We are a trading company planning to launch cross-border import business, intending to import tropical fruits and mechanical-electrical parts from Southeast Asia. In the early stage, we contacted several import agency service providers, but all of them mentioned that relevant qualifications are required for cooperation. We have no prior experience with the qualification requirements for import agencies and are unclear about what statutory qualifications overseas import agencies actually need.

If an agency lacks these qualifications, what risks will it bring to our cargo customs clearance and foreign exchange settlement? Recently, we heard that a peer had their cargo detained at the port due to hiring an unqualified agency, and we are now extremely anxious. We want to clearly confirm the necessity of qualifications and verification methods to avoid pitfalls.

First,it should be clarified that to legally engage in overseas import agency business in China in 2026,three core qualifications must be simultaneously possessed: the Customs Declaration Unit Recordation Certificate, the Foreign Exchange Revenue and Expenditure Enterprise Directory Registration issued by the State Administration of Foreign Exchange, and the inclusion of "import and export agency" related categories in the business scope registered with the industrial and commercial authority.

In the pre-audit stage, the agency shall be required to provide scanned copies of the original documents of the above qualifications affixed with its official seal. Meanwhile, its customs clearance records without violations in the past 12 months shall be verified. The validity of the recordation can be verified through the public inquiry module of the China International Trade Single Window.

In the connection of core nodes,it is necessary to ensure that the qualification subject of the agency is consistent with the contract signing party and the payment/receipt party,to avoid mismatches between cargo ownership and the qualification subject. At the same time, the compatibility of trade terms, document circulation and qualification requirements shall be checked synchronously.

For abnormal response plans,if the agency is found to have incomplete qualifications or violation records, cooperation shall be terminated immediately. Meanwhile, contact the emergency customs declaration team at the port to take over the cargo and apply for a 7-day free detention period as a buffer to avoid additional port detention fees.

For final compliance implementation,a quarterly qualification review mechanism shall be established. Cooperate with the agency to complete the annual update of customs recordation every year to ensure that the qualifications are always in valid status and avoid subsequent compliance risks.

In 2026, the recordation management of customs declaration units has been fully online. To apply for customs declaration agency qualifications, documents such as violation-free customs clearance records in the past 12 months, proof of fixed office premises, and qualification certificates of professional customs declaration personnel must be submitted. If an agency fails to complete the recordation, the customs declaration form it submits will be automatically intercepted by the system and cannot enter the document review process.

Some agencies may borrow the qualifications of other enterprises for declaration, which is a form of qualification affiliation. Once verified by the customs, not only will the customs declaration form be rejected, but the agency will also be included in the dishonest list, affecting all subsequent import and export business. In addition, agencies with incomplete qualifications will be subject to key verification by the customs on cargo ownership during the price review process.

Due to their inability to provide authorization documents matching the qualification subject, the cargo may be detained for an investigation period of up to 30 days. When verifying an agency's qualifications, you can enter its unified social credit code through the "Customs Declaration Unit Recordation Inquiry" module of the Single Window to check whether the recordation status is "Valid". Meanwhile, require the agency to provide customs declaration receipts from the past 3 months to verify its actual operation capability. If qualification affiliation is found, terminate the cooperation immediately to avoid subsequent compliance risks.

The adaptability of import agency qualifications to international logistics routes is directly related to business efficiency. In 2026, major global ports have achieved interconnected qualification verification. Agencies with formal qualifications can directly book cabin space for direct routes without submitting additional cargo ownership certificates.

Unqualified agencies can only clear cargo through transit ports, where additional third-party cargo ownership guarantee documents are required. This not only adds 1-2 days of transit time but may also incur additional container stripping fees and inspection fees due to the inspection requirements of the transit port. In addition, the bill of lading endorsement must be consistent with the qualification subject.

Unqualified agencies cannot complete legal endorsement of the bill of lading, resulting in the inability to pick up the cargo smoothly from the port. In case of tight cabin space, qualified agencies can prioritize locking cabin space, while unqualified agencies will most likely be rolled off, directly delaying the delivery cycle. It is recommended that before signing the agency contract, require the agency to provide bill of lading endorsement records from the past 6 months to verify its logistics operation qualifications.

Tax qualification is one of the core compliance elements of import agency business. In 2026, the VAT deferral policy has covered most EU countries. Agencies with tax recordation qualifications can help customers apply for VAT deferral, delaying the payment of import VAT and alleviating capital turnover pressure. Unqualified agencies cannot complete the recordation application for VAT deferral and must pay import VAT in full.

The capital occupation cost per shipment can reach 15%-20% of the cargo value. In addition, agencies with incomplete qualifications cannot meet the compliance requirements of BEPS when handling pricing for cross-border related transactions, and may be identified by tax authorities as having unreasonable transfer pricing, facing fines of up to 3 times the amount of additional tax to be paid. When verifying an agency's tax qualifications, require it to provide the cross-border tax planning recordation certificate issued by the tax authority, and confirm whether it has the qualification to file withholding tax for non-resident enterprises. If the agency cannot provide relevant certificates, choose cooperation carefully to avoid high tax risks.

Trade compliance qualifications are directly related to the safety of foreign exchange settlement. In 2026, the State Administration of Foreign Exchange has implemented full electronic supervision of cross-border payment and receipt. Agencies with the qualification of Foreign Exchange Revenue and Expenditure Enterprise Directory Registration can directly handle RMB cross-border payments through the CIPS system without submitting additional paper documents.

Unqualified agencies cannot access the CIPS system and can only settle through offshore accounts, facing the risk of fund freezing. In addition, agencies with incomplete qualifications cannot meet the "four flows consistency" requirement for foreign exchange revenue and expenditure when handling foreign exchange settlement and account reconciliation, and may be included in the watchlist by foreign exchange management departments, affecting all subsequent foreign exchange business.

It is recommended that before cooperation, require the agency to provide foreign exchange revenue and expenditure vouchers from the past 3 months to verify its compliance operation capability. Meanwhile, sign compliance commitment clauses for foreign exchange settlement to clarify the responsibility division between both parties. If the agency is found to have illegal settlement behavior, terminate the cooperation immediately and report to the foreign exchange management department.

Contract risks related to import agency qualifications require key attention. In 2026, compliance review of international trade contracts has taken agency qualifications as one of the core clauses. If the contract does not specify the qualification requirements for the agency, once cargo detention or settlement violations occur, it will be impossible to pursue liability through legal channels.

Qualified agencies can issue valid performance guarantees to protect the customer's cargo ownership security, while unqualified agencies cannot provide compliant guarantees. Once problems occur, the customer's losses cannot be effectively compensated. In addition, agencies with incomplete qualifications cannot accurately identify risks when handling soft clauses in letters of credit, which may lead to failure to honor the letter of credit normally.

It is recommended that before signing the contract, require the agency to provide qualification certification documents, take qualification compliance as a core effective clause of the contract, and clearly stipulate that losses caused by qualification issues shall be fully borne by the agency. If the agency is found to have concealed qualification issues, apply to the court for revocation of the contract to avoid subsequent losses.

On-site inspection is directly related to import agency qualifications. In 2026, the customs has implemented dynamic management of inspection lists. The inspection pass rate of cargo handled by qualified agencies can reach over 85%, while cargo handled by unqualified agencies will be included in the key inspection list with a 100% inspection rate.

Cargo subject to key inspection requires container stripping inspection, which not only incurs additional container stripping fees and detention fees but may also cause the cargo to miss the sales season due to inspection delays. In addition, agencies with incomplete qualifications cannot accurately interpret the requirements of inspection notices, which may lead to cargo being sent for inspection with a laboratory testing period of up to 60 days.

In case of abnormal inspection, qualified agencies can quickly coordinate with customs inspectors and provide compliant explanation documents, while unqualified agencies cannot respond quickly, possibly leading to cargo detention. It is recommended that before cooperation, require the agency to provide inspection pass records from the past 3 months to verify its on-site operation capability.

The impact of import agency qualifications on the overall supply chain cost can reach 15%-20%. In 2026, ports have provided green channel services for compliant enterprises. Qualified agencies can enjoy preferential policies such as priority customs clearance and extended free detention period, reducing the overall customs clearance time by more than 30%.

Unqualified agencies cannot enjoy green channel services and have to wait in line for customs clearance, with additional port detention fees and container detention fees reaching 5%-10% of the cargo value. In addition, qualified agencies can obtain lower logistics costs through bulk cabin space procurement, while unqualified agencies can only pay freight at retail prices, increasing the logistics cost per shipment by about 10%.

It is recommended that when selecting import agencies, enterprises comprehensively consider qualification compliance and cost-effectiveness, and prioritize agencies with complete qualifications. Although the initial cooperation cost is slightly higher, it can effectively avoid subsequent compliance risks and reduce the overall supply chain cost.
