I am the person in charge of a small and medium-sized enterprise engaged in imported beauty and daily chemical products. In the past two years, we tried to handle customs clearance on our own.

Sometimes the documents were not prepared correctly and the goods were detained at the port, resulting in tens of thousands of yuan in accumulated port demurrage. Last time, we paid more than 100,000 yuan in supplementary taxes due to wrong HS classification, and last week we received a customs warning again for compliance issues.

I heard from friends that hiring a professional import customs clearance agency can solve these problems, but some others say many small agencies charge arbitrary hidden fees, and cannot be reached once problems occur. I am not sure now, and I want to know whether import customs clearance agencies are truly reliable, whether they can help us solve these problems, and how to choose one without falling into traps.

The first common misunderstanding in the industry is that enterprises only focus on quoted prices while ignoring qualifications. Many small agencies attract customers with low prices, but they do not have a fixed on-site operation team at the port, nor a compliance risk control system. Another misunderstanding is that customs clearance is only trivial errand work that anyone can do,ignoring the compliance attribute of the customs clearance link. Many enterprises only require the goods to be released, and do not care whether the whole process is compliant.

These misunderstandings will trigger a chain of negative consequences. Low-price agencies usually add various hidden fees in the later stage, and the total cost ends up higher than that of formal agencies. Agencies without professional capabilities are prone to document errors and HS classification errors, which directly lead to cargo detention and port demurrage. This will not only generate high port demurrage and container detention fees, but also delay the sales schedule. For fast-moving consumer imported goods,it may even lead to goods expiration and scrapping, leaving a compliance stain that affects subsequent import businesses.

The risk isolation measures are very clear, prioritize institutions with more than 10 years of frontline practical operation experience, confirm that they have their own fixed on-site operation team at the port, instead of subcontracting the whole process to third parties. Meanwhile, require the agency to provide at least three customs clearance cases of imported goods in the same category,to verify its actual capability in handling similar issues.

The exclusive loss control tip is to sign a clear service agreement before cooperation, clearly specify the clause of right and responsibility division for operation errors. All extra expenses caused by the agency's operation errors shall be borne by the agency, and a service balance of about 10% shall be reserved and paid off only after the customs clearance is completed and the goods are released smoothly,so as to avoid risks from the cooperation process.

For price verification disputes of imported goods, most small and medium-sized import enterprises, when declaring on their own, are prone to receive price queries due to inability to provide price proof materials that meet customs requirements, which prolongs customs clearance time. Formal customs clearance agencies will sort out full sets of materials including contracts, invoices, foreign exchange payment vouchers, and manufacturer ex-factory price certificates in advance before declaration, and make response plans for price queries in advance.

In case of price verification disputes, they can submit objection applications through compliant channels, assist enterprises to communicate with customs, and avoid unnecessary tax increases. For the secondary declaration issue under the integrated customs clearance mode, they can sort out a complete logical loop in advance to avoid abnormal situations such as order pushback and suspense account. If there is a need to cancel the declaration and re-declare, they can also quickly organize materials to complete the operation, reducing customs clearance delay.

Container detention fee and port demurrage in the import link are major extra expenditures for many enterprises. Formal customs clearance agencies will communicate with shipping companies in advance to apply for extended free storage period and free detention period. In case of transshipment or space booking overbooking that requires port of call adjustment, they can quickly connect with shipping companies to adjust shipping space, reducing extra incurred expenses.

For different transport demands of goods, they can provide optimal schemes for direct shipping or transshipment, which not only meets the arrival time requirement, but also reduces logistics costs. For imported goods involving ownership transfer, they can also assist in handling the process of bill of lading endorsement and transfer, avoid ownership disputes, and ensure the smooth delivery of goods to the consignee.

For imported goods from regions such as the European Union and the United Kingdom, formal customs clearance agencies can assist in handling VAT deferral, so that enterprises do not need to pay VAT in advance at the import link, easing the pressure of capital occupation and reducing capital turnover cost.

For imported goods under cross-border related transactions, they can assist in making compliant pricing that meets BEPS related requirements to avoid tax adjustment risks. For issues related to withholding income tax for non-resident enterprises, they can also make compliant planning to isolate tax risks, reduce the overall tax cost of enterprises within the compliance scope, and prevent customs clearance delay caused by tax issues.

Compliance of foreign exchange receipt and payment in the import link is a point easily ignored by many enterprises. In recent years, foreign exchange supervision has been continuously tightened, and non-compliant foreign exchange receipt and payment will lead to account supervision, affecting subsequent business development. Formal customs clearance agencies will assist enterprises to complete compliant operation of foreign exchange receipt and payment, connect with the CIPS cross-border RMB payment system, optimize foreign exchange purchase exchange rate, and reduce exchange difference loss.

For abnormal issues of SWIFT messages, they can also analyze and adjust in time. For foreign exchange receipt and payment of offshore accounts, they can sort out compliance issues to avoid abnormal foreign exchange settlement and account reconciliation, ensuring the smooth and compliant foreign exchange receipt and payment process.

The customs clearance link in import trade involves many legal risks, such as intellectual property infringement. If imported goods involve intellectual property infringement, they will be detained and confiscated by customs, and enterprises may even face fines.

Formal customs clearance agencies will remind enterprises to check the IPR Customs Protection Recordation in advance, to confirm that the goods do not involve infringement issues. For import businesses settled by letter of credit, they can assist in checking soft clauses in the letter of credit, make proper clause safeguards for contents related to ownership transfer and letter of guarantee, avoid legal disputes, and protect the legitimate rights and interests of enterprises.

When goods arrive at the port and face on-site customs inspection, many enterprises do not know how to respond, and improper response easily leads to abnormal inspection results and prolongs customs clearance time. Formal customs clearance agencies have fixed on-site operators, who can interpret the inspection notice in advance, prepare full sets of documents in advance, and identify the authenticity of seals in advance.

If container unpacking inspection is required, they can also coordinate the sequence and position of unpacking to reduce unnecessary unpacking costs. If sampling and inspection is required, they can follow up the whole process to obtain the test report in time. If the report is abnormal, they can also assist enterprises to apply for re-screening to reduce the probability of misjudgment.

For import of dangerous goods and sensitive goods, packaging compliance is the core prerequisite for customs clearance. Many enterprises face cargo detention because their packaging does not meet relevant requirements.

Formal customs clearance agencies will check the MSDS information of goods in advance, assist in completing the compliance inspection of UN certified dangerous goods packaging and classification appraisal, and provide corresponding solutions for moisture-proof reinforcement and buffer packaging material selection according to the characteristics of different goods, to ensure the physical safety of goods during transportation, meet customs compliance requirements, and avoid customs clearance failure caused by unqualified packaging.

For many enterprises engaged in import of materials for further processing and subsequent re-export, the customs clearance documents of imported materials directly affect the compliance of subsequent export tax rebate. If the import documents are not kept properly, the tax verification will not pass, affecting the arrival of tax rebate funds.

Formal customs clearance agencies will sort out full sets of documents of the import link in accordance with the requirements of export tax rebate verification, complete document recordation, ensure four-party consistency, and meet the verification requirements of tax authorities. In case of cross-month declaration and pre-declaration verification abnormality, they can also assist in adjusting and sorting materials, ensuring the smooth tax rebate process and avoiding unnecessary tax rebate losses.

Import customs clearance is the core link of the whole import supply chain, connecting international transportation and domestic distribution. Formal customs clearance agencies can adjust the customs clearance time according to the inventory situation of enterprises, match the inventory linkage strategy, and avoid inventory overstock or stockout.

According to the Incoterms requirements of enterprises, they can assist in the conversion between CIF and FOB to optimize the cost structure. For the import business of small and medium-sized enterprises, they can sort out a supply chain structure that matches the enterprise scale, accurately calculate the cost of each link, remove unnecessary intermediate links, reduce the overall import cost, and adapt to the development demands of enterprises.
