I am a small and medium-sized cross-border e-commerce merchant focusing on home goods categories. I just expanded the self-operated site market in Europe and the United States in 2026. Last month, I entrusted an agency company to handle one 20ft container of storage supplies. During customs declaration, the customs required me to provide an Export Agency Certificate.

I asked the upstream supplier factory for it, but the factory said they only do domestic sales and never issued such certificates. Then I turned to the agency company for the document, but they claimed that the certificate should be prepared by the entrusting party and is not their responsibility to issue. Now the cargo has been stranded at Yangshan Port for 3 days, and the container detention charge is rising every day.

I am rushing to restock the West US overseas warehouse. If the delay continues, the site listing will be demoted due to stockout, and the hundreds of thousands of yuan I invested in traffic advertising will be completely wasted. I am too anxious to sleep, and I want to figure out who exactly provides the Export Agency Certificate, and how to remedy the current port detention issue.

First of all,it shall be clarified that under the current customs supervision requirements in 2026,the legal issuing entity of the Export Agency Certificate is a formal export agency service provider with import and export operation qualifications. The prevarication of the agency company you are cooperating with now is an irregular operation. The first step you need to take is to immediately require them to issue the Export Agency Certificate affixed with their official seal within 1 working day,and provide the scanned copy of their Import and Export Operation License at the same time. On your side, you need to supplement the entrustment export agency agreement affixed with your official seal, then submit the two sets of documents to the customs broker synchronously, and prioritize the emergency declaration channel.

Secondly, you need to check the document matching details: the goods description,HS code, and cargo value on the Export Agency Certificate must be 100% consistent with the pre-recorded customs declaration form, commercial invoice, and packing list, without any character error, otherwise the customs will send it back for re-examination,further prolonging the port detention time. You can require the agency company to arrange a dedicated person to liaise with the customs document window. At present,Shanghai Port has a 24-hour expedited review authority for e-commerce restock goods. Qualified goods can be prioritized for release, and the document review and customs clearance can be completed in as fast as 4 hours.

For the current container detention charge, you can ask the agency company to assist you in applying to the shipping line for a 3-7 day extension of the free detention period. In 2026,for port detention caused by non-cargo owner responsibilities at Shanghai Port, shipping lines generally have flexible quota policies, which can cover up to 80% of the detention charge expenses. You can submit the responsibility statement issued by the agency company to apply for the policy.

Before you entrust export agency services in the future, you must clarify the document issuing responsibility at the agreement signing stage, and write the issuing time limit and error compensation clauses for required documents including the Export Agency Certificate and Customs Declaration Entrustment Letter into the contract, agreeing that the responsible party shall bear all losses caused by port detention, tax refund failure and other related issues. In addition, you can synchronize the business license of the supplier factory and product quality inspection reports to the agency company in advance for pre-audit,to avoid similar problems in subsequent operations.

The issuing entity of the Export Agency Certificate must be a subject that has completed the import and export operation right filing with the customs. If the entrusting party does not have import and export qualifications, the entrusted agency company must issue the certificate.

If the agency company refuses to issue it, you can submit a complaint application to the customs, provide the entrustment agency agreement signed by both parties, and the customs will impose penalties on the agency company for irregular operations. Meanwhile, you can apply for a temporary customs liaison channel, go through the cargo release procedures first with the entrustment agreement, and submit the official Export Agency Certificate later by mail.

Please note that the validity period of the Export Agency Certificate is only 15 days. The declaration must be completed within the validity period after issuance, otherwise the certificate needs to be reissued. The certificate shall be affixed with the customs seal of the agency company, and the administrative seal cannot be used instead, otherwise the certificate will be judged as invalid.

Now that your cargo is stranded at Yangshan Port, you shall first confirm the remaining duration of the free storage period and free detention period of the shipping line. The free detention period for ordinary 20ft containers is generally 7 days, and the free storage period is 5 days. You have been in port detention for 3 days now, with 2 days of free storage period left. You need to strive to complete the release before the free storage period expires, otherwise you will have to pay extra storage fees.

You can ask the agency company to coordinate with the shipping line to issue a port detention cause statement, submit it to the terminal to apply for a temporary free storage extension, which can be extended for a maximum of 3 more days. If you cannot catch up with the original booked sailing schedule, you can arrange to transfer to the next vessel of the same route. At present, the cabin vacancy rate for Europe and US routes is around 12%. You do not need to pay extra cabin penalty for vessel transfer, only need to pay a document amendment fee of around 150 yuan, which is more cost-effective than paying high port detention fees.

The Export Agency Certificate is one of the required documents for export tax refund declaration. If you cannot provide a formal Export Agency Certificate, you will not be able to declare the 13% export tax refund for this order, and directly lose 13% of the profit based on the cargo value. Please note that the title on the Export Agency Certificate must be completely consistent with the business unit title on the customs declaration form, which means it must be the title of the agency company, and cannot be filled with the title of the entrusting party, otherwise the tax authority will judge the documents are inconsistent and reject the tax refund application.

If the agency company is unwilling to issue the certificate, you can require them to return the already collected agency service fee, and bear the compensation responsibility for your tax refund loss. You can submit proof to the tax authority with the entrustment agreement to apply for a delayed tax refund declaration, which can be delayed for up to 3 months, leaving you enough time for negotiation.

The Export Agency Certificate is also one of the required documents for subsequent foreign exchange collection and settlement. If you cannot provide a formal Export Agency Certificate, the bank will judge that your transaction background is questionable, and cannot handle the foreign exchange settlement procedures for you. The received foreign exchange will be suspended in the pending verification account, which can only be retained for a maximum of 6 months, and will be returned in the original path after expiration.

You need to ensure that the error between the cargo value on the Export Agency Certificate and the subsequent foreign exchange collection amount does not exceed 5%, otherwise the bank will require you to provide additional transaction supporting materials, which will prolong the foreign exchange settlement time. If you settle RMB through the CIPS channel, you also need to submit the Export Agency Certificate synchronously to the Cross-border RMB Settlement Center for filing, otherwise the funds cannot be normally received.

If there is no clear agreement on the document issuing responsibility in the entrustment agency agreement signed by you and the agency company, in accordance with the latest *Cross-border Agency Trade Administration Regulations* implemented in 2026, all customs clearance documents in export agency businesses shall be issued by the entrusted agency party, and the relevant expenses incurred shall also be borne by the agency party. You can rely on this clause to require the agency company to immediately issue the Export Agency Certificate, and bear all your losses caused by this port detention.

If they refuse, you can file a complaint with the local foreign trade industry association, or file a small claim lawsuit with the court. The trial period for such cases is only 15 days, and the winning rate is over 98%. You can also require the other party to bear all rights protection costs including legal fees and litigation fees you incurred.

If your cargo has not been arranged for X-ray inspection yet, you can first apply to the customs for an advance X-ray inspection, no need to wait for the Export Agency Certificate to be in place before queuing. For cargo with normal X-ray inspection results, it can be directly released after the documents are in place, no need to go through the manual inspection process, which can save at least 2 days.

If the X-ray inspection is abnormal and unpacking inspection is required, you can arrange the warehouse staff to be present for cooperation in advance, prepare the packing list and product instruction manual of the goods in advance, and submit them directly to the customs inspector during inspection to speed up the inspection process. Please note that if the goods are detained by the customs for more than 15 days due to incomplete documents, the customs will move the goods to the supervised warehouse. The supervised warehouse storage fee is 3 times of the ordinary storage fee per day, and you should try your best to avoid this situation.

Your goods are home storage supplies, which belong to ordinary goods. As long as the packaging meets conventional transportation requirements, you do not need to provide additional UN packaging certificate, nor do you need to conduct dangerous goods classification appraisal, and the packaging will not affect customs clearance. If unpacking is required during subsequent inspection, you shall remind the on-site staff not to damage the original packaging of the goods, otherwise the goods cannot be normally put on shelves for sale after being delivered to the overseas warehouse, and the resulting cargo damage shall be borne by the agency company.

If you take the route to West US ports, you can require the agency company to apply for moisture-proof packaging reinforcement for the goods. At present, the moisture-proof reinforcement fee at Shanghai Port is 25 yuan per cubic meter, which can effectively avoid the problem of damp and mold during sea transportation, and reduce the return rate of the overseas warehouse.

The Export Agency Certificate needs to be filed and retained together with the customs declaration form, foreign exchange collection voucher, entrustment agency agreement, and special VAT invoice for 10 years. The tax authority will conduct random inspections at any time. If you cannot provide the Export Agency Certificate during the random inspection, you will be judged as tax fraud.

You will not only have to return the already received tax refund, but also pay a fine of 1 to 5 times the tax refund amount. In serious cases, you will be included in the dishonest list, and cannot handle export tax refund for 3 years. After you get the Export Agency Certificate, you shall scan and archive it as soon as possible, and upload it to the tax refund declaration system for pre-verification.

After confirming that there is no problem with the documents, submit the formal tax refund declaration. The pre-verification result will be released within 24 hours, and you can modify the problems in time, no need to wait for the formal declaration to be rejected before handling, which can save at least 1 month of tax refund processing time.

For your subsequent export businesses, you can prioritize selecting agency service providers directly connected with the port. The document issuing time of such service providers is 3 times faster than that of ordinary agency companies, and there will be no prevarication issues.

The average customs clearance time can be shortened by 40%. You can also sign a long-term cooperation agreement with the agency company, agree on fixed document issuing time and compensation standards, which can reduce logistics costs by around 15%.

In addition, you can synchronize the issuing requirements of the Export Agency Certificate to your upstream factory, require the factory to provide accurate information such as goods description, quantity, and HS code 3 days before delivery, to avoid additional costs and time losses caused by subsequent document modification. The overall supply chain efficiency can be improved by over 20%.
