I am a trader mainly engaged in cross-border beauty product imports, and I have just closed an annual procurement order for a batch of niche European fragrances. The previous agency import institution we worked with always made payments on our behalf, but this time the overseas supplier clearly requires that our company must make direct payments abroad to obtain priority order scheduling. If we go through the original payment agent process, the goods will arrive at least 15 days later, missing the peak consumption season in the second half of the year and resulting in at least over two million losses.
I am very hesitant now, not knowing whether as the principal under the agency import model we can directly make foreign exchange payments abroad, whether the operation is compliant with the latest regulatory requirements in 2026, and whether issues such as payment suspense accounts, customs declaration delays, and input tax deduction failure will occur. I want to know the specific conditions that need to be met and the risks that must be avoided.

First,it can be clearly confirmed that under the 2026 current regulatory framework, the principal under the agency import model has the qualifications for compliant foreign exchange payment, provided that two core requirements are met: "real trade background" and "logically consistent documents".
In the pre-submission document review process, you need to prepare in advance a dual-title agency import agreement,a purchase confirmation letter with the overseas supplier, and a payment authorization statement issued by the agency institution. The value of goods, payment recipients and payers, and cargo details on all documents must be completely consistent, with no information discrepancies. You need to submit the complete set of documents to the bank for pre-verification 3 working days in advance before payment to avoid being returned due to document non-compliance.
In terms of core node connection, after the payment is completed, you need to synchronize the payment voucher issued by the bank to the agency import institution, apply for a dual-title customs payment certificate during customs declaration, and subsequently your company can directly use this certificate for input tax deduction without going through the agency institution's transfer process. If the bank requests additional trade background materials during payment, contact the agency institution immediately to synchronize the pre-customs declaration information, and do not submit mismatched materials privately.
In terms of abnormal contingency plans,if a payment suspense account occurs, you need to submit the agency agreement and pre-customs declaration document to the bank immediately for explanation, and do not return the foreign exchange directly along the original path, otherwise it will trigger an abnormal early warning from the foreign exchange authority. After compliance is implemented, you need to retain the complete set of payment documents, agency agreement, and customs declaration documents for at least 5 years for inspection.

After the principal makes direct payment under agency import, pay attention to the consistency of document logic in the customs declaration process: the consignee for consumption on the customs declaration form shall be filled with the full name of the principal, the domestic consignee shall be filled with the full name of the agency import institution, and the remark column must indicate "principal makes direct payment". If the remark information is not marked during customs declaration, the customs authority will identify the payment subject and declaration subject as inconsistent during subsequent inspections, which may result in minor issues such as requiring document deletion and re-submission, or serious issues such as triggering price review investigations, leading to cargo detention and generating high detention and storage fees.
If the customs declaration has been completed without marking the relevant information, you can submit the agency import agreement and payment voucher to the port customs to apply for modifying the customs declaration remarks. As long as the trade background is real, the modification will usually be completed within 3 working days, without going through the document deletion and re-submission process.

Under the premise of the principal's direct payment, attention must be paid to the risk of cargo ownership control: require the overseas supplier to fill the consignee on the bill of lading as "TO ORDER" (without direct indication of the principal), and after arrival, the agency import institution shall endorse and transfer it to the principal. Do not directly fill the principal as the consignee, otherwise if the supplier temporarily fails to deliver goods after payment, the delivery behavior cannot be restrained through the bill of lading.
In addition, agree on the responsibility division for free detention period application with the agency institution in advance, synchronize the payment voucher to the agency institution immediately after payment is completed, complete the bill of exchange procedures as soon as possible, and strive for additional free detention periods to avoid additional detention fees caused by delayed bill of exchange due to payment process.

For agency import business where the principal makes direct payment, after obtaining the dual-title customs payment certificate, the VAT deduction certification must be completed within 90 days from the date of issuance. When certifying, synchronize and upload the agency import agreement and payment voucher as supporting documents.
Do not use the VAT special invoice issued by the agency institution for deduction, otherwise it will be identified as "four flows inconsistent", which may result in minor issues such as requiring input tax transfer, or serious issues such as triggering tax audits, leading to fines and late fees. If you have already used the agency institution's invoice for deduction, complete the input tax transfer in the current period's declaration as soon as possible, and submit a description to the competent tax authority explaining the authenticity of the transaction model to reduce subsequent tax risks.

Give priority to choosing the CIPS channel for RMB cross-border foreign exchange payment. Compared with the SWIFT channel, the arrival time is faster, the exchange rate cost is 0.15%-0.2% lower on average, and it is not restricted by overseas payment paths.
If the payment amount exceeds 500,000 US dollars, submit the trade background materials to the foreign exchange authority for pre-reporting in advance, and do not directly submit the payment application, otherwise it will be identified as an abnormal transaction by the foreign exchange authority system, leading to payment being returned and affecting subsequent payment quotas. After the payment is completed, print the SWIFT or CIPS message and retain it as supporting documents for subsequent inspections. Do not only retain the bank's transfer receipt.

When signing the agency import agreement, clearly stipulate the "principal makes direct payment" clause, and also stipulate that if problems arise in the customs declaration process after payment due to the agency institution's reasons, all resulting losses shall be borne by the agency institution.
In addition, clearly stipulate in the overseas purchase contract that the payment subject is the principal, to avoid the supplier subsequently refusing to deliver goods on the grounds of inconsistency between the payment subject and the contract signing subject. If the previously signed purchase contract does not stipulate the payment subject, sign a supplementary agreement with the supplier as soon as possible to clarify the responsibility division related to payment and avoid subsequent contract disputes.

When the customs authority requires payment documents during on-site inspection of agency import goods where the principal makes direct payment, submit the principal's payment receipt and agency import agreement directly, and do not submit materials related to the agency institution, otherwise the trade background will be identified as suspicious, requiring inspection and testing, extending the goods release time.
If the goods have already been inspected and tested, submit the payment voucher and agency agreement to the inspection department immediately to explain the authenticity of the transaction model. Generally, this can speed up the issuance of test results, shortening the inspection time by at least 3 to 5 days.

Long-term adoption of the agency import model with the principal's direct payment can optimize the overall supply chain cost, reducing payment costs by 0.8%-1.2% on average, shortening the payment arrival time by 3 to 7 days, and enhancing the supplier's cooperation priority.
Agree with the agency institution to adopt FOB trade terms, so that the principal can directly designate the international logistics service provider, further reducing logistics costs and better controlling cargo ownership. If the annual import amount exceeds 10 million US dollars, negotiate exclusive foreign exchange purchase rate discounts with the bank to further reduce payment exchange rate costs.

If there is a need for re-export of the imported goods in the future, the principal's payment voucher is a core supporting document for export tax refund, and must be retained together with the customs declaration form, foreign sales contract, and receipt voucher to ensure consistency of four flows. Do not use the agency institution's payment voucher as tax refund materials, otherwise the tax authority will identify the capital flow as inconsistent, and refuse to handle tax refund.
If tax refund has already been processed, the tax refund amount must be recovered together with late fees. If the agency institution's payment voucher has been previously submitted for tax refund, submit the principal's payment voucher and agency import agreement to the competent tax authority as soon as possible to explain the authenticity of the transaction model and avoid tax refund recovery.
