I am a small-scale merchant engaged in cross-border jewelry business. I launched an independent website this year to do small-batch exports. Previously, I only shipped individual parcels via courier for direct mail, and now I have received a bulk order of about 100 pieces to be shipped via LCL at Shanghai Port.
I have not yet applied for import-export operation rights, and my business scope on the business license does not include import-export related items. I asked two small freight forwarders before, and both said they cannot accept my order without import-export rights. Now the shipping schedule is fixed, and the cutoff is in five days.
I have received the customer’s advance payment, and if I cannot ship the goods, I will have to pay liquidated damages. I have not slept well for several nights because of this, so I want to ask: do I have to have import-export rights myself to entrust customs brokerage? Can I complete compliant customs declaration and shipment in my current situation? Will there be port detention and high port detention fees?

The most common misconception in the industry is that "entrusting customs brokerage requires the client to have import-export rights". Many small freight forwarders and industry newcomers spread this incorrect information, causing many small and medium merchants without qualifications to miss orders in vain. The root of this misconception is confusing "declarant qualification" with "client qualification". In fact, customs brokerage is declared to the customs by a qualified customs brokerage enterprise as the declarant, and it is not mandatory for the client to provide its own import-export rights.
This misconception will trigger a series of negative chain reactions: first, merchants will blindly suspend the shipment process due to incorrect information, miss the shipping cutoff, have to pay client liquidated damages and lose the cargo space deposit, and also damage the merchant’s overseas reputation, second, some merchants will illegally borrow another entity’s import-export rights to ship goods. Borrowing another entity’s import-export rights is an illegal practice. Once found by customs, the goods will be detained directly, and a compliance blemish will be left, affecting all subsequent import-export business.
To mitigate this risk, the most direct method is to find a fully qualified customs brokerage service provider, who will act as the operator entity to assist in completing compliant declaration. The client only needs to be the consignor or consignee, and does not need to have its own import-export qualifications. In 2026,the customs has explicitly allowed this compliant dual-subject declaration model. As long as the document information is true and valid, normal customs clearance can be completed.
For emergency situations where the cutoff is approaching, the exclusive loss-reduction trick is: provide true cargo details and transaction vouchers to the customs brokerage service provider in advance, conduct document pre-review,and go through the port fast declaration channel. Usually,pre-declaration can be completed in 1 to 2 working days, which will not delay normal cutoff shipment and will not generate additional compliance risks.

According to current customs declaration rules, the declarant qualification for customs brokerage is provided by the customs brokerage enterprise undertaking the business, and the client does not need to have its own import-export rights. For clients without import-export operation rights, compliant declaration can be completed as long as they provide true and valid cargo information, transaction contracts, and payment vouchers. If there is a price verification dispute, as long as true transaction documents can be provided, the customs price verification can be cooperated with, and the probability of additional price verification due to lack of import-export rights will not be increased.
For abnormal situations such as delayed processing and pending records, the cancellation and re-declaration can be completed by supplementing a standardized power of attorney for customs declaration and a dual-subject declaration statement. After sorting out the logical closed loop, normal declaration can be resumed, no long-term bad customs clearance record will be left, and subsequent batch cargo declaration processes will not be affected.

Entrusting customs brokerage for shipment without import-export rights will not increase additional logistics risks. As long as the declarant information is confirmed with the customs brokerage service provider in advance, normal docking with shipping company booking, bill of lading confirmation and other links can be carried out. If the cutoff is approaching, the manifest information can be synchronized with the customs brokerage service provider in advance, and pre-allocated manifest verification can be conducted to avoid manifest inconsistency due to incorrect declarant information, resulting in amendment fees or cargo rejection risks.
For LCL shipment, the declarant information can also be confirmed with the LCL company in advance. As long as the information is consistent, normal port entry and customs declaration can be completed, no additional container detention fees, storage fees and other additional costs will be generated, and the original logistics transportation plan does not need to be adjusted.

When entrusting customs brokerage through the dual-subject model without import-export rights, only a standardized power of attorney for customs declaration needs to be signed with the customs brokerage service provider, clarifying the rights and obligations of both parties to avoid the risk of cargo title disputes. The power of attorney will clarify the ownership of cargo title and the division of customs declaration responsibilities, so there will be no risk of cargo title being encroached on.
It can also provide coverage for the letter of credit clauses and force majeure clauses of the order to protect the legitimate rights and interests of the client. If it involves goods with intellectual property rights, as long as the client provides a legitimate intellectual property authorization document, the customs recordation of intellectual property rights related procedures can be assisted, and compliant protection cannot be handled due to lack of import-export rights.

When entrusting customs brokerage for goods without import-export rights, when encountering on-site customs inspection, only the client needs to provide true cargo samples and product specifications. The on-site personnel of the customs brokerage service provider will connect with the customs inspection.
The client does not need to handle additional qualification procedures. For machine inspection, if there is abnormal image, specification details can be provided in advance to assist the on-site customs officer to complete the verification. When unpacking inspection, the on-site personnel of the customs brokerage service provider can follow up.

Small cross-border merchants without import-export rights for a long time can carry out business through continuous entrustment of compliant customs brokerage, without applying for import-export rights by themselves to save qualification maintenance costs. The shipment rhythm can also be dynamically adjusted according to the order volume to optimize supply chain costs.
For subsequent expansion of order volume, the trade mode can be switched at any time. After applying for import-export rights by themselves, the declarant can be adjusted without changing the original supply chain path. The customs declaration scheme can be dynamically adjusted according to order scale and cost structure to match the optimal supply chain structure and reduce overall operating costs.
