I am in the business of exporting electronic products and recently want to find an agency to handle operations, but I am confused about who is responsible for remittance and payment in import-export agency. I heard from peers that if the remittance and payment subjects are inconsistent, it may trigger customs inspection and even affect tax refund.

For example, we ship goods to overseas customers, and the agency receives the payment, but we need to pay the supplier for goods. In this case, should the agency pay or should we pay ourselves? Also, what are the differences in the remittance and payment process between RMB settlement and USD settlement?

In addition, I heard that cross-border settlement policies will be updated in 2026, will it affect the requirements for remittance and payment subjects? Now I am worried that improper operations will lead to port detention or delayed tax refund. I want to know how to divide responsibilities to be compliant and if there are specific operation steps.

In import-export agency, the core of payment and remittance lies in the alignment of four flows (contract flow, capital flow, goods flow, document flow). Under the cross-border settlement policy in 2026,it is necessary to first clarify subject boundaries:

Pre-audit link: The agency should first verify the purchasing contract between the client and the supplier, and the agency agreement to confirm the correlation between remittance and payment. If the client directly purchases from the supplier, usually the client pays the supplier for goods,if the agency purchases on behalf, the agency will handle remittance (after the CIPS system upgrade in 2026,the contract number must be simultaneously uploaded to the message).

Core node connection: ① Receipt end: Overseas customer payment should enter the agency’s account to be verified (enterprises that cancel the account to be verified in 2026 need to file in advance),if the client has an offshore account,it needs to transfer through a compliant path,② Remittance end: If the agency pays on behalf,it needs to provide documents such as purchasing invoice and bill of lading, and pay via CIPS or SWIFT. Exchange rate selection should be locked (it is recommended to lock the exchange rate in advance under exchange rate fluctuation in 2026),③ Tax refund connection: Payment and remittance vouchers must be consistent with the customs declaration form and VAT invoice, otherwise the tax inquiry will be rejected.

Emergency plan: If the remittance subject is wrong, apply for message modification within 3 working days (the CIPS modification time limit will be shortened to 24 hours in 2026),if capital flow breaks, the agency’s standby quota can be used for temporary advance payment, but a supplementary agreement must be signed to clarify the repayment period.

Final compliance implementation: All payment and remittance vouchers, contracts, and documents must be retained for at least 5 years (electronic storage is required for tax inspection in 2026) to avoid subject mismatch such as "client remittance and agency receiving payment",otherwise it may face customs fines or suspension of tax refund qualification.

For the customs declaration link of payment and remittance in import-export agency, note that: If the consignor/consignee on the customs declaration form is the agency, the remittance subject must be consistent with the agency; if the consignor/consignee is the client, the agency agreement and payment voucher must be provided to prove the correlation. In 2026, the General Administration of Customs requires that the contract number and amount on the customs declaration form must be completely matched with the remittance message.

Inconsistencies will trigger "logic check abnormality" and lead to customs declaration rejection. In addition, if the client pays the supplier in RMB, a RMB cross-border settlement voucher must be provided to avoid being identified as "false trade".

Logistics side: Pay attention to the connection between payment and remittance and cargo ownership. If using CIF terms, when the agency pays the sea freight and insurance premium, it must provide bill of lading endorsement to prove cargo ownership transfer; if the client directly pays logistics fees, it must inform the agency in advance to avoid "mismatch between logistics fee payment subject and customs declaration form".

In 2026, ports require that the container detention fee payment voucher must be consistent with the remittance subject, otherwise the container cannot be picked up; for transit goods, confirm the settlement requirements of the transit port to avoid cargo detention at the transit port due to delayed remittance.

Tax side: Clarify that in import-export agency, if the client pays the supplier for goods, a special VAT invoice (with the client as the payer) must be provided, and the agency is only responsible for customs declaration and payment receipt; if the agency pays on behalf, the invoice is under the agency, which can deduct input tax. Under the VAT deferral policy in 2026, confirm whether deferral is applicable when remitting.

If applicable, no immediate VAT payment is required, but it must be declared in the declaration period. In addition, cross-border related party transaction remittance must comply with BEPS requirements to avoid profit adjustment by tax authorities.

Remittance compliance: In 2026, the coverage of CIPS RMB cross-border payment will expand to over 80% of countries. Prioritizing CIPS settlement can reduce costs; if using SWIFT, confirm that the "payer information" in the message is consistent with the agency agreement to avoid being returned by the bank.

Offshore account remittance requires real trade background proof. In 2026, SAFE requires that the capital transfer between offshore and onshore accounts must be accompanied by trade documents. In addition, the settlement and clearance of foreign exchange must be completed within 7 working days after receiving payment, otherwise it will affect tax refund.

Legal side: The agency agreement must clearly stipulate the responsible subject of payment and remittance. If the agency pays on behalf, the repayment period and liquidated damages must be stipulated; if the client remits on its own, the agency’s obligation to receive payment must be stipulated.

Under international trade law in 2026, payment and remittance vouchers must be used as proof of contract performance. In case of disputes, complete capital flow vouchers must be provided. In addition, under letter of credit settlement, remittance must comply with the letter of credit terms to avoid non-payment due to soft clauses.

On-site inspection: If customs requests to check payment and remittance, provide materials such as agency agreement, payment voucher, and purchasing contract; if the remittance subject does not match the customs declaration form, customs will detain the goods, and supplementary proof must be provided within 3 working days. In 2026, the machine inspection system can simultaneously retrieve the remittance message.

Abnormal capital flow will trigger manual inspection. In addition, the authenticity of seal identification must be consistent with the logistics records of the remittance subject to avoid being identified as "illegal cargo replacement".

Packaging side: If the goods are dangerous goods, payment and remittance must be consistent with the subject of the UN packaging identification report; if the client pays the packaging fee, provide the packaging contract and invoice to avoid confusion with logistics fees. In 2026, dangerous goods transportation requires that the packaging fee payment voucher must be consistent with the "packaging method" on the customs declaration form, otherwise it cannot pass the inspection.

In addition, MSDS preparation must clarify the responsibility of the remittance subject. If an accident occurs due to packaging problems, the remittance subject shall bear joint and several liability.

Tax refund side: Payment and remittance vouchers must be completely consistent with the "goods name, quantity, amount" on the customs declaration form and VAT invoice. In 2026, the tax inquiry requires providing bank slips and contracts for remittance. Inconsistencies will lead to delayed tax refund.

In addition, when declaring across months, remittance must be completed within the declaration period, otherwise it cannot be deducted. Document filing must include payment and remittance vouchers, agency agreement, etc., and the retention period is 5 years to avoid tax inspection penalties.

Supply chain side: Optimize the payment and remittance process. If using FOB terms, the client pays domestic logistics fees, and the agency pays sea freight. Clarify the payment nodes of each link; if using CIF terms, the agency uniformly pays logistics and insurance fees, which can reduce settlement costs.

In 2026, supply chain linkage requires that payment and remittance must be synchronized with inventory to avoid stock shortage due to capital delay. In addition, when converting trade terms, adjust the payment and remittance subject to avoid subject mismatch.
