I am the person in charge of a small foreign trade company. We have been exporting clothing to Europe through agents for a long time.
Recently, our cooperating agent said that policies will become stricter in 2026 and they dare not take new business. Our batch of goods worth RMB 500,000 is scheduled to be shipped next month, and the client is pressing for delivery.
We do not have import and export rights on our own, and wonder if agent export services are still available now. We are afraid of being investigated for violations, failing to obtain tax refund, and even affecting subsequent business, so we are eager to know the specific risks and operation points.

Agent export business is not impossible to carry out,but the compliance requirements will be stricter in 2026,and many enterprises fail to operate properly due to neglect of details. A common misunderstanding is that hiring an agent is enough, while ignoring the core requirement of four-flow consistency -- capital flow, cargo flow, document flow and invoice flow must be fully matched.
If the four flows are inconsistent,it will trigger a chain reaction: the tax authority will launch correspondence verification, and tax refund will be temporarily withheld, the customs will deem the transaction abnormal, leading to cargo seizure or port detention,in severe cases, the enterprise will be included in the tax dishonesty list, affecting subsequent business.
Risk isolation measures include: selecting agents with complete qualifications, signing a clear responsibility agreement, reviewing all documents in advance to ensure consistent information on contracts, invoices and bills of lading, keeping transaction vouchers for at least 5 years.
Exclusive loss prevention tips: check data with pre-declaration verification tool before pre-declaring tax refund, provide authentic certificates in time when receiving correspondence verification, carry out regular internal compliance self-inspection to avoid small problems turning into major risks.

When declaring customs for agent export, the remarks column shall indicate "agent export" as well as the name and unified social credit code of the entrusting party. Failure to make such indication may be deemed as self-operated export, leading to obstruction of tax refund.
Authentic transaction certificates such as procurement contracts and bank receipts shall be provided during customs valuation to ensure a closed loop of price logic. In case of customs valuation disputes, transaction records of similar goods or industry reports can be submitted for support to avoid order deletion and re-declaration.

The key to cargo right control for agent export: the bill of lading shall be endorsed by the agent to the entrusting party or the client to avoid loss of cargo right. In case of container rolling, negotiate with the shipping company for priority stowage in time, record the time point of container detention fee, and apply for exemption if the delay is caused by the shipping company.
If the container is not picked up within the free storage period, apply for extension in advance to reduce extra costs. Choose direct routes for transit to reduce cargo damage risks.

VAT handling for agent export: the agent shall issue service fee invoices, and the entrusting party shall handle tax refund with agreements and customs declaration forms. Cross-border related transaction pricing shall comply with the arm's length principle to avoid BEPS risks.
VAT deferral can reduce capital occupation, but shall meet the requirements of the importing country. For example, registration of a local VAT number and regular declaration are required for the EU.

Use the CIPS system for foreign exchange receipt and payment to ensure that the capital flow is consistent with the contract. Offshore accounts shall comply with local regulations to avoid freezing.
Trade background certificates such as contracts and bills of lading shall be provided for foreign exchange settlement to avoid being deemed abnormal by the bank. Choose a period with stable exchange rate for foreign exchange purchase, or use forward foreign exchange settlement and sale to lock in risks.

The agency agreement shall clarify the responsibilities of both parties: the agent is responsible for customs declaration, logistics and tax refund, and the entrusting party provides documents and pays funds.
Soft clauses of letters of credit shall be reviewed in advance, such as "the bill of lading shall be signed by a person designated by the issuing bank", to avoid payment refusal. The force majeure clause shall cover delay responsibilities caused by epidemics, wars and other events, and cargo right transfer shall be completed through bill of lading endorsement.

Four-flow consistency is required for agent export tax refund: capital flow (entrusting party → agent → supplier), cargo flow (supplier → port → client), document flow (customs declaration form, bill of lading), invoice flow (supplier → agent → entrusting party).
Verify data during pre-declaration, such as ensuring the amount on the customs declaration form is consistent with that on the invoice. Provide authentic vouchers during correspondence verification to ensure approval.

Agent export cost actuarial calculation: compare the cost difference between self-operation and agency, including agency fee, logistics fee and tax refund time cost. For CIF/FOB conversion, consider the bearer of freight and insurance premium to avoid overspending.
Link inventory information with the agent in real time to ensure timely delivery. Warehousing and entrepot trade in bonded zones can reduce tariff costs.
