Our company recently received a batch of agent export orders, the entrusting party is a factory without import and export rights, and we are responsible for the full process of customs declaration and logistics. However, we once encountered a situation where the customs returned the declaration form due to incorrect filling of the business unit, and we are in a dilemma this time: which party should be filled in as the business unit, consignor/consignee, and end user on the customs declaration form, our company or the factory?

How to fill in if a third-party intermediary is involved? Recently, we heard from colleagues that the customs has new filling specifications in 2026, will there be any changes? We are very anxious because we are afraid that incorrect filling will lead to cargo detention again, delay delivery and affect tax refunds.

First, clarify the latest 2026 customs filling rules for agent export customs declaration: the business unit must be filled with the agent with import and export operation rights (i.e. your company). The consignor/consignee shall be distinguished between domestic and overseas situations: if the entrusting party is a domestic factory without import and export rights, fill in your company as the consignor/consignee,if the final overseas buyer is the actual consignee, the overseas buyer can be marked, but a complete entrustment agreement must be provided.

Pre-document review details: The agent export agreement of the entrusting party and the purchase and sales contract of the factory must be requested in advance to clarify the ownership of the goods, and at the same time confirm that the foreign exchange collection subject is consistent with the business unit on the customs declaration form,so as to avoid tax investigation caused by inconsistency among contract, goods, fund and invoice flows.

For core node connection,if a third-party intermediary is involved, the information of the actual entrusting party shall be indicated in the "remarks column" of the customs declaration form, and the authorization documents between the intermediary and the entrusting party shall be submitted at the same time to ensure a closed logical chain.

For abnormal contingency plans,if the customs raises questions about the filled subject, complete supporting documents for the agency business, including fund flow records, logistics documents and agreement documents, shall be provided immediately to cooperate with the customs to complete the re-declaration or declaration deletion and re-submission.

For final compliance implementation, please note that the customs launched an intelligent verification system for customs declaration subjects in 2026,which will automatically compare the import and export qualifications of the business unit when filling in the form. If the entrusting party has no relevant qualifications, the system will directly intercept the declaration. Therefore,be sure to complete the qualification verification in advance, and keep all documents on file for subsequent tax refund verification.

It is also specially reminded that the end user shall be filled with the overseas enterprise that actually uses the goods finally, and the agent shall not be filled in at will, otherwise it will lead to inconsistency between the foreign exchange collection subject and the customs declaration subject, which will affect the compliance of foreign exchange settlement.

For the subject filling of agent export customs declaration forms, it is necessary to focus on the new "subject traceability" rule launched by the customs in 2026. The business unit must be consistent with the enterprise that actually handles the customs declaration procedures, that is, the agent. If the entrusting party has import and export rights, the entrusting party can be selected as the business unit, but the agency filing must be completed in the single window in advance.

The filling of the consignor/consignee column shall be distinguished between domestic and overseas. When the domestic entrusting party has no qualifications, the agent must be filled in; if the overseas buyer is the actual consignee, supplementary explanation can be made in the remarks column, and the entrustment authorization letter shall be submitted at the same time.

If the declaration form is returned due to incorrect filling, the entrustment agreement and goods ownership certificate shall be checked immediately, and declaration deletion and re-submission shall be preferred over form modification to avoid affecting the customs clearance time limit. For cross-port agent export, it is necessary to ensure data linkage between the local customs of the business unit and the port customs to avoid information mismatch.

Goods ownership control of agent export is strongly related to the subject of the customs declaration form. The consignee on the bill of lading shall be consistent with the consignor/consignee on the customs declaration form. If the consignor/consignee on the customs declaration form is the agent, the bill of lading shall be endorsed and transferred to the entrusting party or the overseas buyer.

If a transit port is involved, the customs requirements of the transit port shall be confirmed in advance to avoid container detention charges caused by inconsistent goods ownership information. At the same time, the application for free storage period and free detention period shall be submitted in the name of the business unit to ensure that the fee settlement subject is consistent with that on the customs declaration form, so as to avoid fee disputes.

For logistics route selection, direct routes are preferred to reduce the number of goods ownership transfers in transit links and reduce the complexity of customs declaration subject verification. If transit is necessary, the ownership of goods at the transit port shall be clearly indicated on the bill of lading, and the remarks information of the customs declaration form shall be updated synchronously.

The core of tax compliance for agent export is the consistency among contract, goods, fund and invoice flows, that is, the above four flows match the subject of the customs declaration form.

When the business unit is the agent, the value-added tax invoice shall be issued by the entrusting party to the agent, and the agent shall then issue the agency service fee invoice to the entrusting party. At the same time, the foreign exchange shall be paid by the overseas buyer to the agent, and then transferred by the agent to the account of the entrusting party.

In 2026, the State Taxation Administration upgraded the intelligent risk control system for export tax refunds, which will automatically compare the business unit on the customs declaration form with the invoice issuing subject. In case of inconsistency, tax investigation will be triggered.

Therefore, it is necessary to keep a good record of the fund flow ledger in advance, and keep the vouchers of each foreign exchange receipt and payment to ensure that complete materials can be provided quickly during tax verification.

The compliance of cross-border foreign exchange receipt and payment is directly related to the subject of the customs declaration form. According to the new foreign exchange administration regulations in 2026, the foreign exchange collection subject for agent export must be consistent with the business unit on the customs declaration form, that is, the agent.

If the overseas buyer pays the payment directly to the entrusting party, it will be regarded as illegal foreign exchange collection and face penalties from the State Administration of Foreign Exchange. Therefore, it is necessary to communicate the foreign exchange collection account information with the overseas buyer in advance to ensure that the payment enters the foreign exchange account of the agent.

At the same time, the attribute of agency business shall be clearly marked through CIPS or SWIFT messages, and "agent export payment" shall be indicated in the remarks to avoid the bank classifying the fund as general trade payment and leading to system suspension. If the foreign exchange collection subject is inconsistent, contact the State Administration of Foreign Exchange immediately for explanation, and submit the agency agreement and customs declaration materials to complete the correction.

The legal risks of agent export are mainly concentrated in the ownership of goods and division of responsibilities. The filling rules of the customs declaration subject and the responsibility boundary of both parties shall be clearly specified in the entrustment agreement.

If the customs detains the goods due to incorrect filling of the customs declaration form, it shall be clearly specified which party shall bear the loss. At the same time, the responsibility for document filing shall be agreed in the agreement to ensure that the agent keeps complete customs declaration, logistics, foreign exchange receipt and payment materials for subsequent legal disputes.

If a third-party intermediary is involved, the scope of authority of the intermediary shall be clearly specified in the agreement to prevent the intermediary from modifying the customs declaration information beyond its authority. At the same time, the intermediary shall be required to provide the authorization documents with the entrusting party to ensure the legality of the customs declaration subject and avoid the situation of unauthorized agency.

During on-site customs inspection, the customs will check the subject of the customs declaration form and the ownership certificate of the actual goods. If the business unit is the agent, the agency agreement and the copy of the entrusting party's business license shall be prepared in advance.

If it is found that the goods ownership certificate is inconsistent with the customs declaration form during inspection, supplementary materials will be required, and even the goods will be temporarily detained. Therefore, all documents shall be prepared before the goods are loaded to ensure that they are consistent with the information on the customs declaration form.

During machine inspection, the information of the business unit and consignor/consignee on the customs declaration form shall be informed in advance to avoid abnormal goods ownership matching in the machine inspection system. If there is an inspection abnormality, contact the documentation section of the on-site customs immediately, explain the situation of the agency business, and submit complete supporting materials to speed up the inspection and release.

The compliance requirement for export tax refund is that the subject of the customs declaration form is consistent with the tax refund declaration subject, that is, when the agent is the business unit, the agent shall make the tax refund declaration, and provide the special value-added tax invoice of the entrusting party and the agency service fee invoice at the same time.

The 2026 tax refund system will automatically compare the foreign exchange collection information on the customs declaration form with the tax refund declaration information. If the foreign exchange is not received or the subject is inconsistent, the tax refund review will be suspended.

Please note that the tax refund declaration for agent export shall be completed within 90 days after the goods are declared for export, and all documents shall be kept on file, including customs declaration form, entrustment agreement, foreign exchange receipt voucher, invoice, etc. In case of tax investigation, complete supporting materials shall be provided within 15 days, otherwise the tax refund progress will be affected.
