I am a business specialist at a foreign trade company. Last month, I received an order for importing precision instruments from Germany, with the customer quoting DAP Shanghai Port. However, I’m confused now. From what I learned before, DAP means delivery at destination, but I’m not sure whether the seller or our side is responsible for import customs clearance?
A peer told me that the buyer has to handle customs clearance on their own under DAP, but this customer said they would take care of it. I’m also worried about who will be held responsible if there are problems during customs clearance, such as customs inspection and seizure, and whether additional storage fees and late payment penalties will be incurred?
Additionally, will the new customs clearance regulations at Shanghai Port in 2026 affect the implementation of this clause? The contract I have only states DAP Shanghai without clarifying customs clearance responsibilities, and I’m afraid of disputes later, so I want to figure out who should be responsible for the procedures and costs of import customs clearance.

Under the Incoterms® 2020,which remains in effect in 2026,the standard liability allocation for DAP is clear: the seller is responsible for transporting the goods to the named place of destination and bears all risks and costs associated with transportation to that destination, but import customs clearance procedures and import duties and taxes are defaulted to be borne by the buyer. This is only a general rule of the Incoterms®,the parties to the contract may modify the subject of responsibility through supplementary clauses, and the customs clearance guidelines at Shanghai Port in 2026 also recognize the principle of contract agreement taking precedence.
Pre-review of documents is a core prerequisite for customs clearance. Regardless of which party bears the responsibility,a complete set of documents including commercial invoice, packing list, ocean bill of lading, and certificate of origin must be prepared in advance. Paperless electronic declaration for import customs clearance has been fully implemented at Shanghai Port in 2026,requiring electronic documents to be uploaded in advance for pre-review. If the seller is agreed to handle customs clearance on behalf of the buyer,an additional customs clearance power of attorney with an official seal must be provided to clarify the scope of agency authority.
In terms of core node coordination,if the buyer handles customs clearance on their own, electronic declaration must be completed 3 working days before the goods arrive at the destination port, otherwise declaration late fees will be incurred,if the seller handles it on behalf of the buyer, they need to confirm in advance the buyer’s qualifications such as import and export operation rights and customs filing information, and agree on the fee settlement method to avoid subsequent disputes.
Regarding contingency plans,if goods are detained during customs inspection, the subject of responsibility specified in the contract must first be confirmed: if the buyer handles customs clearance on their own, additional costs arising from inspection shall be borne by the buyer,if the seller handles it on behalf of the buyer,it depends on whether the contract stipulates that the seller shall bear the relevant costs. In 2026,the customs has added an appeal channel within 24 hours after inspection, allowing timely submission of supporting documents to avoid long-term detention of goods.
The key to final compliance implementation is clear contract details. It is recommended to include in the contract content such as the party responsible for customs clearance, the party bearing the costs, the time limit for document submission, and the process for accountability in case of abnormalities. At the same time, all communication records and copies of documents should be retained for subsequent dispute resolution.

In the "Import Customs Clearance Supervision Guidelines" issued by the General Administration of Customs in 2026, the boundary of customs clearance liability under the DAP clause is clearly defined. Under the default rule, the buyer is responsible for handling import customs clearance procedures and paying import duties and taxes.
However, if the parties to the contract agree through supplementary clauses that the seller will act as an agent, the seller must provide a customs clearance power of attorney with an official seal, and the agency behavior must comply with customs supervision requirements throughout the process. Paperless declaration for import customs clearance has been fully implemented at Shanghai Port in 2026, and all documents must be uploaded to the Single Window in advance for pre-review.
If customs clearance is delayed due to the seller’s failure to provide compliant documents in a timely manner, the responsibility shall be borne by the agreed responsible party. In case of price appraisal disputes, the responsible subject shall bear the corresponding review fees and late payment penalties. It is recommended to clearly stipulate the bearer of these fees in the contract in advance, and retain all communication records and copies of documents for subsequent dispute resolution.

Under the DAP clause, the logistics chain is closely bound to customs clearance liability. The seller is responsible for arranging ocean transportation to the named destination, and the title to the goods remains with the seller until the buyer completes customs clearance and takes delivery. In 2026, the tight space situation in the international shipping market will still have local fluctuations. If the seller fails to arrange a suitable shipping schedule in a timely manner, resulting in port detention of goods, the seller shall bear container detention fees and storage fees.
If the seller is agreed to handle customs clearance on behalf of the buyer, the logistics service provider shall connect with the customs clearance agent in advance to ensure timely transmission of documents such as commercial invoices and packing lists, avoiding delays caused by information gaps. In addition, if the port is changed or the destination is altered midway, the buyer must be consulted in advance to confirm whether the customs clearance liability will change accordingly, and the relevant clauses in the contract shall be updated to avoid subsequent issues of unclear responsibility.

The bearing of import taxes and fees under the DAP clause is directly related to customs clearance liability. Import duties, value-added tax (VAT) and other taxes are defaulted to be borne by the buyer. However, if the parties to the contract agree through supplementary clauses that the seller shall bear them, the specific amount of taxes and fees and the payment time limit must be clearly stated in the contract, otherwise the tax authorities will collect taxes according to the default rule.
The VAT deferral policy implemented by China Customs in 2026 applies to the deferred payment of VAT on imported goods. However, if the buyer handles customs clearance on their own, they must complete the deferral qualification filing in the customs Single Window in advance, otherwise they cannot enjoy this policy.
If the seller handles customs clearance on behalf of the buyer, they must ensure that the tax payment method is consistent with the contract agreement, avoiding additional costs caused by exchange rate differences or tax differences. In addition, imported goods related to connected transactions must comply with transfer pricing requirements, otherwise they will face tax audits and late payment penalties.

Foreign exchange payment and receipt compliance under the DAP clause is closely related to customs clearance liability. If the buyer handles customs clearance on their own, they must ensure that the payment amount is consistent with the value of the goods stated in the customs clearance documents, avoiding inconsistent foreign exchange payment and receipt which may lead to inspection by foreign exchange regulatory authorities. In 2026, the State Administration of Foreign Exchange of China has further optimized the cross-border RMB settlement process, and import payments can be completed directly through the CIPS system.
If this method is chosen, the settlement currency must be confirmed with the seller in advance, and the currency stated in the customs clearance documents must be consistent with the payment currency. If the seller handles customs clearance on behalf of the buyer, they must retain the payment vouchers for customs clearance fees and the agency agreement for inspection by foreign exchange regulatory authorities. In case of abnormal foreign exchange payment or receipt, it must be reported to the foreign exchange regulatory authorities in a timely manner to avoid affecting the enterprise’s cross-border settlement credit rating.

Contract risks under the DAP clause mainly come from unclear customs clearance liability. It is recommended to clarify the following core contents in the contract: the party responsible for handling customs clearance procedures, the party bearing import taxes and fees, the time limit for document submission, the allocation of liability in case of abnormalities, and the claim process, etc. In 2026, China Customs issued new regulations on the management of customs clearance guarantees.
If the seller handles customs clearance on behalf of the buyer, the buyer may require the seller to provide a customs clearance guarantee with an official seal to ensure that the seller strictly fulfills customs clearance obligations, avoiding cargo damage or delays caused by the seller’s mistakes. If goods are seized by customs due to customs clearance issues, the scope of compensation of the responsible party must be clarified, including port detention fees, late payment penalties, and cargo losses, etc. It is recommended to consult professional foreign trade legal personnel before signing the contract to ensure that the contract clauses comply with the international trade laws and regulations and customs supervision requirements in 2026.

On-site customs inspection under the DAP clause is directly related to customs clearance liability. If the buyer handles customs clearance on their own, they must arrange personnel with corresponding qualifications to be present to cooperate with the inspection. If the inspection is delayed due to the buyer’s failure to be present in a timely manner or providing incorrect information, the buyer shall bear additional storage fees and declaration late fees.
In 2026, the pass rate of machine inspection at Shanghai Port has increased, but about 30% of goods still require manual unpacking inspection. At this time, it is necessary to ensure that the packaging of the goods meets the physical safety requirements of the customs, avoiding inspection delays or cargo damage caused by packaging damage.
If the seller handles customs clearance on behalf of the buyer, the customs clearance agent must understand the inspection process and requirements in advance to ensure that the personnel cooperating with the inspection are familiar with customs supervision regulations. If it is found that the cargo seal is damaged, it must be reported to the customs in a timely manner and on-site photos must be retained to avoid bearing unnecessary cargo damage liability.

Although the DAP clause simplifies the seller’s cross-border transportation liability, the allocation of customs clearance liability will directly affect the buyer’s supply chain costs and operational efficiency. In 2026, some enterprises will convert the DAP clause to the DDP clause according to their own needs, where the seller bears all import customs clearance procedures and taxes. Although the upfront cost will increase, it can reduce the buyer’s customs clearance risks and daily workload.
However, converting the clause requires advance evaluation of the seller’s customs clearance capability and cost-bearing capacity, and the basis for price adjustment must be clearly stated in the contract. If the buyer insists on using the DAP clause, they can sign a long-term cooperation agreement with a professional customs clearance agent to reduce customs clearance costs and delay risks. It is recommended to combine the advantages and disadvantages of different trade terms in supply chain planning and select the clause that best meets the enterprise’s operational needs.
