As a small and medium-sized foreign trade enterprise without import and export qualifications, we are planning to export a batch of 3C products to Germany recently. We heard that "document-purchasing customs declaration" is an accessible method, but we have never dared to try it. We want to figure out what this operation actually involves. Is it true that we can "borrow" another company's qualification to complete customs declaration? What consequences will we face if we are inspected by customs?

For example, will the goods be detained, will we be fined, or will the enterprise credit be adversely affected? In addition, what is the difference between document-purchasing customs declaration and formal agency export? Will it cost less than normal customs declaration? If document-purchasing customs declaration is non-compliant, are there any safer alternative solutions? After all, this batch of goods is critical to our capital turnover in the second half of the year, and we are extremely worried about running into problems.

The essence of document-purchasing customs declaration is the act of enterprises without import and export qualifications declaring customs by borrowing other companies' qualifications. In 2026,the General Administration of Customs of China explicitly classifies it as a typical non-compliant scenario of "inconsistency between the declarant entity stated on the customs declaration form and the actual operating entity",and it is defined as a "gray operation" under strict customs inspection.

A common misconception in the industry is that "document-purchasing declaration saves money and effort",but its actual consequences are far more severe than expected. If the non-compliance is identified during inspection, the goods will be detained, and the enterprise will face a fine of 0.5 to 5 times the value of the goods (up to a maximum of RMB 500,000). The enterprise credit rating will be directly downgraded to Category C,making the enterprise ineligible for government procurement and tax incentives for 3 consecutive years. If the operation involves forged customs declaration documents, the legal representative may be put on record for the crime of "evading customs supervision",which will also affect personal credit reference.

To achieve physical risk isolation, the following requirements must be met: select an agency company with "national customs clearance integration" qualification, and require it to provide the Agency Customs Declaration Letter of Authorization and the qualification certificate of the customs broker registered with customs. The "operating entity" and "consignee entity" items on the customs declaration form shall match the information on the actual contract, and the false declaration pattern of "one declaration form for one separate consignment" must be completely eliminated.

If you have already used document-purchasing customs declaration, take immediate actions to stop losses: ① Contact the original agency to obtain the Special Customs Declaration Form for Export Tax Refund and the Customs Clearance Permit,to ensure that the entity information on logistics documents (bill of lading, packing list) is consistent with that stated on the customs declaration form,② Submit a Statement of Circumstances to the local customs, focusing on emphasizing "operational errors caused by the entrusted agency" instead of intentional violation,③ Keep all bank statements and contracts properly for future verification.

More compliant alternative solutions include: applying for import and export qualification filing (which can be completed within 3 working days),or choosing the "invoice-free tax exemption" policy for cross-border e-commerce comprehensive pilot zones. The newly launched "Single Window + Customs AEO Certification" green channel in 2026 can significantly shorten customs clearance efficiency.

Chief Customs Declaration Expert: The core non-compliance point of document-purchasing customs declaration is "inconsistency between the operating entity on the customs declaration form and the actual export enterprise". In 2026, China Customs implements the "one declaration form, one audit" mechanism.

If the remark column of the customs declaration form does not note "entrusted agency", the system will automatically trigger inspection. It is recommended to verify the Customs Declaration Unit Registration Certificate of the agency company, to make sure that its filing information in the General Administration of Customs of China contains the "agency customs declaration" qualification.。

Senior Logistics Expert: Document-purchasing customs declaration will lead to disconnection between logistics information and customs declaration information. For example, if the freight forwarder submits customs declaration under the name of Company A while the actual goods are transported under the name of Company B, conflict between the consignor information on the bill of lading and the customs declaration entity may occur, which will result in delivery refusal by the destination country customs. It is mandatory to require the agency to provide the Bill of Lading Confirmation Letter that guarantees "consignor information on the customs declaration form is consistent with that on the bill of lading", and reserve 2 working days as the buffer period to cope with unexpected inspections.。

Senior Tax Consultant: Document-purchasing customs declaration will inevitably cause "inconsistency of four flows (goods flow / capital flow / document flow / information flow)", which leads to non-deductible value-added tax. Under the new 2026 policy, if the enterprise chooses the "agency export tax refund" service, the agency company can issue "agency export service invoice" at a tax rate of 6%, which is fully legal and can avoid tax risks.。

Trade Compliance Expert: Document-purchasing customs declaration directly violates the Regulation on Foreign Exchange Administration. Banks will reject foreign exchange settlement during payment collection due to "the foreign exchange receiving entity is inconsistent with the customs declaration entity", which leads to funds being stranded overseas. It is recommended to adopt CIPS Cross-border RMB Payment System to realize closed capital flow through "entrusted foreign exchange collection and payment", and keep the Foreign Exchange Income and Expenditure Statement for future verification.。

Foreign Trade Legal Expert: According to Article 82 of the Customs Law of the People's Republic of China, declaring customs under another entity's name is suspected of the crime of "illegal business operation".

If the agency company knowingly provides services for the name-borrowing declaration, both parties are identified as joint offenders. You must require the agency to sign the Compliance Operation Commitment Letter, clearly stipulating that "all legal liabilities caused by non-compliant operations shall be borne by the agency party".。

On-site Inspection Expert: If the goods have been taken for inspection, contact the Customs Inspection Division immediately, provide original documents such as logistics transport documents and commercial invoices, explain the situation as "operational error of the entrusted agency", to prevent the goods from being directly identified as "smuggled goods". If the inspection officer requests unpacking, be sure to record the whole process with video to reserve evidence and avoid subsequent disputes.。

Export Tax Refund Auditor: The special customs declaration form for export tax refund generated from document-purchasing customs declaration cannot correspond to the actual operating entity, which will be recognized as "abnormal voucher" by the tax authority.

Even if the tax refund has already been obtained, the tax may still be recovered with late payment surcharge. It is recommended to stop all relevant operations immediately and switch to formal agency export services.。
