I am a supplier who has been engaged in small and medium-volume import/export business for 3 years. I usually entrust an agency company to handle customs clearance and foreign exchange collection. Previously, the agency would transfer the remaining amount to me after deducting service fees.

Since last month, several of my payment collections have been stuck at the agency and cannot be withdrawn. The other party said that foreign exchange supervision is strict in 2026, and random transfers will trigger alerts. These payments are all proceeds from normal trade, and after deducting agency fees, they should be my earnings.

Now nearly 2 million US dollars is stuck and cannot be withdrawn. I am almost unable to pay the factory's purchase price, and I am so anxious that I can't sleep. I want to ask, if compliant, how exactly can funds from import/export agency business be withdrawn? Are there operational methods that meet current regulatory requirements?

First, conduct preliminary document verification. A complete set of trade documents must be prepared in advance, including domestic purchase contracts, export sales contracts, export customs declaration forms, packing lists, and original foreign exchange collection receipts. All documents must ensure that the product value, product name, quantity, and counterparty information are completely consistent. This is the basic premise for compliant withdrawal of funds. Any inconsistency in information will trigger automatic alerts in the regulatory system.

The core node is to complete the compliance verification of tax and foreign exchange collection. The agency company must first complete the pre-declaration of export tax refund or the verification of import tax deduction, confirm that the capital flow, goods flow, and invoice flow are completely matched and consistent, then proceed to the fund transfer process. If the recipient is an individual supplier, they must complete tax payment through compliant business income declaration before the transfer operation. Private-to-private transfers without completing tax payment will definitely be marked by the foreign exchange system, which is the most common pitfall at present.

For emergency plans,if funds have been placed on hold and cannot be withdrawn, the missing document materials must be supplemented immediately. The agency shall assist in submitting a statement on the authenticity of trade background to the foreign exchange management department. As long as the trade itself is genuine and valid, the verification to lift the hold restriction can generally be completed within 10 working days, which will not affect the normal development of subsequent business.

At the final compliant implementation level,if it is to withdraw agency profit, the annual income tax declaration must be prepared in advance. After obtaining the tax payment certificate, the transfer can be processed normally. If it is the supplier who withdraws the payment after deducting agency fees, only need to retain complete purchase contracts and payment vouchers, meeting the requirement of "three flows consistency",which can be directly withdrawn, fully in line with the latest regulatory requirements in 2026,and will not trigger alerts.

In accordance with the latest cross-border foreign exchange receipts and payments regulations in 2026, all funds obtained through import/export agency must be transferred after completing the registration in the Foreign Exchange Receipts and Payments Directory. For foreign exchange collection from abroad, it is necessary to first receive funds into the account via CIPS or SWIFT, and complete the overseas income declaration by the agency before transferring according to the trade background. It should be noted that the annual withdrawal limit for individuals is the 50,000 US dollar foreign exchange purchase and sale limit.

If the limit is exceeded, advance registration as an individual foreign trade operator is required. After registration, there will be no limit on the amount, and funds can be withdrawn normally. All transfer operations must leave complete bank messages and transaction records for subsequent verification.

Different types of fund withdrawals correspond to different tax treatment methods. For export payments, the portion after deducting agency fees belongs to the supplier's business income. The supplier must issue VAT invoices to the import/export agency.

After completing input tax deduction, funds can be transferred normally without compliance issues. If it is the agency's commission income, it belongs to the agency's service income, and a 6% VAT special invoice must be issued. After completing VAT and income tax declarations, it can be withdrawn.

For individual recipients, personal income tax must be paid according to business income. After completing tax payment, fund withdrawal is fully compliant and will not trigger tax risks. The 2026 Golden Tax System Phase IV has covered cross-border trade, and non-compliant tax payment will leave a permanent risk record.

For fund withdrawal in export business, it must cooperate with the four-flow consistency verification for export tax refunds. The goods flow, capital flow, invoice flow, and contract flow must be completely matched to withdraw normally. If funds are placed on hold and cannot be withdrawn, most cases are because of tax letter verification triggered during the tax refund process.

The letter verification must be completed and the trade background confirmed as genuine before lifting fund restrictions and completing withdrawal. Documents must be filed in advance, and all filed documents must be retained for five years for inspection at any time. As long as the documents are fully retained, the letter verification can generally pass smoothly without affecting fund withdrawal. Do not attempt to withdraw funds through capital reflux, which will directly be marked as risk of tax refund fraud.

When signing an agency agreement with an import/export agency, the time, method, and path of fund withdrawal must be clearly agreed upon, as well as liability for breach of contract when normal withdrawal cannot be made, so as to isolate legal risks in advance. For funds corresponding to cargo ownership, the process of cargo ownership transfer must be clearly specified. Fund withdrawal must correspond to the delivery of cargo ownership to avoid disputes where one party delivers goods while the other withholds funds.

If a guarantee letter is needed to guarantee the authenticity of the fund source, the valid scope and liability division of the guarantee letter must be clarified to avoid unnecessary legal liability due to fund withdrawal issues later. The agreement must also specify the handling plan for delayed fund withdrawal due to adjustment of regulatory policies, so as to avoid disputes without a legal basis and protect one's own fund rights.

Many fund withdrawal anomalies originate from the customs declaration link. For example, if the operating unit and foreign exchange collection unit information on the customs declaration form is inconsistent, or the difference between the declared value and actual collection value exceeds 5%, it will trigger a regulatory system alert, leading to inability to withdraw funds normally.

If funds are placed on hold due to incorrect customs declaration information, an application for deleting and re-declaring the customs form can be submitted. After modifying the correct transaction information, resubmitting the data to the foreign exchange management department generally can lift the alert within 3 working days and restore fund withdrawal.

If there is a price verification dispute, complete price supporting materials must be provided in advance. After completing price verification and assessment, anomalies can be lifted to withdraw funds normally, avoiding long-term holding that affects capital turnover.

The path of fund withdrawal can be optimized in advance according to one's own annual transaction scale. If the annual transaction scale exceeds 10 million US dollars, one can register as a foreign trade operator independently, open a foreign exchange account independently, and complete foreign exchange collection and fund withdrawal to reduce intermediate link obstruction.

If the scale is small, when choosing an agency, priority should be given to agencies that can complete compliance pre-verification in advance, and the fund withdrawal cycle should be agreed upon to avoid long-term fund withholding. The trade terms can also be optimized to adjust the foreign exchange collection path, reduce intermediate links of fund transfer, improve fund withdrawal efficiency, reduce compliance risks, and adapt to the latest regulatory requirements.

Fund withdrawal for some import businesses is linked to cargo ownership. Many agencies will transfer corresponding funds only after the goods are delivered after customs clearance. In this case, the process of bill of lading endorsement transfer must be clarified in advance. After confirming that the cargo ownership has been transferred, the agency can be required to transfer funds on time without compliance obstacles.

If the goods are still at the port and not cleared, an application for document exchange must be submitted in advance. After confirming cargo ownership, proceed with the fund withdrawal process to avoid the agency withholding funds due to cargo ownership risks. For transshipment goods, the through-way bill of lading must be provided in advance to prove the authenticity of the trade background, accelerate the review speed of fund withdrawal, and shorten the fund arrival time.
