I am engaged in imported snack food trade, and I just obtained the exclusive online and offline distribution right in China for a popular overseas milk tablet brand this year. I used to only do bulk wholesale of domestic snack foods, with no frontline practical experience in imported pre-packaged food at all. More than half a year ago, I tried to ship a small consignment, and chose two small agencies with very low quotations. As a result, the customs clearance was stuck for a full half month, and I was ordered to rectify because the label filing did not meet the new domestic regulations.

The goods piled up at the port and generated over 8,000 RMB of port demurrage, but the two small agencies shifted responsibilities to each other and refused to bear any losses. Now I need to ship 3 full containers of milk tablets every month on a fixed basis, and I am in urgent need of a reliable and professional imported milk tablet agency. I want to know how to choose properly to avoid traps, and which agency can guarantee smooth process and control compliance risks?

The most common misconception when sourcing imported milk tablet agencies in the industry is only focusing on quotations and selecting small agencies whose quotations are far below the market price. Most of these agencies hide a large number of additional service fees when quoting, and charge extra fees layer by layer afterwards. In addition, most of them do not have fixed on-site operation teams at ports, and outsource many core links to third parties. When problems occur, parties shift responsibilities to each other and no responsible party can be found.

Choosing an agency only based on low price will trigger a series of negative chain reactions: for example, lax document review leads to non-compliant labels and cargo detention, wrong HS code classification is deemed as false declaration by customs, which leads to fines and rectification at the minor case,or direct return shipment at the severe case. It will also generate high port demurrage and container detention charges, and the cargo pick-up can be delayed for up to 2 to 3 months, which directly misses the peak sales season of milk tablets, and brings irreversible sales loss and brand reputation impact to distributors.

To achieve physical risk isolation, first of all,you need to verify the agency's qualification for pre-packaged food import, confirm that the agency has more than 10 years of practical experience in pre-packaged food import, has a fixed direct operation team at the port, and is not a freelance intermediary agency that outsources the whole process.

Secondly, you need to confirm clear division of rights and responsibilities in contract terms, explicitly include the responsibility for additional costs caused by the agency's operational errors such as port demurrage and rectification fees into the contract,to avoid mutual shirking of responsibilities after problems occur from the contract level.

The exclusive loss control tip is that before cooperation, you can require the agency to provide the customs clearance records of milk tablets of the same category in the latest 3 months,to confirm its customs clearance efficiency and compliance rate. In addition, you can first test the practical operation capability by shipping one small trial consignment. Expand the cooperation scale only after confirming that the process is smooth and the timeliness meets the standard,so as to avoid stepping into traps with large one-time investment, and control the trial and error cost to the maximum extent.

Imported milk tablets fall into the category of pre-packaged food. Before import declaration, you need to check the overseas production enterprise's China market registration information in advance, confirm that the enterprise has completed registration with the General Administration of Customs of China. Products without valid registration are not allowed to be imported. In the declaration link, pay attention to tariff classification.

The classification of milk tablets depends on their ingredients: milk tablets with added sugar are classified under the general dairy product category, while the classification of casual milk tablets with other grain ingredients will be different. Wrong classification will lead to price review disputes, or even cause the document to be deleted and re-submitted. In case of price review disputes, you need to prepare original manufacturer invoices, foreign exchange payment vouchers, brand pricing documents and other materials in advance, cooperate with customs valuation, which can shorten the dispute handling time and avoid delaying customs clearance efficiency.

Most imported milk tablets require constant temperature transportation. When choosing the sea freight route, prioritize direct vessels to avoid repeated container changes during transit that cause temperature fluctuations and damage product quality. When booking space, confirm the pre-cooling requirements for reefer containers with the shipping company in advance, and follow up on the space status after booking, to avoid cargo rolling and space shortage during peak seasons.

Arrange customs clearance in advance after the cargo arrives at the port, and strive to complete container pick-up within the free storage period and free container period, which can avoid additional container detention charges and port demurrage. If you need to extend the free storage period due to abnormal customs clearance, you can apply to the port authority in advance, which can reduce part of the additional costs and lower the overall logistics cost.

The import value-added tax of imported milk tablets can be deducted against the output VAT of domestic sales. When selecting an agency, confirm that the agency can provide standard tax payment vouchers to support normal deduction of import VAT. For large-volume bulk import, you can apply for VAT deferral, which means you do not need to pre-pay VAT at the customs clearance link, so as to optimize capital occupation cost and improve capital turnover rate.

Pay attention to the application threshold of VAT deferral: the corresponding qualification of the agency is required to help the enterprise complete the filing application, and you can enjoy the policy dividend only after meeting the relevant requirements. Meanwhile, you need to properly retain tax documents to avoid problems in subsequent tax inspections.

The foreign exchange payment link for imported milk tablets must comply with China's domestic foreign exchange receipt and payment compliance requirements. Before making payment, confirm that the trade background is authentic, and prepare corresponding documents including contracts, invoices and customs declaration forms, to avoid being judged as abnormal foreign exchange payment by banks which delays the payment progress.

If you choose cross-border RMB payment, you can use the CIPS channel, which has lower handling fees, faster arrival speed, can avoid transit delay issues of the SWIFT channel, and lock the exchange rate in advance to reduce exchange difference loss. The agency needs to help check the payment message information to ensure all details are correct, avoid payment return caused by wrong message information, which delays payment timeliness and causes dissatisfaction from overseas suppliers.

When signing the cooperation contract for imported milk tablets, specify intellectual property clauses, require overseas suppliers to provide brand authorization documents, confirm that the authorization is valid within the territory of China, so as to avoid that the imported goods are detained after entry due to the intellectual property customs protection initiated by the brand owner.

When signing the import agency contract, clearly specify the division of responsibilities, and specify compensation clauses for additional costs caused by the agency's operational errors, to avoid no way to pursue liability when disputes occur afterwards. If you use letter of credit for payment, review the L/C terms in advance, remove hidden soft clauses, to avoid non-payment caused by inconsistent terms after shipment, which causes unnecessary losses.

Before customs inspection of imported milk tablets, prepare a full set of documents in advance, including label sample, component test report, original manufacturer invoice, trade contract and other materials, to cooperate with customs inspection. In case of machine inspection, sort out cargo storage information in advance, ensure clear machine inspection images, which can effectively shorten the inspection judgment time.

If container unpacking inspection is required, arrange a compliant unpacking team in advance, complete the unpacking within the specified time, to avoid additional overtime charges. If laboratory testing is required, cooperate with customs sampling in advance, follow up the test progress, and the goods can be released quickly after obtaining the qualified test report, which shortens the overall inspection duration.

The packaging of imported milk tablets must meet the domestic label specifications for pre-packaged food. The Chinese label must clearly mark core contents including ingredients, production date, shelf life, country of origin, overseas manufacturer information, and domestic importer information, without any errors or omissions.

The outer transport packaging must be reinforced with moisture-proof and drop-proof measures, to avoid packaging damage during long-distance transportation which leads to product damp and deterioration. For sea freight transportation, select cushioning packaging materials that meet moisture-proof requirements, to avoid the impact of high humidity maritime environment on product quality. Clearly mark transport labels on the packaging, to facilitate port operation and reduce the damage rate during handling.
