I am a handler at a foreign trade company, and I have just taken over the agency export business recently. Last month, we helped a client export a batch of electromechanical products.

The client has transferred the payment for goods to our corporate account, and also paid a sum of agency service fee. Now I am a bit confused, wondering if tax is required for this agency export payment. Also, if the payment is received via an offshore account, will there be different requirements?

I heard from a colleague earlier that the agency export service fee is subject to tax, but is the principal of the foreign exchange received for goods payment exempt? In addition, we have another payment for goods paid by a third party, will that involve tax risks? I am really worried that accidental violations will affect the company's credit.

Tax issues related to agency export payment collection shall be judged based on the subject and the nature of the payment. Under the 2026 cross-border trade tax policies, the core logic is clear and followable. The agency service fee collected by the agent falls into the category of modern services, which is subject to 6% value-added tax and shall be included in the taxable income of corporate income tax. For the foreign exchange received by the entrusting party for exported goods (i.e。the principal of goods payment),if it meets the export tax refund conditions,it can enjoy tax exemption or refund policies, and no additional value-added tax is required.

Two types of special scenarios require special attention: First, foreign exchange collection on behalf of clients. If the agent collects foreign exchange on behalf of the entrusting party,it shall timely transfer the fund to the entrusting party's account after foreign exchange settlement, and retain a full set of documents such as the agency agreement and foreign exchange receipt vouchers to avoid being recognized as self-operated income. Second,third-party payment. A entrusted payment agreement between the entrusting party and the third party shall be provided to ensure the consistency of four streams: contract, invoice, goods ownership and foreign exchange receipt, otherwise it may trigger tax inquiry by letter.

Data linkage between customs and tax authorities has been realized in 2026. Any discrepancy between foreign exchange receipt and customs declaration will trigger a system warning. It is recommended to confirm that the foreign exchange receiving entity is consistent with the operating unit on the customs declaration before receiving payment, and meanwhile complete document filing, keeping the documents for at least 3 years for future inspection. If payment is received via an offshore account,it is necessary to ensure the compliance of the source of funds to avoid being identified as abnormal foreign exchange transactions.

If the entrusting party collects foreign exchange by itself,it can directly declare foreign exchange verification and cancellation through the export tax refund system without going through the agent. However,if the entrusting party is a small-scale taxpayer,it cannot enjoy the tax refund policy and shall pay value-added tax according to domestic sales. On the whole,as long as the compliance procedures are strictly followed, the tax burden of agency export payment collection can be clearly divided, and no additional compliance risks will arise.

The compliance of agency export foreign exchange receipt is directly bound with the customs declaration information. In 2026, all ports nationwide have realized real-time connection between customs declarations and the foreign exchange monitoring system. If you, as the agent, collect foreign exchange on behalf of the entrusting party, you shall mark the name of the entrusting party in the "foreign exchange receiving entity" column of the customs declaration, complete the foreign exchange settlement and transfer within 3 working days after receiving the foreign exchange, and retain a full set of documents such as the agency agreement, foreign exchange receipt slip, and goods ownership certificate.

If the foreign exchange receiving entity is inconsistent with the information on the customs declaration, it will trigger the customs price review process, and even lead to declaration cancellation and re-submission. It is recommended to confirm the foreign exchange receiving path with the entrusting party in advance to ensure that each foreign exchange receipt is associated with the corresponding customs declaration.

Details of the international logistics link will indirectly affect the tax compliance of foreign exchange receipts. For example, the consignee on the bill of lading shall be consistent with the foreign exchange receiving entity.

If the entrusting party requires the bill of lading to be endorsed to a third party, a written agreement shall be signed in advance to avoid the disconnection between goods ownership and the foreign exchange receiving entity. In addition, the entity collecting fees such as container detention charges and free storage period shall be consistent with that specified in the agency agreement.

If these fees are advanced by the agent, they shall be listed separately in the subsequent foreign exchange receipt, otherwise they will be recognized as extra-charge expenses by the tax authority and subject to additional value-added tax. It is recommended to clarify the division of expenses in the logistics contract to avoid subsequent tax disputes.

Tax handling for agency exports shall distinguish between agency service fees and the principal of goods payment. The service fee collected by the agent is subject to 6% value-added tax as a modern service. For cross-border agency services, value-added tax exemption is available under the 2026 policies, provided that the condition of "services are fully consumed outside the territory" is met, and the service acceptance certificate from the overseas client shall be retained.

For the principal of goods payment of the entrusting party, if it is a self-operated export, tax refund can be applied for according to regulations; if it is an agency export, the entrusting party shall declare the tax refund by itself, and the agent only needs to pay tax on the service fee. Attention shall be paid to related transaction pricing to avoid being adjusted by the tax authority due to excessively low service fee pricing.

Compliance of cross-border foreign exchange receipt and payment is the core link of agency exports. In 2026, the CIPS system has supported real-time settlement of major global currencies. If an offshore account is used to receive foreign exchange, it is necessary to ensure that the funds in the account come from real trade backgrounds, and retain documents such as trade contracts and customs declarations.

If a third party pays the goods payment on behalf of the entrusting party, a payment authorization certificate issued by the entrusting party shall be provided to ensure that the received foreign exchange funds are consistent with the trade contract. In addition, qualified banking channels shall be selected for foreign exchange settlement, and unqualified third-party institutions shall be avoided, otherwise you will be listed as an abnormal entity by the foreign exchange administration authority, affecting subsequent foreign exchange receipt and payment operations.

Legal risks of agency exports shall be avoided in advance through contract clauses. The agency agreement shall specify contents such as foreign exchange receipt responsibility, tax bearing subject, and document retention obligation. If losses are caused by delayed foreign exchange receipt or tax issues, the liability for breach of contract shall be clearly defined.

If letter of credit settlement is involved, the contents of the letter of credit terms regarding the foreign exchange receiving entity and document requirements shall be reviewed to avoid foreign exchange receipt risks caused by soft clauses. In addition, if the entrusting party requires the goods payment to be transferred to an offshore account, the compliant use requirements of the account shall be specified in the agreement to avoid risks involving money laundering or tax violations.

Foreign exchange verification and cancellation for export tax refund is a key link of tax compliance. In 2026, the tax authority has realized automatic comparison between the export tax refund system and the foreign exchange monitoring system.

If the amount of foreign exchange received is inconsistent with the amount on the customs declaration, it will trigger tax inquiry by letter. The tax refund for agency exports shall be applied for by the entrusting party, and documents such as the agency agreement, foreign exchange receipt voucher and customs declaration shall be provided to ensure the consistency of the four streams.

If the entrusting party is a small-scale taxpayer, it cannot enjoy the tax refund policy and shall pay value-added tax according to domestic sales. It is recommended to sort out the corresponding relationship between foreign exchange receipts and tax refunds every month to avoid tax refund delays caused by cross-month declaration, and at the same time retain the filed documents for at least 3 years for tax inspection.
