Core Division of Rights and Liabilities Between Import-Stage Taxes and Foreign Trade Agent Tax-Related Affairs
Many first-time importers often confuse the subject of import-stage tax payment obligation and the declaration responsibility of foreign trade agents. The newly revised 2026 *Regulations on the Administration of Declaration of Import and Export Goods* explicitly stipulates that the consignee of imported goods is the taxpayer, and the foreign trade agent as the entrusted declaration party only bears joint and several liabilities for the authenticity and accuracy of the submitted declaration data.Unclear division of rights and liabilities easily leads to tax-related disputes.

Tax-related responsibilities vary greatly under different declaration modes. Most importers run into problems because they do not clarify the boundary of rights and liabilities in the early stage.Specific division rules can be referred to in the table below:
| Comparison Item | Self-Declaration | Entrusted Declaration via Foreign Trade Agent |
|---|---|---|
| Tax Obligor | Consignee of imported goods | Consignee of imported goods |
| Liability for Declaration Errors | 100% borne by the importer | The agent bears liabilities for errors in data submitted by the agent, while the entrusting party bears liabilities for errors in materials provided by the entrusting party |
| Eligible Entity for Tax Deduction | Importer | Deduction is eligible for the entrusting party under dual-header declaration, and eligible for the agent under single-header declaration |
| Eligible Entity for Supplementary Tax / Tax Refund Application | Submitted by the importer independently | The agent may assist in submitting the application, with all supporting materials provided by the entrusting party |
| Risk Bearing Ratio | 100% borne by the importer | Divided based on agreed rights and liabilities in the contract, and the agent may bear up to 80% of losses caused by declaration errors |
Core Practical Points for 2026 Import-Stage Tax Calculation & Declaration
The 2026 customs valuation model adds a cross-verification rule for logistics trajectories, which greatly improves the accuracy of CIF price inspection for general imported goods.Declaration only with invoices and contracts can no longer pass customs valuation.Three core points need to be highlighted during calculation and declaration:
- Accurate HS code classification.A deviation of more than 2 digits in HS code classification will directly trigger customs control inspection. In 2026,the most-favored-nation tariff rates and RCEP agreed tariff rates for 1270 HS codes are adjusted.Do not classify HS codes directly based on past experience. It is recommended to apply for customs advance classification rulings in advance,to avoid wrong application of tax rates caused by classification errors, which leads to supplementary tax and late payment interest.Last year,we served a client Mr.Su from Suzhou, who self-classified a batch of laboratory instruments into a lower tax rate HS code by mistake. He was required to make a supplementary tax payment of RMB 180,000,plus RMB 21,000 of late payment interest after customs verification.
- Consistency check of declaration elements. The brand, model, material and specification filled in the declaration must be completely consistent with the physical goods, original manufacturer invoice, purchase contract and packing list.Even a single letter deviation may trigger customs valuation. For goods eligible for tariff preferences under RCEP,the declaration elements must also fully match the information on the certificate of origin, otherwise the preference eligibility will be directly cancelled, and tariffs will be levied at the most-favored-nation rate.
- Compliance verification of certificate of origin. In 2026,global electronic online verification for RCEP certificates of origin has been fully realized. Before submitting the declaration, check in advance whether the goods meet the cumulative rules of origin,to avoid that the certificate of origin provided by the supplier does not meet preference requirements, resulting in failure to enjoy tariff reductions. This year,we verified certificates of origin in advance for 32 clients, identified 11 non-compliant certificates, and arranged suppliers to replace them in time, avoiding total tax losses of RMB 7.6 million for our clients.
Common Tax-Related Risks of Foreign Trade Agents & Risk Avoidance Guide
Many importers select foreign trade agents only by service quotation, ignoring potential tax-related risks. Some low-price agents set quotations far below the market average level, and make profits through illegal tax-related operations. There are three major types of common risks:
The first category is hidden cost traps. Some agents split the tax calculation process, and charge extra hidden fees such as customs valuation coordination fee, document amendment fee, certificate of origin verification fee. They even deliberately declare wrong HS codes to underreport tariffs, and shift all liabilities to the entrusting party when customs launch verification, collecting service fees without taking any corresponding risks. In 2026,Shanghai Port has publicly notified 3 such illegal agent cases, and the 17 involved importers were all required to make supplementary tax payment and pay late payment interest.
The second category is exchange loss risk.In 2026,the RMB exchange rate shows expanded two-way fluctuation range. The central parity rate of the RMB published by the People’s Bank of China on the third Wednesday of the previous month is applied for customs to levy import-stage taxes. Some agents use self-defined conversion rates 1 to 2 percentage points higher than the official customs levy rate, collecting extra disguised taxes from clients, which may cause importers to pay over RMB 100,000 extra per year simply from unnecessary exchange losses.

The third category is occupied tax deduction quota risk. For goods declared under single-header mode, the import value-added tax deduction quota will be credited to the agent’s account. Some non-compliant agents will embezzle clients’ deduction quotas without permission,or delay issuing special VAT invoices to clients, leading to clients’ failure to deduct input VAT in time and resulting in capital occupation losses.
Rooted at Shanghai Port,Zhongshitong’s service team supports cross-port declaration across all ports in China, and our global agent network covers 37 major trading countries. We can predict tariff adjustments and anti-dumping policy changes in various countries in advance. Before the EU announced additional anti-dumping tariffs on certain hardware tools in 2026,we sent early warnings to 19 cooperating clients, assisted them in adjusting supply chain layout, and helped each client reduce tax expenditure by RMB 820,000 on average.
Fast Resolution Path for Tax-Related Disputes
If you encounter customs valuation objections or supplementary tax requirements, you do not need to accept the penalties directly. In 2026,customs has launched a fast handling channel for import tax-related disputes.Foreign trade agents can assist in submitting materials including original manufacturer invoices, purchase contracts, international logistics documents and payment vouchers to apply for price negotiation. As long as the transaction is authentic and compliant, the vast majority of customs valuation objections can be resolved through negotiation.
Last month,we just helped a furniture importer in Guangzhou handle its valuation objection. The importer’s previous agent underreported the value of imported furniture, and the importer was required to make supplementary tax payment of RMB 270,000 after customs verification. After taking over the case,we assisted the importer to submit full sets of authentic transaction vouchers, and conducted two rounds of price negotiation with customs. Finally, the importer only needed to pay RMB 12,000 as supplementary tax with all late payment interest waived, reducing the total loss of around RMB 280,000 for the client.
The core of import-stage tax calculation and declaration is compliance. As long as you complete pre-classification review, document verification and clear rights & liabilities division in advance, you can realize both full compliance and tax saving without taking risks through illegal operations.
