We are an enterprise focusing on agent import of industrial equipment, and we have just secured a proxy import order for a batch of Germany-manufactured semiconductor testing equipment. The goods will be shipped from Port of Hamburg to Shanghai Yangshan Port soon.

Previously we only handled agency business for ordinary mechanical and electrical equipment, and we have no experience at all in the tax payment process for this high-end testing equipment: we need to clarify the tax calculation base for tariffs and import value-added tax, and also figure out whether the preferential tax policy for temporary import and export is applicable. In addition, if issues such as equipment maintenance during the warranty period or product return and exchange occur later, will there be any changes in the tax payment links?

Are there any special adjustments for agency import in the latest 2026 import tax policies? The price verification dispute mentioned by peers also makes me very anxious. What should we do if the customs challenges the declared price? We hope to get a detailed explanation of the entire tax payment process and key precautions for agent-imported equipment.

First of all,pre-document review and commodity classification must be completed, which is the basic prerequisite for tax payment. Customs commodity code confirmation is particularly critical. The 2026 customs code library has added new temporary preferential tax rate entries for high-end semiconductor equipment. Accurate classification must be conducted combined with the equipment's technical parameters and intended use,to avoid tax rate application deviation caused by wrong code. At the same time, prepare a full set of documents including agency import agreement, commercial invoice, packing list, certificate of origin and other documents. The tax bearing party must be clearly specified in the agency agreement,to avoid subsequent disputes with the principal.

When entering the core tax calculation node, tax calculation rules for different trade scenarios must be distinguished. Take general trade import as an example, the tax base of tariff is CIF transaction value, and import value-added tax is calculated on the base of (customs dutiable value + tariff amount),for agency import,it must be clarified whether the taxes are withheld and paid by the agent or declared by the principal on its own. If the equipment needs to go through bonded maintenance later, temporary import and export filing can be handled with customs in advance to suspend the payment of taxes, and write off after the equipment is re-exported,which greatly reduces capital occupation cost.

If customs price verification dispute occurs, supporting materials must be prepared in time. Price verification supporting documents include the original procurement contract of the equipment, technical parameter specification,third-party testing report, international market quotation in the same period and other materials,to prove the authenticity and rationality of the declared price, avoiding extra costs caused by customs adjusting the dutiable price. If there is document discrepancy or declaration error, the deletion and re-declaration must be completed within 7 working days as required by customs,to avoid extra expenses such as port demurrage and late declaration fee.

In the final compliance implementation link, after tax payment is completed, all full set of documents including tax payment certificates, customs declaration forms, agency agreements must be retained for subsequent tax verification letters or customs inspection. In 2026,the one-stop processing of import tax electronic payment and tax rebate has been realized in some regions. Agents can complete tax payment and document archiving through the Single Window to improve operation efficiency. If subsequent return and exchange is involved, bonded return and exchange filing must be handled with customs in advance,to avoid repeated tax payment.

For the price verification issue of import equipment agency tax payment, the authenticity of transaction value needs to be focused on. The 2026 customs price verification system has been connected to the global trade database, which can automatically compare the declared price with the market trend in the same period.

If the declared price deviates from the threshold, manual review will be triggered. At this time, the full set of materials including the equipment's procurement contract, payment voucher, technical service agreement shall be provided to prove that the price does not include additional undeclared expenses such as royalty and brokerage fee.

If the customs still has doubts, price consultation can be applied, and the price appraisal report issued by a third-party institution can be provided to ensure the compliance of dutiable price. In addition, commodity code classification error is a common risk, classification should be conducted combined with the equipment's function, principle and structure. If necessary, a pre-classification ruling can be applied to customs to confirm the tax rate in advance.

For agency import, the operating unit and consignee unit on the customs declaration form must be clarified. If the agent is the operating unit, it shall assume the responsibility of withholding and paying taxes, and the tax payment node shall be agreed with the principal in advance to avoid capital chain tension.

If temporary import and export goods are involved, the application shall be submitted to the customs 15 working days before import, and the commitment letter of re-export shall be provided. After being approved by the customs, the tax payment can be suspended, and the write-off procedure shall be handled within 6 months when the goods are re-exported later. If the write-off is not completed within the time limit, the taxes shall be supplemented.

The logistics link of import equipment is directly related to tax payment cost, and the plan to avoid free storage period and container detention fee shall be planned in advance. In 2026, the maximum free storage period of Shanghai Yangshan Port can reach 14 days, the free storage period policy of the freight forwarder shall be confirmed before the goods arrive at the port, to avoid extra expenses caused by delayed document review.

If the goods need to be transferred to other ports, the transit procedure shall be handled in advance to avoid port demurrage at the port. In addition, the consignee on the bill of lading shall be consistent with the consignee unit on the customs declaration form. For agency import, the consignee on the bill of lading can be filled as the agent, and then endorsed and transferred to the principal later, to avoid the tax payment process being affected by cargo right issues.

If the equipment is transported by sea with transit, the customs requirements of the transit port shall be noted. Some transit ports require tax payment guarantee to be submitted in advance to avoid the goods being detained.

Meanwhile, direct shipping routes shall be selected to reduce cargo right risks and time cost in transit links, ensure the goods arrive at the port on time, and avoid late declaration fee caused by delay. In addition, logistics expenses shall be listed separately in the commercial invoice, to avoid being combined with the equipment price for tax calculation which increases tariff cost.

Tax planning for import equipment agency tax payment can start with VAT deferral. In 2026, the import value-added tax deferral policy has been fully implemented by customs nationwide. Agents can suspend the payment of import value-added tax at the time of import, and then declare and pay the tax to the tax authority when selling the goods later, which effectively reduces capital occupation cost.

It should be noted that VAT deferral is only applicable to goods imported under general trade, and customs filing is required with the general taxpayer qualification certificate of the principal provided. In addition, if the equipment is used for R&D purposes, preferential tax policies for R&D equipment import can be applied for to reduce or exempt part of the tariff and import value-added tax, and the supporting documents of R&D projects shall be prepared in advance.

Cross-border related party transaction pricing is also a point that needs attention. If the agent has a related relationship with the overseas supplier, the transaction price shall conform to the arm's length principle to avoid the dutiable price being adjusted by the tax authority.

At the same time, the pricing documents of related party transactions shall be retained for tax inspection. If subsequent maintenance and spare parts replacement are involved, the procedures shall be handled in accordance with the relevant provisions of bonded maintenance to avoid repeated tax payment.

In addition, the time node of foreign exchange payment shall be noted, the payment shall be completed within 180 days after the goods are imported, to avoid being included in the foreign exchange concern list.

If agency commission payment is involved, non-resident enterprise income tax shall be withheld and paid in accordance with relevant provisions, and the withholding and payment voucher shall be retained.

At the same time, the commission amount shall conform to the industry standard, to avoid being recognized as the adjustment item of transaction value by the customs. The tax payment cost of import equipment agency can be optimized through supply chain planning. Bulk import of equipment can be adopted through centralized procurement, to reduce unit tariff cost. Meanwhile, appropriate trade terms can be selected.

If FOB term is adopted, the tax calculation base of freight and insurance premium can be reduced to cut down tariff cost. In addition, the RCEP rules of origin can be utilized. If the origin of the equipment meets RCEP requirements, agreement tariff can be applied for to reduce tariff cost.

If the equipment needs to be imported in batches, bonded warehouse can be adopted to suspend tax payment, and pay tax when the equipment is sold later, which reduces capital occupation cost.

Meanwhile, establish long-term cooperative relationship with freight forwarders and customs, understand the latest policies and processes in advance, to optimize the efficiency of tax payment links. In addition, establish a supply chain risk early warning mechanism to respond to policy changes and market fluctuations in a timely manner, and reduce tax payment risks.
