.

Export tax rebate audit shall pay attention to the verification of capital return and four-flow consistency. The entry of foreign exchange receipt taxes and fees shall correspond to the agency agreement, customs declaration form and invoice one by one.

Tax letter verification in 2026 will be linked with foreign exchange revenue and expenditure data. If the tax and fee accounting does not meet the requirements, the tax rebate application will be rejected.

Cross-month declaration and pre-declaration verification shall check the abnormal tax and fee data in advance. If there is exchange rate loss of foreign exchange receipt taxes and fees, it shall be explained separately when declaring the tax rebate.

Supporting materials for exchange rate fluctuations shall be retained at the same time to avoid being identified as illegal operation by the tax authority. The foreign exchange verification process shall be included in the tax and fee accounting link simultaneously to ensure that every tax and fee income and expenditure has compliant vouchers.

Macro supply chain structure design shall optimize the tax and fee costs of agent export. The party bearing taxes and fees can be adjusted through the conversion of CIF/FOB trade terms.

The optimization of international trade structure in 2026 shall combine exchange rate fluctuations and tax policies to select the optimal trade scheme.

Inventory linkage strategy shall consider the cost fluctuation of foreign exchange receipt taxes and fees. If the inventory cycle of agent export goods is long, it is necessary to lock the exchange rate in advance or agree on a tax and fee adjustment mechanism to avoid the increase of tax and fee costs caused by exchange rate changes.

The cost actuarial model shall include variables of foreign exchange receipt taxes and fees to ensure that the pricing of agency service fees covers all potential tax and fee costs.
