I am a foreign trade trader engaged in export of small and medium batches of home hardware. In March this year, we exported a batch of goods worth USD 120,000 to a new customer in the Middle East through an agent. Unexpectedly, the customer refused to pay the full payment on the grounds of minor product defects after receiving the goods.

So far we have only received USD 30,000, and the remaining USD 90,000 has been overdue until now. I communicated with the agent, and they said I need to handle this situation on my own, adding that failure to collect foreign exchange will affect tax refunds and may even lead to audits and inspections.

I am so anxious that I can't sleep now. I am afraid that the previously refunded tax will be recovered and I will have to pay fines, and I don't know what compliance procedures to follow to solve this problem. Can you tell me what specific operations I should take now to minimize losses?

First, sort out the root cause of the current anomaly. The uncollected foreign exchange in agent export caused by customer payment refusal you encountered belongs to a scenario that can be handled compliantly. Against the latest 2026 regulatory requirements for export foreign exchange collection, first identify whether it falls under the exemption scenario of deemed foreign exchange collection: customer payment refusal due to quality disputes, overseas foreign exchange payment restrictions, and customer bankruptcy all fall within the scope of deemed foreign exchange collection allowed by the policy, and you can retain the export tax refund qualification without full collection of foreign exchange.

The first step is to carry out immediate response operations, sort out a full set of materials including trade contracts, communication records between both parties on quality disputes,third-party quality inspection certificates, and written records of multiple payment collections, submit supplementary documents to the competent tax authority for deemed foreign exchange collection filing within 15 working days, eliminate tax refund audit warnings in advance, and avoid suspension of tax refunds or recovery of already refunded tax amounts.

If your situation does not meet the requirements for deemed foreign exchange collection, you need to proactively carry out red letter entry offset for tax refund adjustment, adjust the current export tax refund declaration, and proactively pay back the already refunded tax amount. This will not affect the enterprise's tax credit rating, nor will it incur additional fines and late fees.

Finally, build a long-term risk control closed loop. For cooperation with new customers in the future, you can require bank payment guarantees,or purchase export credit insurance. After payment refusal, you can meet the compliance requirements for foreign exchange collection through claim funds. At the same time, sort out orders with uncollected foreign exchange every quarter, handle anomalies in advance to avoid risk accumulation, and control the overall loss to the minimum range.

According to the new 2026 export tax refund management regulations, for agent export with uncollected foreign exchange, foreign exchange collection or deemed foreign exchange collection filing shall be completed before the deadline of the tax refund declaration period. If the completion is overdue, the corresponding export business is applicable to the value-added tax exemption policy, and the already refunded tax amount shall be recovered for tax that has already been refunded.

When handling deemed foreign exchange collection filing, it is necessary to ensure four-stream consistency, and the information of the agent export agreement, goods declaration form, trade contract and anomaly certification materials must be completely matched without information mismatch, otherwise it will directly trigger tax correspondence adjustment, prolong the filing review time, and even lead to filing rejection. If foreign exchange cannot be collected indeed and does not meet the conditions for deemed foreign exchange collection, you shall proactively make tax exemption declaration within the declaration period, and do not conceal the failure to declare, otherwise it will be identified as non-compliant declaration, affect the enterprise's export tax refund credit rating, and subsequent tax refund reviews will be listed as key verification targets.

Under the current cross-border foreign exchange collection and payment regulatory requirements, uncollected foreign exchange in agent export needs to be registered as an anomaly on the Digital Foreign Exchange Administration Platform of the State Administration of Foreign Exchange, with the reason for uncollected foreign exchange indicated. If it is caused by customer payment refusal, you only need to submit corresponding dispute certification materials. If it is uncollected foreign exchange settled in RMB, you can apply for special filing for CIPS RMB cross-border collection, and those meeting the requirements can be deemed as completed foreign exchange collection.

Do not try to balance accounts through third-party personal account transfers, as this operation will be identified as capital backflow, trigger foreign exchange compliance warnings, and even lead to being listed as a Category B enterprise in serious cases, restricting the foreign exchange collection and payment authority for subsequent import and export business. Even if account balancing is required, it shall be handled through compliant export credit insurance claim settlement or bad debt write-off procedures, and do not take the non-compliant path of personal account transfer.

For uncollected foreign exchange caused by customer payment refusal, you can initiate arbitration or litigation in accordance with the dispute resolution clauses in the trade contract. After obtaining the effective legal document, it can be submitted to the tax and foreign exchange administration authorities as certification material for deemed foreign exchange collection.

If the contract stipulates a payment guarantee clause, you can require the issuing bank to perform the payment obligation and obtain the corresponding amount to complete foreign exchange collection. You can also use the bad debt recovery service of export credit insurance, entrust professional institutions to recover the payment from overseas customers.

If the recovery is unsuccessful, the bad debt confirmation letter issued by the credit insurance company can also be used as compliance filing material to meet the compliance requirements in case of uncollected foreign exchange. Do not reach private agreements with customers without keeping records, otherwise you will not be able to provide corresponding certification materials and can only accept the result of tax exemption or tax repayment.

Uncollected foreign exchange in agent export will not directly affect the export customs clearance process of goods. Goods that have completed export customs clearance will not be required to be returned or detained by customs due to uncollected foreign exchange, but if uncollected foreign exchange is identified as false trade declaration, it will trigger follow-up customs audits, requiring submission of trade authenticity materials.

You need to sort out a full set of customs clearance documents including packing lists, bills of lading, export invoices, purchase and sales contracts in advance, keep them for more than three years, and cooperate with customs audits. If you know in advance that foreign exchange cannot be collected at the time of declaration, you shall truthfully indicate it in the foreign exchange collection category column of the customs declaration form, do not conceal information, so as to avoid being identified as false declaration and increasing subsequent compliance risks.

The tax treatment of uncollected foreign exchange in agent export corresponds to different costs in different scenarios: if it meets the conditions for deemed foreign exchange collection, there is no need to adjust value-added tax, nor to pay additional corporate income tax, and no additional tax costs will be incurred. If it does not meet the conditions for deemed foreign exchange collection and is treated as tax exemption, the corresponding input tax needs to be transferred out and included in the cost; if it is treated as tax repayment, you need to pay value-added tax and late fees according to the tax rate of the exported goods, but there will be no fine for proactive repayment.

If bad debt write-off processing is carried out, the uncollected payment can be used as asset loss for pre-tax deduction against corporate income tax, offsetting the corresponding taxable income and reducing corporate income tax costs. This path can reasonably reduce the overall loss.

For the situation where new customers often refuse to pay resulting in uncollected foreign exchange, you can adjust the cooperation rules, requiring new customers to prepay more than 30% of the payment, and the remaining balance to be paid upon presentation of the bill of lading copy, so as to reduce the risk of uncollected foreign exchange from the source. You can also adjust trade terms, change FOB to EXW, and let the buyer be responsible for logistics and foreign exchange payment, transferring the foreign exchange collection risk.

You can also set graded foreign exchange collection requirements for different customers, requiring full prepayment for customers from high-risk regions, and half prepayment for medium-risk customers, reducing the probability of uncollected foreign exchange from the business structure level, avoiding large irrecoverable losses, and optimizing the risk structure of the overall export business.
