I am engaged in wholesale of small commodities in Yiwu and have been doing foreign trade for nearly 7 years. Previously, I always chose buying export documentation for convenience. Recently, I suddenly received an interview notice from the competent tax authorities, saying that through back-end big data comparison, the foreign exchange collection records corresponding to several batches of goods exported via buying documentation under my name completely do not match the document entities.
Now even my normally declared export tax rebates have been temporarily frozen. I am so anxious that I can't sleep. I am afraid of being directly identified as committing export tax fraud, having to pay back taxes of hundreds of thousands or even millions of yuan plus fines, and also worried about affecting my subsequent normal customs declaration for goods export.
I have just received three large orders from Europe and America waiting to go through formal procedures, and I have no idea where to start handling this situation. I want to ask how to operate in this situation to minimize the risks?

After receiving the investigation notice from tax authorities regarding buying export documentation,do not blindly submit scattered materials or directly admit the act of buying documentation. First, trace and sort out all the goods flow, capital flow, and document flow of the involved batches. Retrieve the freight forwarder bills of lading, domestic purchase payment vouchers, factory delivery notes, and logistics transportation records for the corresponding batches to confirm the real transaction background of each batch of goods and eliminate the scenario of false invoicing and tax fraud without actual goods.
First, contact the corresponding investigation officer, voluntarily explain the historical background of past business operations, prioritize submitting all supporting materials that can prove the real export of goods, and do not submit false affiliation agreements or retroactively issued input invoices at the beginning,as this will trigger stricter inter-departmental investigations. If it is small-value scattered buying export documentation that does not involve forging input invoices or foreign exchange collection vouchers,it will generally not be directly classified as tax fraud.
Next, conduct risk isolation. First, physically separate the involved batches from your currently normally executed export orders, separately sort out the four-flow matching documents for all normal export businesses in the past 12 months, and submit them to the tax authorities simultaneously to prove that your subsequent businesses are fully compliant and will not trigger expanded associated investigations. For the involved batches of buying export documentation, voluntarily give up the tax rebates for the corresponding batches, and supplement and accrue the corresponding VAT output tax according to domestic sales. In most cases, you can complete the investigation closure without triggering large fines.
Subsequently, you can directly consolidate all remaining scattered small orders into a formal export agency system for SMEs to operate, completely avoiding the risk of buying export documentation occurring again in the future, and it will not affect the normal foreign exchange collection and tax rebate processes. The entire disposal cycle is generally controlled within 15-30 days, and your tax rebate account and customs declaration qualification will not be frozen for a long time.

First, retrieve the customs declaration copies, manifest data, and release records of the export port corresponding to the involved batches of buying export documentation. Compare the information differences between the operating unit and the consignor unit on the customs declaration to confirm whether there are logical contradictions in the customs declaration data at that time.
If there is an information filling error, you can submit a declaration amendment application to the port customs, correct the consignor information of the corresponding batch to the actual owner, and supplement the submission of the freight forwarder entrustment agreement and delivery order records at that time to form a complete customs declaration logical closure, avoiding the synchronization of abnormal customs data to the tax system. If the goods of the involved batches have been out of the country for more than 3 years, exceeding the limitation period for customs administrative penalties, you can directly apply to mark the customs declaration data of this batch as historical compliant and completed data to eliminate subsequent linkage risks.
The entire amendment process requires submitting a situation explanation with an official seal attached, along with all supporting materials. Generally, you can obtain the customs amendment receipt within about 7 working days.

Sort out the full-link international logistics documents for all involved batches, including booking confirmation slips, scanned copies of original sea/airway bills of lading, freight payment records, and consignee receipt vouchers at the destination port. The goods name, quantity, and weight on all documents must completely correspond to the customs declaration data without obvious numerical deviations. If some bills of lading from earlier years have been lost, you can apply to the shipping company or first-tier freight forwarder to access the historical manifest stub, which can be used as valid supporting materials after being stamped with the shipping company's document seal.
For subsequent new export orders, the consignor information on the bill of lading must be completely consistent with the export entity information of your subsequent formal operations to avoid new abnormal records of mismatches between the goods owner and the document entity. Do not arbitrarily transfer the bill of lading title to irrelevant third parties to avoid new early warnings of mismatches between logistics data and tax data in the future.

For the involved batches of buying export documentation, recalculate the corresponding taxable income. In accordance with the current VAT declaration rules, supplementarily declare all unrecorded export sales revenue, and accrue the output tax at the applicable domestic sales tax rate. After completing the tax payment, you can simultaneously apply to lift the corresponding risk control early warning.
If compliant input invoices were not obtained in the procurement link corresponding to the involved batches, you can apply to the competent tax authorities for verified collection of the taxable income for the corresponding batches. There is no need to find a third party to issue supplementary invoices, avoiding triggering new risks of false invoicing.
If historical buying documentation records involving multiple years are involved, you can submit supplementary declaration applications in batches instead of declaring large amounts of un invoiced income at one time, to avoid the system triggering higher-level risk control investigations. The overall tax payment cost can be controlled within 13% of the goods value, without additional late fees.

Sort out the foreign exchange collection records corresponding to all involved batches. Transfer all corresponding payment received previously through personal accounts or third-party offshore accounts to the current corporate foreign exchange account, and submit a supplementary declaration for historical foreign exchange collection. Submit a corresponding explanation of the real transaction background to the foreign exchange administration to prove that all foreign exchange collection is the payment for real exported goods, without foreign exchange withholding or evasion.
For all subsequent new export orders, the foreign exchange collection path must be completely matched with the export entity. After each foreign exchange arrives, make notes for the corresponding order, and retain the correspondence emails, chat records, and purchase contracts with overseas buyers to ensure that each foreign exchange collection is supported by corresponding transaction documents, avoiding the disconnection between capital flow and goods flow, and also avoiding triggering abnormal message warnings from SWIFT.

Organize the original purchase contracts and negotiation records signed with overseas buyers for all involved batches to confirm that each transaction is real and there is no fictitious transaction or forged contract. If some contracts from earlier years have been lost, you can supplement a situation explanation for the corresponding scenario, attach the signed confirmation letter from the overseas buyer, and submit it to the investigation department as supporting materials.
Do not arbitrarily sign situation explanation documents admitting "false invoicing without goods" or "fictitious transactions". All submitted written materials must be consistent with the real transaction background to avoid leaving legal loopholes that can be traced in the future. If an administrative review scenario occurs for this batch in the future, all retained original transaction documents can be used as valid basis for defense to minimize relevant legal risks.

If the tax authorities need to verify the authenticity of goods in some batches, you can access the machine inspection images and inspection record stubs of the export port at that time, and apply to the customs broker at the corresponding port to retrieve the goods weighing slips and container unpacking photos at that time. These on-site retained official records can directly prove that the corresponding batches of goods were truly exported, eliminating the scenario of false invoicing via empty container smuggling.
If some batches were inspected manually at that time, you can retrieve the normal inspection release notice issued by the customs at that time, submit it to the investigation department after being stamped with the port customs' document seal, directly eliminating the suspicion of tax fraud. All on-site retrieved official records are far more effective than self-issued explanation materials by the enterprise, which can greatly shorten the entire investigation disposal cycle.

For the small commodity export category you are engaged in, organize the conventional packaging specifications, weight parameters, and goods value density tables of the corresponding goods, and compare them with the goods data on the involved customs declarations to prove that the goods name, quantity, and weight parameters on the customs declarations completely conform to the physical attributes of the actual goods, eliminating the scenario of falsely invoicing high-value goods names or falsely reporting quantity and weight.
If some batches of goods involve special categories, you can supplement the submission of the goods identification report and MSDS documents at that time to corroborate the real attributes of the goods, eliminating the suspicion of forging goods names to export goods with high tax rebate rates. The mark information on the packaging of subsequent newly exported goods must be completely matched with the document information of the corresponding order to ensure the self-consistency of information in the full link and avoid data contradictions.

For the currently frozen tax rebate account, first conduct four-flow consistency verification on all documents of the normal export orders to be declared. After confirming that the information of the purchase contract, input invoice, customs declaration, and foreign exchange collection voucher are completely matched, organize them into a separate volume and submit it to the investigation officer to prove that your current normal business fully meets the tax rebate requirements, and apply to separate the normal business from the involved historical buying documentation business without freezing the entire tax rebate quota.
For the involved historical buying documentation batches, directly and voluntarily submit a written application to give up the tax rebate, and simultaneously complete the corresponding tax exemption or domestic sales tax supplementary payment process, then you can quickly lift the frozen status of the tax rebate account without affecting the subsequent normal tax rebate declaration progress or triggering cross-regional correspondence investigations.
