We are a small and micro industrial and trading enterprise that has just started importing industrial spare parts. This is the first time we have arranged for a full container of goods to arrive at the port in the past two weeks.
We have not obtained import-export operation rights before, so we temporarily found a small agent introduced by a friend to handle the procedures. Now the customs suddenly notified us to supplement the complete set of relevant certification materials of the agent. I was completely confused, as I had never heard of this requirement before.
I am afraid that the goods will be seized directly due to missing materials, resulting in demurrage fees of tens of thousands of yuan, and even affecting the long-term stable supply orders negotiated with overseas suppliers. I am completely unclear about which scenarios require importers to provide agent information, which scenarios allow importers to operate on their own without an agent, and whether there will be unforeseen hidden costs to bear after submitting the materials later?

Many importers mistakenly believe that as long as they hold valid import-export operation rights, the entire customs clearance process will not involve the submission of any agent-related documents. This is a very common misconception in the industry. Many people conceal the actual situation of entrusting an agent with a fluke mind and directly submit customs declaration applications on their own, which will trigger a series of negative reactions later.
Once the system determines that the information of the declaring entity does not match that of the actual trade performing entity,it will either enter the secondary price assessment verification queue, resulting in 3-7 days of customs clearance delay and requiring supplementary transaction supporting documents later,or directly transfer the goods to the customs seizure pending inspection status. The accumulated comprehensive costs such as detention, demurrage, and storage may exceed 8% of the value of a single batch of goods. In addition,an abnormal customs declaration record will be left for the enterprise, which will affect the customs clearance priority of all import businesses within the next 6 months.
The core operation of physical risk isolation is to complete two basic self-inspections first: First, confirm whether your import-export operation rights are within the validity period and whether the imported category this time is a special category under national control that requires an agent with designated qualifications. Second, sort out the entire chain of performing entities for this import and confirm that all entrusted agency relationships are supported by corresponding formal agreements.
The exclusive loss prevention tip is that all qualification certificates and entrusted agreement documents related to the agent should be submitted to the pre-audit team 3 working days in advance for information verification. In import scenarios where the importer has no import-export qualifications, all agent materials must be submitted together with the first customs declaration form, and should not be supplemented later,so as to avoid triggering abnormal system warnings from the source.

All declaring entity information in the import customs declaration link must completely match the entity information filed with the customs. If the importer itself does not have the filing qualification of import-export consignor/consignee, the filing information of the agent must be filled in the business unit column of all customs declaration forms, and the three core documents including the agent's business license, customs registration certificate, and entrusted agency agreement must be submitted together with the customs declaration documents.
If the importer holds valid filing qualifications, it only needs to actively submit the agency agreement when entrusting the agent to handle auxiliary businesses such as foreign exchange payment, logistics, and inspection coordination, without the need to upload the complete set of agent qualifications, which will not affect the normal customs clearance and price assessment process. In scenarios involving price assessment disputes, the agent, as the business unit, shall cooperate in submitting price supporting materials to reduce the communication costs of the enterprise itself.

If customs clearance delay occurs after a full container of goods arrives at the port, high detention fees will start to be incurred after more than 7 days. The daily detention fee for ordinary containers can reach more than 300 RMB, and the daily detention fee for dangerous goods and cold chain special containers exceeds 1,000 RMB.
If it has been confirmed that agent materials need to be submitted, you can apply to the shipping company for an additional 7-10 days of free storage and detention period at the same time, and lock in the free storage duration in advance during the gap of document submission to avoid unnecessary additional costs later. For near-sea direct routes, all agent-related materials can be prepared in advance and pre-entered 3 days before the goods arrive at the port, and customs clearance and release can be completed directly after the goods arrive, without any delay throughout the process.

The VAT deferral declaring entity in the import link must be consistent with the business unit on the customs declaration form. If the importer has import-export qualifications and declares imports in its own name, there is no need to bind the agent's tax qualification information, and the importer can complete the VAT deferral declaration and deduction process on its own later.
If the agent is declared as the business unit, the agent shall complete the tax-related declaration in the import link as the nominal taxpayer, and then transfer the relevant bills to the importer in the form of agency service fee invoices to complete the full closed loop of VAT deduction. Note that the pricing of the import cargo value and agency service fee amount must comply with the arm's length principle to avoid triggering anti-tax avoidance inspections.

The foreign exchange payment entity in the cross-border payment and settlement link must completely match the business unit on the import customs declaration form. If the importer has not activated the cross-border foreign exchange payment authority and entrusts the agent to make the payment, the corresponding vouchers of the complete set of entrusted agency agreements, import contracts, and logistics documents must be retained to ensure that the foreign exchange payment capital flow completely matches the cargo flow information.
When using the CIPS system to complete cross-border RMB payments, the corresponding remark information of "Payment for XX goods imported by agency" must be clearly marked in the transaction remarks column to avoid triggering transaction background inspection warnings by the SWIFT or CIPS system, which will affect the payment arrival efficiency.

If manual container inspection is selected during on-site customs inspection, the contact person of the agent as the business unit must be present throughout the process to cooperate with customs staff to complete the cargo information verification, and prepare the identity certification documents of the agent's authorized contact person in advance to avoid interruption of the inspection process due to inconsistent qualifications of the contact entity.
For categories involving inspection and testing, the agent shall submit the corresponding inspection application as the inspection entity, and then synchronize the test report to the importer after receiving it. All signed and traceable documents throughout the process must be stamped with the official seal of the business unit, in compliance with the on-site inspection process specifications.

When signing an entrusted import agreement with an agent, the rights and responsibilities of both parties must be clearly defined, and it must be clearly stated that the agent only acts as a nominal business unit to cooperate in completing customs clearance and foreign exchange payment procedures, and does not own the title to the imported goods of the corresponding batch, so as to avoid subsequent disputes over title ownership. For imports of special categories involving intellectual property filing, it must be clearly stated in the agreement that the agent only acts as a trustee to cooperate in submitting intellectual property-related certification documents, and shall not use the relevant intellectual property information for other non-designated import batches without authorization, so as to avoid subsequent joint risks of intellectual property infringement.
