I am the procurement head of a medium-sized pharmaceutical trading enterprise in the Yangtze River Delta region. Recently, we have obtained the regional distribution and agency rights of several new prescription drugs of Pfizer.

We have no prior experience in importing such controlled pharmaceutical products. We have contacted multiple agencies for quotations, and the price gaps are extremely large: some claim customs clearance can be completed in 15 days, others say it takes 45 days.

Some peers who cooperated with small agencies before reported that their entire batch of goods was seized and they lost millions of funds. Now we want to know how Pfizer import agency works, what key points we should focus on when selecting such service providers, and whether there is any way to avoid common pitfalls?

First of all,it must be clarified that the core threshold for import agency of Pfizer related pharmaceutical products is not the quotation level, but the full-link compliance control capability. In the pre-document review stage, you shall check whether the service provider can sort out all required documents in advance, including 12 core documents such as drug import and export permit, overseas manufacturer qualification documents, product inspection and quarantine report, certificate of origin, etc. Cross verification of all documents must be completed 7 working days in advance to avoid document rejection caused by inconsistency between documents and goods. Many small agencies directly lead to goods detained at port for more than 30 days,or even returned, due to omissions in document review.

In terms of core node connection, you shall confirm whether the service provider has a dedicated green channel for pharmaceutical product customs clearance and priority declaration authorization at core ports such as Shanghai and Guangzhou. Meanwhile, verify whether it can realize process connection of manifest pre-processing,advance declaration, and immediate release upon cargo arrival. Under normal circumstances, the customs clearance cycle of controlled prescription drugs can be controlled within 20 days, far lower than the industry average of 35 days.

Abnormal contingency plan reserve is also a core assessment indicator. You shall confirm whether the service provider has response plans for abnormal situations such as price review disputes, sampling inspection and testing, temporary port control. Clear abnormal compensation clauses shall be signed, and the compensation ratio for overdue port detention shall not be less than 0.1% of the cargo value per day to transfer abnormal risks to the maximum extent.

In the final compliance implementation stage, you shall verify whether the service provider can complete the compliance declaration of foreign exchange receipt and payment and full-link follow-up of import value-added tax deduction process simultaneously,so as to avoid subsequent problems such as tax suspended accounts and abnormal foreign exchange receipt and payment. Do not blindly select agencies whose quotation is more than 30% lower than the industry average. Most of such agencies compress costs by omitting risk control links, and the final loss is often far higher than the agency fee saved.

The core of customs declaration for Pfizer related pharmaceutical products is the matching of price review logic. At present, all ports in China adopt the global concurrent transaction price comparison mechanism for the price review of imported prescription drugs. Three types of documents including Pfizer original manufacturer Invoice, foreign exchange payment voucher, and regional distribution agreement shall be submitted in advance as price supporting documents to avoid being identified as under-declared price by customs.

In case of price review disputes, supplementary explanatory materials shall be submitted within 3 working days, and guarantee release shall be applied for at the same time to avoid extra costs caused by cargo port detention. Do not trust the so-called "special relationship" for low-price customs clearance, as most of such operations will leave flaws in customs declaration records, resulting in repeated customs control and inspection for subsequent imports of similar products, which increases customs clearance costs.

For the international logistics of Pfizer pharmaceutical products, direct shipping routes are preferred, and transit regions such as Southeast Asia and the Middle East shall be avoided as much as possible to reduce the risk of excessive temperature and humidity and cargo damage during transit.

When booking space, apply for at least 14 days of free detention period at the port of destination and 7 days of free container period in advance, and purchase full-link cargo insurance covering abnormal temperature and humidity, damage, and seizure. In case of container roll-off, coordinate with the shipping company immediately to arrange the nearest subsequent voyage, and apply to the port customs for extension of the manifest validity period at the same time, to avoid the situation that the manifest cannot be declared due to overdue.

The core of tax optimization for Pfizer imported products is to reasonably apply for VAT deferral. Eligible enterprises can temporarily defer the payment of 13% import value-added tax at the import stage, and make the deduction until the subsequent domestic sales invoicing, which can greatly ease the cash flow pressure of enterprises.

Note that the consuming and using entity on the import customs declaration must be the enterprise that actually makes the deduction, and the full set of import documents, purchase and sales contracts, and foreign exchange payment vouchers shall be kept for future reference, to avoid being identified as false input tax deduction by tax authorities. Do not advance import tax payment through third-party enterprises, which will lead to the failure of normal input VAT deduction and generate extra tax costs.

The foreign exchange receipt and payment for Pfizer import must strictly follow the principle of authenticity of trade background. When making foreign exchange payment, three types of documents including import customs declaration, original manufacturer Invoice, and distribution agreement shall be submitted to the bank. The foreign exchange payment amount must be completely consistent with the dutiable value on the customs declaration, to avoid the situation that the difference of foreign exchange receipt and payment exceeds 5%.

If cross-border RMB settlement is adopted, CIPS channel is preferred, which takes 2-3 days less to arrive than SWIFT channel, and can avoid exchange rate fluctuation risks. Do not collect and pay goods payment through personal accounts or offshore accounts, which will be identified as abnormal foreign exchange receipt and payment by the foreign exchange administration, and affect the subsequent application for foreign exchange quota.

When signing the Pfizer import agency agreement, the qualification guarantee obligation of the service provider shall be clearly stipulated, requiring the service provider to commit to possessing all relevant qualifications for pharmaceutical product import. Meanwhile, the clause of cargo ownership shall be clarified: the ownership of the goods shall always belong to the entrusting party after the goods arrive at the port, to avoid the service provider misappropriating or mortgaging the cargo ownership.

Intellectual property exemption clause shall be added, clarifying that the entrusting party will not bear the responsibility for cargo seizure and confiscation caused by the intellectual property problems of Pfizer original manufacturer. Do not sign standard contracts without clear responsibility division, most of which will exempt the core responsibilities of the service provider, and no responsibility can be traced in case of disputes.

Adequate preparation shall be made in advance for port inspection of Pfizer imported pharmaceutical products. Before the goods arrive at the port, sort out the information such as batch number, validity period, and storage conditions of each batch of goods in advance, to facilitate quick verification during inspection.

If container unpacking inspection is required, the whole process shall be supervised on site to avoid damaging the sealed package of the drugs or causing excessive temperature and humidity during inspection. If laboratory testing is required, coordinate with the inspection institution for priority testing immediately.

The testing cycle of pharmaceutical products can usually be shortened to within 7 days, far lower than the 15-day testing cycle of ordinary goods. Do not open the package of inspected goods without permission, which will be identified as moving supervised goods without authorization by customs, facing fines or even cargo seizure penalties.

The packaging of Pfizer imported pharmaceutical products shall strictly comply with international transportation standards. Especially for products requiring cold chain transportation, UN-standard cold chain insulated containers shall be used, built with temperature and humidity recorders to record the temperature and humidity data during the whole transportation process, and the data shall be kept for at least 6 months for future reference.

Prepare the qualified MSDS report in advance, clearly specifying the product storage conditions and emergency response plan, and transport it together with the goods. Do not use ordinary thermal insulation materials to pack cold chain drugs, which will lead to excessive temperature and humidity during transportation, resulting in drug deterioration and scrappage, and huge losses.

The document retention for Pfizer imported products shall strictly comply with tax supervision requirements. Five types of core documents including import customs declaration, original manufacturer Invoice, foreign exchange payment voucher, inspection and quarantine certificate, and purchase and sales contract shall be kept for at least 10 years for future reference, to ensure the consistency of cargo flow, capital flow, document flow and invoice flow.

If input tax deduction related to subsequent domestic sales is involved, document filing shall be completed in advance, to avoid input tax transfer-out caused by failure to provide materials during tax verification. Do not lose any core import documents, as the reissue cycle of documents usually exceeds 30 days, which will affect the subsequent deduction process and generate extra tax costs.

The supply chain planning for Pfizer import shall prioritize CIF trade terms, under which the overseas Pfizer original manufacturer is responsible for international transportation and insurance, greatly reducing the logistics risks and costs of domestic enterprises. Inventory linkage mechanism shall be established, and import plans shall be arranged in advance according to domestic sales forecast, to avoid supply interruption or overstock of inventory.

Pre-stored inventory can be set up in domestic bonded warehouses: goods are imported to the bonded warehouse in advance, and customs clearance is processed after orders are received, which can shorten the domestic distribution cycle to within 3 days, greatly improving the response speed of the supply chain. Do not import goods exceeding 3 months of sales volume at one time, which will occupy a large amount of cash flow and increase the risk of drug expiration.
