I have been engaged in cross-border daily goods purchasing agency for almost 3 years. Usually I help customers in domestic first-tier and second-tier cities to purchase overseas viral snacks, organic complementary foods for infants and young children, functional soft drinks and other food products. In the past, when the order volume was small, I cleared customs through the personal postal articles channel and never had problems. Recently I have connected with 3 large B customers running community group buying, whose required cargo volume has increased by more than ten times, with more than a thousand pieces per single order.

If I still use the personal postal articles channel, the customs will definitely determine the goods as commercial cargo and detain them. Now I don't want to go through the trouble of registering a company, and want to act as an agent to import this batch of food in my personal name, but I am afraid of being fined for illegality or even included in the credit blacklist. I want to know whether it is legal for individuals to act as agents for imported food, and what conditions need to be met to complete normal customs clearance without crossing regulatory red lines?

Many people mistakenly believe that individuals can act as agents for imported food as long as they can find supply sources and have customers, which is the most common misconception in the industry. According to the latest 2026 Import and Export Food Supervision Regulations, individuals do not have the right to import and export operations, and cannot obtain qualifications required for food import such as consignee and consignor record-filing,food label record-filing,etc. Directly declaring imported food for commercial use under personal name will be 100% determined as irregular declaration.

The chain reaction of irregular declaration starts with direct cargo detention. Afterwards, the goods will either be ordered to be returned, incurring extra costs such as round-trip ocean freight and demurrage,or be directly destroyed by customs, resulting in total loss of cargo value. In serious cases, violators will be fined 5 to 20 times the cargo value,or even included in the cross-border dishonesty list, and cannot conduct any personal cross-border shopping declaration for 3 consecutive years.

If you want to legally carry out individual imported food agency business, the simplest physical risk isolation measure is to affiliate to a formal import and export agency company with valid food import qualifications, and use the agency company's qualifications to complete full-process compliance declaration. When handling affiliation, you must require the agency company to provide a dual-named customs declaration form. As the actual cargo owner, you can normally deduct input tax,and legally sell this batch of goods in the domestic market.

If your personal declaration has already led to cargo detention,do not submit documents for explanation by yourself immediately. First find a qualified agency company to liaise with customs, submit a situation statement to change the declarant to the agency company, pay the corresponding tax and late payment surcharge, and you can pick up the goods in as fast as 3 working days, which can reduce over 80% of cargo loss risks.

In 2026, the customs implements very strict review on declarants of imported food. Declarations under personal name are only limited to personal postal articles with reasonable quantity for self-use, the value of a single shipment shall not exceed 5000 RMB, and the goods shall not be used for commercial sales.

If the cargo value exceeds the limit and the shipment is of trade nature, the system will directly trigger a red alert, and the documents will be transferred to manual review before direct cargo detention. If your submitted personal declaration has been rejected, do not submit repeated declaration requests, which will be determined as malicious declaration and lead to heavier penalties.

The correct operation is to cancel the original personal declaration record first, then entrust an enterprise with import and export food operation qualifications to re-declare. When declaring, you need to truthfully submit a full set of documents including certificate of origin, sanitary certificate, component testing report, etc. As long as the documents are complete and meet regulatory requirements, price verification and customs clearance can generally be completed within 2 working days.

If you choose to ship imported food in batches through the personal postal articles channel as an individual agent, do not split multiple parcels under the same recipient and same address. The logistics system will automatically identify such parcels as bulk trade goods and transfer them directly to customs inspection.

If the total cargo weight exceeds 500kg, it is recommended to go through the general trade channel directly, communicate with the agency company about the logistics route in advance, and give priority to direct sailing routes to avoid extra costs caused by secondary inspection at transit ports. When booking space, you can ask the shipping company to apply for 14 days of free storage period and 7 days of free container period.

Even if inspection is required, there will be no high demurrage and container detention charges. 3 days before the goods arrive at the port, prepare the full set of customs clearance documents in advance, submit declaration immediately upon cargo arrival, so that the overall logistics lead time can be controlled within 7 days.

If the individual agent for imported food fails to declare in compliance, not only will the violator be fined by customs, but the subsequent sales income will also be determined as untaxed income. The tax authority will recover value-added tax and individual income tax, and collect 0.5 to 5 times of tax late payment surcharge. For food imported through a formal agency company, the actual cargo owner indicated on the dual-named customs declaration form can normally deduct 13% of the import value-added tax.

Qualified applicants can also apply for VAT deferral, which means there is no need to pay value-added tax at the customs clearance stage, and complete input tax deduction after domestic sales, which can save 1 to 2 months of capital occupation cost. Please note that all customs declaration forms, tax receipts, logistics vouchers and sales contracts shall be properly reserved for subsequent tax verification to avoid being recognized as tax evasion.

If the individual agent for imported food directly uses a personal account to pay and receive overseas , any single transaction over 50,000 USD will trigger a foreign exchange regulatory alert, be determined as illegal cross-border settlement, the account will be frozen, and a fine will be imposed. If you collect and pay foreign exchange through a formal agency company, you only need to transfer the RMB payment to the agency company, who will directly handle foreign exchange purchase and payment with overseas suppliers.

All operations comply with foreign exchange regulatory requirements, and the exchange rate for settlement can lock in the optimal exchange rate of the current period, reducing 1% to 2% of loss caused by exchange rate fluctuation. After the foreign exchange payment is completed, you can ask the agency company to provide the SWIFT message receipt, so you can check the payment arrival status at any time without worrying about capital safety.

Before acting as agent for imported food, you shall sign a formal purchase contract with overseas suppliers. The contract shall clearly mark the ingredients, shelf life and origin of the food, and add a force majeure clause. In case of port lockdown, inspection delay and other situations, you can apply for partial payment reduction from suppliers. When signing an agency agreement with the agency company, clarify the rights, responsibilities and obligations of both parties.

For example, all losses caused by cargo detention due to qualification problems of the agency company shall be borne by the agency company. You shall also pay attention to the intellectual property rights of imported food. Do not act as agent for brand food without domestic authorization, otherwise the goods will be detained by customs, and you shall bear compensation liability for intellectual property infringement.

During arrival inspection of imported food, the customs will focus on checking whether the food labels meet domestic standards, including whether there are Chinese descriptions of ingredients, shelf life, origin and importer information. Food without Chinese labels or with unqualified labels will be directly detained, and require rectification or return.

If the food you represent has been transported to the inspection site, do not tear and paste labels privately, which will be determined as intentional concealment of information and lead to heavier penalties. You can entrust on-site staff of the agency company to cooperate with the inspection, submit a label rectification plan in accordance with customs requirements, and the goods can be released normally after the rectification passes the verification.

If the goods are required to be sent for laboratory test, actively cooperate and submit the materials required for testing. The test report will generally be issued within 7 working days, and the goods will be released immediately after passing the test.

The packaging of imported food must meet domestic transportation and regulatory requirements. The packaging of pre-packaged food shall clearly mark storage conditions. Food that requires cold chain transportation must use temperature-controlled packaging with built-in temperature recorder to ensure that the full-process temperature data is traceable.

For functional drinks containing alcohol and fermented food, complete hazard classification appraisal in advance. Products classified as low-risk shall use UN standard packaging with corresponding hazard labels pasted on the package, otherwise logistics providers will refuse to accept the shipment and the customs will detain the goods.

The packaging shall be treated with moisture-proof and cushioning measures to avoid food pollution caused by packaging damage during transportation. Once the food is polluted, it will be destroyed directly and cannot be sold on the market.

Individual agents for imported food shall ensure the consistency of cargo flow, capital flow, document flow and invoice flow. The subject information of all purchase contracts, customs declaration forms, tax receipts, logistics vouchers and sales invoices shall correspond to each other.

Otherwise, in case of subsequent tax verification letter, if you cannot provide a complete document chain, the transaction will be determined as false invoicing, and you need to make supplementary tax payment and pay fines. If you have the demand for subsequent re-export of the food, reserve all import documents in advance.

Qualified applicants can apply for refund of the value-added tax paid at the import stage. When declaring, separate the documents of re-export goods from those of domestic sales goods for archiving to avoid declaration errors leading to tax refund failure.

If the monthly order volume of individual imported food agency business stably reaches 1 full container or above, you can negotiate with the agency company to customize a supply chain solution, choose CIF trade terms, and let overseas suppliers be responsible for transportation and insurance, which can reduce logistics cost and lower cargo loss risk at the same time. You can make batch import plans according to sales forecast, store the goods in a bonded warehouse in batches, and deliver the goods directly from the bonded warehouse after customers place orders, which can shorten the logistics lead time to within 3 days.

You can also enjoy the tax preferential policies of bonded warehouses, do not need to pay the full import tax at one time, and the capital occupation cost can be reduced by over 30%. You shall adjust the inventory turnover cycle according to the shelf life of the food to avoid losses caused by unsalable nearly-expired products.
