I am the person in charge of a small and medium-sized garment manufacturing enterprise in the Yangtze River Delta region. This year, we just expanded into the EU market and recently received an order for knitted outerwear worth 2 million euros.

We entrusted a local customs brokerage company to handle export customs clearance. Having never dealt with Export Agency Certificate applications before, the application I submitted independently through the Single Window for International Trade last week was directly rejected, with feedback stating that the rights and responsibility division clauses in the entrusted agreement do not meet the latest 2026 regulatory requirements.

With only 12 days left until the sailing date and the quarterly export tax refund declaration deadline approaching, any further delays will not only require us to pay detention penalties to overseas customers but also may cause us to miss the tax refund window and lose hundreds of thousands of yuan in tax refunds. I would like to know the complete compliance process for applying for the Export Agency Certificate now, what core materials need to be supplemented, whether there is a compliant expedited processing channel, and what common declaration pitfalls to avoid?

During the pre-document review stage, three types of core materials need to be prepared in advance: First, the entrusted agency export agreement, which must clearly specify three core elements: ownership of goods, expense responsibility, and tax refund liable party. The validity period of the agreement must cover at least 180 days after export declaration, and a page-seal with the official seals of both parties must be affixed to avoid rejection due to unclear rights and responsibilities. Second, the record receipt of the agent's import and export operation rights. Starting from 2026,paper copies are no longer required, simply upload the electronic record number from the Single Window. Third, the corresponding export contract, commercial invoice, and packing list. The commodity name, quantity, and HS code in all documents must be completely consistent, with no discrepancies in descriptions.

The connection of core nodes must adhere to time limit requirements. After submitting the application,it first undergoes automatic verification through the Single Window, with results generally available within 2 working days. Once verified,it is transferred to manual review. If a supplementary document notice is received during the manual review stage, supplementary materials must be submitted within 3 working days, otherwise, the application will be automatically rejected and need to be re-submitted. If rushing to meet the sailing date, you can upload a sailing schedule certificate with the shipping company's official seal along with the application to apply for the expedited channel. Under normal circumstances, the electronic certificate can be issued within 1 working day after expediting.

Contingency plans for abnormal situations should be prepared in advance. If the application is rejected, first correct the issues one by one according to the rejection reasons: if there is inconsistent document logic, directly revise the corresponding content and re-submit,if there is suspicion of false trade background, prepare materials such as goods ownership certificates, production warehousing slips, and domestic logistics transportation vouchers in advance for inspection to avoid affecting the subsequent declaration progress. After obtaining the electronic version of the Export Agency Certificate, archive the paper version simultaneously. The retention period must not be less than 5 years for subsequent tax correspondence and customs inspection to avoid compliance risks.

In 2026, the Export Agency Certificate declaration system on the Single Window has upgraded its intelligent verification rules, which automatically compare the tripartite data of the entrusted agreement, export customs declaration form, and manifest. If the matching degree of any item's value, name, or HS code is lower than 98%, automatic rejection will be triggered.

If the previous application was rejected, when submitting the second application, you must mark the first rejection number and correction explanation in the remarks column to avoid being judged as a duplicate application by the system and included in the low-credit declaration list, which will extend the review period for all subsequent declarations. If there is a misjudgment in system verification, you can directly submit a written explanation to the comprehensive business department of the local customs, along with relevant supporting materials. Manual review to resolve the abnormality can generally be completed within 1 working day.

The Export Agency Certificate is the core document for handling entrusted export tax refunds. The tax refund liable party indicated on the certificate must be completely consistent with the actual tax refund declaration entity. If marked incorrectly, it will directly lead to the failure of tax refund declaration, and even be judged as a suspected tax fraud, triggering tax correspondence.

After the certificate is processed, the electronic data must be synchronized to the tax declaration system within 30 days. Do not wait until the quarterly declaration deadline to upload it to avoid system data synchronization issues.

In addition, it should be noted that the entrusted agreement must clearly specify the transfer path of tax refund funds. Third-party payment is not allowed, otherwise it will be judged as inconsistent capital flow, failing the four-flow verification, and directly affecting the arrival of tax refund funds.

When applying for the Export Agency Certificate, the payment and collection paths of the entrusting party and the agent must be consistent with the rights and responsibilities agreed in the agreement. If the entrusting party collects foreign exchange, the information of the foreign exchange collection account must be indicated on the certificate. During subsequent settlement, the bank will compare the account information on the certificate; if inconsistent, the settlement quota will be directly frozen.

Starting from 2026, for CIPS cross-border RMB settlement businesses, when applying for the Export Agency Certificate, you can directly upload the contract denominated in RMB without providing additional foreign currency conversion instructions, which can save a lot of review time. If foreign exchange is collected through an offshore account, prepare the control right certificate of the offshore account in advance to avoid being judged as false trade and affecting the compliance of payment and collection.

If you need to expedite the processing of the Export Agency Certificate to meet the sailing date, in addition to uploading the sailing schedule certificate, you can also upload a screenshot of the pre-manifest simultaneously, which will give you higher review priority than only uploading the sailing schedule certificate. It should be noted that the port of shipment indicated on the certificate must be completely consistent with the actual customs declaration port. If the port is changed subsequently, the modification procedure for the Export Agency Certificate must be handled in a timely manner.

Otherwise, the mismatch between the manifest and the certificate information will result in the inability to load the goods normally, and even additional costs such as container detention fees and port change fees will be incurred. When applying for free detention period, the Export Agency Certificate can also be used as supporting material for real trade background, which can improve the approval rate of the free detention period application, with a maximum free detention period of 14 days available.

The rights and responsibility clauses of the entrusted agency export agreement must comply with the requirements of the "Cross-border Agency Trade Management Specifications" issued in 2026. Exemption clauses such as "the agent shall not bear any trade compliance responsibilities" are not allowed, otherwise the agreement will be directly judged invalid, leading to the rejection of the Export Agency Certificate application. For long-term cooperative agents, it is recommended to sign an annual entrusted framework agreement.

The supplementary agreement corresponding to each order only needs to mark the order number, and there is no need to sign a complete agreement every time, which can save a lot of time in preparing materials. In addition, the agreement must clearly specify the time limit for applying for the Export Agency Certificate to avoid declaration delays caused by the agent's delay in submitting materials. The resulting losses can be claimed in accordance with the agreement.

If the export goods are selected for on-site inspection, the Export Agency Certificate can be used as supporting material for goods ownership, which can speed up the inspection and release process. Prepare a printed paper copy of the Export Agency Certificate in advance and submit it to the inspection officer along with other customs declaration documents to avoid the goods being detained for inspection due to inability to prove ownership.

If discrepancies are found between the actual information of the goods and the markings on the certificate during inspection, submit an explanation and apply for the modification procedure of the certificate immediately. Do not conceal information and force customs clearance, otherwise it will be judged as false declaration, resulting in detention of goods and fines, and will also affect the enterprise's credit rating, leading to a significant increase in the inspection rate for all subsequent import and export businesses.
