I am an integrated industrial and trade enterprise exporting mid-to-high-end home furnishings. This year, I just expanded into new markets in the EU and Southeast Asia. Previously, I always used an agency company for the full export chain, and foreign exchange collection also went through the agency's account.

Recently, several long-term clients have asked to remit payments directly to our own Hong Kong offshore account, claiming it saves on intermediate transfer fees and arrives faster. I am now worried that collecting funds myself might not meet regulatory requirements and affect subsequent export tax refunds.

I heard from a peer that someone who collected funds themselves was subject to a tax inquiry, and the tax refund was delayed for nearly a year. I want to know if I can collect funds myself under the agency export model, what conditions must be met to avoid compliance pitfalls, and whether it will affect subsequent tax refunds.

Under the agency export model,self-collection of foreign exchange is permitted, but it must meet the prerequisite of full-chain document matching, otherwise, regulatory alerts will be triggered. First, the pre-document review must be completed. The entrusting party and the agency need to sign a formal agency export agreement in advance that includes the clause "Entrusting Party Self-Collects Foreign Exchange," clarifying ownership of goods, collection path, and division of tax refund responsibilities. Simultaneously, the collection path must be filed with the local SAFE in advance by submitting materials such as the overseas buyer's qualifications, order contract, and agency agreement. Operation can only proceed after the filing is approved.

The connection of core nodes must achieve a match of the three flows. In the customs declaration stage, the "Operating Unit" should be the agent, and the "Consigning/Shipping Unit" should be the entrusting party. The remarks column of the customs declaration form must mark "Entrusting Party Self-Collects Foreign Exchange." When the overseas buyer makes the payment, they must note the unified number of the corresponding export customs declaration in the SWIFT message remarks. After collection, the entrusting party must synchronize the collection voucher and message screenshot to the agent within 3 working days for retention as supporting documents for subsequent tax refunds.

Contingency plans for anomalies must be agreed upon in advance. If the remitter differs from the overseas buyer,a tripartite third-party payment agreement must be supplemented in advance. If the collection amount deviates from the customs declaration amount by more than 5%,a discrepancy explanation must be submitted to the SAFE within 7 working days to avoid triggering foreign exchange payment alerts.

For final compliant implementation, document retention must be handled well. All agency agreements, customs declarations, collection vouchers, and order contracts must be retained for at least 5 years. When cooperating with tax department inquiries, the full set of materials can be submitted directly. As long as the requirements for document consistency and the four-flow match are met,self-collection will not affect the declaration progress and arrival timeliness of export tax refunds.

For the customs declaration stage of agency export self-collection, two core requirements must be noted. First, the operating unit and the shipping unit must be filled in with the full names and customs registration codes of the agent and the entrusting party respectively; mixing or omitting information is not allowed.

Second, the remarks column of the customs declaration form must clearly state "Entrusting Party Self-Collects Foreign Exchange." Declarations without this remark will be judged by the system as the operating unit's obligation to collect, leading to subsequent collection gap alerts under the agent's name and triggering customs valuation checks.

If the remark is omitted during declaration, a modification application must be submitted within 7 working days after the customs declaration is closed, attaching materials such as the agency export agreement and the collection path filing proof. Modification applications exceeding the time limit will be rejected, and only deletion and re-declaration can be processed, which will affect the timeliness of subsequent tax refund declarations.

Under the agency export self-collection model, control of title to goods must match the pace of collection. It is recommended to fill "To Order" in the Bill of Lading consignee field. After the agent performs a blank endorsement, it is transferred to the entrusting party.

The entrusting party should send the original Bill of Lading to the overseas buyer only after collecting the full payment, avoiding situations where the buyer defaults after the title has been transferred. If choosing telex release, the agent and the entrusting party must jointly issue the telex release application, and it must be confirmed that the entrusting party has collected the corresponding payment before operating the telex release to avoid the risk of releasing goods without documents.

If anomalies such as container rolling or port changes occur, the collection progress must be synchronized immediately. If there is a delay in collection, adjustments to the shipping schedule or transshipment port can be applied for to reduce additional expenses for demurrage and detention charges.

Tax planning for agency export self-collection must pay attention to related-party transaction pricing issues. If an affiliated relationship exists between the entrusting party and the overseas buyer, the collection amount needs to comply with the arm's length principle to avoid being recognized by the tax authorities as transfer pricing to evade taxes, resulting in back payment of VAT, Enterprise Income Tax, and late fees.

Simultaneously, attention must be paid to the withholding tax policies of different countries. Some Southeast Asian countries impose a 10%-15% withholding tax on payments to overseas parties.

It is advisable to agree on the tax bearer in the order contract in advance to avoid a large deviation between the actual collection amount and the declaration amount, which affects subsequent tax refund calculations. Eligible enterprises can apply for deferred VAT declaration to reduce capital occupation costs.

The foreign exchange payment and collection operations for agency export self-collection must comply with foreign exchange management requirements. The collection account must be a foreign exchange settlement account or offshore account in the name of the entrusting party that has been filed. Third-party personal accounts must not be used for collection; otherwise, anti-money laundering alerts will be triggered, leading to account freezes. After collection, declaration must be completed within the prescribed time limit.

The transaction code should be selected as "General Trade Export Collection," and the remarks should note the corresponding customs declaration number. If cross-border RMB settlement occurs, the payment and collection must be completed through the CIPS channel, and a RMB settlement explanation must be submitted to the SAFE simultaneously to avoid anomalies in the occupation of settlement quotas. Annually, one must cooperate with the SAFE to complete foreign exchange checks and submit the full set of documents to prove the authenticity of the transaction.

The contract terms for agency export self-collection must clarify the rights and responsibilities of the three parties. The agency export agreement must clearly stipulate the division of responsibilities for self-collection. If regulatory penalties or tax refund losses are caused by the entrusting party's collection anomalies, the entrusting party shall bear them; if collection alerts are caused by the agent's customs declaration errors, the agent shall bear the responsibility.

The overseas order contract must clearly stipulate the payment path, remarks requirements, and the bearer of exchange rate fluctuations. An force majeure clause should also be added; if special circumstances such as overseas sanctions or foreign exchange controls cause collection delays, the default liability of both parties can be exempted. In case of payment arrears, a claim for compensation can be filed with China Sinosure based on the full set of documents to reduce losses.

The tax refund declaration for agency export self-collection must meet the requirement of consistency among the four flows: the flow of goods, flow of funds, flow of invoices, and flow of documents must match completely. The agent needs to issue a "Proof of Agency Export Goods" to the entrusting party.

The entrusting party handles the tax refund declaration based on this proof, the customs declaration, collection voucher, and VAT special invoice. If collection delay exceeds the tax refund declaration time limit, an application for extension must be submitted to the tax authorities in advance to avoid being treated as domestic sales requiring back payment of tax.

For the annual tax refund inquiry, the full set of collection vouchers, message screenshots, and agency agreements must be submitted to prove the authenticity of collection. As long as materials are complete, the processing time for the inquiry will be consistent with that of agency collection and will not be delayed.

The supply chain architecture for agency export self-collection can be optimized in a targeted manner. The collection pace can be matched with inventory turnover and raw material procurement pace.

The collected foreign exchange can be used directly to pay for overseas raw material procurement, reducing exchange rate spread losses from settlement and purchase and lowering exchange costs. Trade terms can be adjusted according to the collection pace. For long-term clients with low collection risk, CIF terms can be chosen to arrange logistics oneself and control title to goods.

For new clients with high collection risk, FOB terms can be chosen so the buyer arranges logistics, reducing the pressure of advancing logistics costs. Simultaneously, a collection alert mechanism can be established to link collection progress with order production and shipping rhythm, avoiding losses from collection failure after shipment.

For the cargo inspection stage of agency export self-collection, attention must be paid to document consistency. During on-site customs inspection, the "Entrusting Party Self-Collects Foreign Exchange" mark in the customs declaration remarks will be checked, and the shipping marks, specifications, and quantity of the goods will be verified against the order contract and customs declaration.

If there is a discrepancy between goods and documents, proof of transaction authenticity will be required, including collection vouchers and agency agreements, affecting the timeliness of inspection clearance. Before machine inspection, the full set of documents can be organized in advance for reference.

If unpacking inspection is required, one must cooperate with customs officers to open the container to avoid cargo damage. If goods are sent for identification and appraisal, the appraisal report must be synchronized to the agent and the entrusting party in time for subsequent collection and tax refund processes.
