I’m a domestic beauty retailer planning to expand into imported color cosmetics this year. I don’t have import/export qualification myself. Earlier, I hired a small agent to handle a trial shipment, but the cargo was detained at the port for over half a month, resulting in tens of thousands of dollars in demurrage fees.

The agent blamed all issues on customs and refused to take responsibility, so I had to bear the costs myself. Now I have a large shipment to send, some friends say big agencies are reliable, but others say many agencies make price differences and are irresponsible. I’m unsure whether import business agencies are reliable now and don’t know how to choose to avoid the previous pitfalls. I want to ask about professional evaluation methods.

There are three common pitfalls in the import agency industry: First, hiring individual intermediaries or small freight forwarders without qualification. Most of these entities don’t have fixed port filing or compliance risk control systems, often winning orders with low prices and shirking responsibilities immediately when problems arise. Second,over-trusting the "all-inclusive price" promise. Many low-priced all-inclusive prices hide a large number of additional fees, and will charge extra under various names after the cargo arrives at the port. Third, ignoring compliance qualification verification. Many small agencies don’t have corresponding business scopes and operate by illegally attaching qualifications.

These non-compliant practices will trigger a series of negative consequences: at the minor level, additional demurrage fees and container detention fees will be generated, increasing unnecessary costs,at the severe level, cargo detention or return due to non-compliant documents, even affecting the enterprise’s import/export credit due to illegal declarations, leaving long-term compliance risks.

The core measures of physical risk isolation are: first, verifying the agency’s formal qualification, requiring them to provide import/export filing and port operation qualification certificates, and confirming the front-line practical experience of their core operation team, second, clarifying responsibility division in the contract, writing down various possible additional fees and responsibility attribution for abnormal situations into contract terms, avoiding verbal promises.

Exclusive loss-control tips: If you have already encountered an unreliable agency, ask them to transfer all complete documents immediately, contact the port’s formal operation team to check for amendment verification, communicate with customs in advance to explain the situation, avoid leaving abnormal records on your enterprise’s credit file, and retain all communication records and fee vouchers, pursue compensation through formal channels, fundamentally control risk spread and avoid impact on your subsequent import business.

For customs declaration anomalies caused by import agencies, first verify whether the agency’s declaration logic is closed-loop. Many unreliable agencies will forge documents to under-report prices or be unfamiliar with valuation rules, leading to valuation disputes and prolonged customs clearance. If over-due settlement or delayed declaration has occurred, organize complete cargo ownership certificates, purchase contracts and payment vouchers immediately, cooperate with customs to complete valuation verification.

If meeting customs integration declaration requirements, apply for deletion and re-declaration across ports, re-organize declaration logic and eliminate abnormal records. Confirm in advance whether the agency has experience handling valuation disputes and can provide complete document support, avoid leaving customs clearance abnormal records on your enterprise due to unprofessional agency operations, affecting subsequent business.

Loss of control over import logistics costs is mostly related to the agency’s solution design. Many agencies choose lower-priced transit routes to earn price differences, but don’t inform in advance of the storage rules at transit ports, leading to high container detention fees and storage fees after cargo arrives. When choosing an agency, ask for a clear route plan, mark specific duration of free storage period and free container period, as well as cost details of different transit methods.

For emergencies like cargo reloading and space overbooking, confirm whether the agency has backup sailing adjustment plans and can lock space with shipping companies in advance. When transferring cargo ownership, confirm whether the bill of lading endorsement transfer process is compliant, avoid unnecessary cargo ownership disputes and additional processing costs.

Many unreliable import agencies don’t actively do tax planning for clients, but instead earn tax differences using information asymmetry, leading to clients bearing unnecessary tax costs. Compliant import operations can apply for VAT deferral, reasonably use the deferral policy to delay VAT payment and optimize enterprise cash flow.

For import businesses involving cross-border related transactions, make pricing compliance adjustments in advance to avoid triggering transfer pricing investigations by tax authorities. If the agency doesn’t inform relevant tax optimization policies in advance but earns tax differences, this kind of agency is basically non-compliant, need to replace it in time, avoid long-term unnecessary tax costs, and complete tax risk isolation to avoid affecting your enterprise’s tax credit due to the agency’s non-compliant operations.

Import payment links are high-risk points for many unreliable agencies. Some non-compliant agencies require clients to transfer funds to private accounts or non-filing accounts, leading to compliance anomalies in foreign exchange receipts and payments, affecting the enterprise’s foreign exchange grade.

Currently, the coverage of RMB cross-border payment CIPS system is very high, formal agencies support RMB cross-border settlement through CIPS system, facilitating enterprises to settle and adjust accounts, and all payment and receipt processes comply with SAFE requirements. When choosing an agency, confirm all funds are transferred to public filing accounts, ask them to provide SWIFT messages or CIPS payment vouchers for retention, avoid SAFE inspections due to non-compliant fund processes, affecting subsequent payment and receipt business.

When cooperating with import agencies, focus on responsibility terms in the contract. Many unreliable agencies set ambiguous exemption clauses in the contract, shifting all responsibilities to clients when problems occur. Clearly agree on responsibility division for anomalies like cargo detention, port delay and declaration errors.

For cargo ownership transfer, ask the agency to issue corresponding guarantees to clarify cargo ownership, avoid situations where you pay the payment but can’t get the cargo. If involving imported goods with intellectual property, confirm in advance whether the agency has completed intellectual property customs protection filing verification, avoid cargo detention due to product infringement. All agreements need to be put in written contracts, don’t trust verbal promises, and you can safeguard your legitimate rights and interests with contract terms when disputes arise.

When imported goods encounter on-site customs inspection, unreliable agencies often can’t prepare in advance, leading to prolonged inspection process and additional costs. Formal operation agencies will prepare corresponding documents according to the cargo type, verify the authenticity of seals, organize cargo list in advance, if container opening is needed for inspection, arrange compliant container opening teams to cooperate with customs to shorten inspection time.

If goods need to be sampled for testing, the agency will follow the whole testing process, transfer test reports timely, avoid cargo detention at the port due to delayed information transfer. When choosing an agency, confirm its past on-site customs inspection success rate to evaluate its actual professional ability.

Whether an import business agency is reliable also depends on whether it can match the enterprise’s own supply chain needs. Enterprises of different sizes have different demands for import agencies: small and medium-volume import enterprises need flexible small-volume customs clearance operations, large-scale bulk import enterprises need long-term supply chain connection with controllable costs.

A reliable agency will adjust operation plans according to the enterprise’s import frequency, cargo type and volume, optimize inventory linkage strategy, calculate overall cost of the whole chain, won’t use a unified plan for all clients, and can also adjust trade terms according to enterprise’s needs, match different transaction methods, help enterprises control overall supply chain risks and improve operational efficiency.
