Last year,I worked with Manager Ge from a general cargo import & export agency company in Jiading,Shanghai. In 2025,the company handled RMB 12 million worth of agency business. The accountant reported all received funds as operating income for tax purposes, resulting in an overpayment of RMB 620,000 in value-added tax (VAT).It was not until the annual tax settlement in early 2026,when they approached us for compliance checks, that they applied for a refund of the overpaid tax, saving more than RMB 80,000 in late fees alone. Many agency business owners are unclear whether their incomes need to be taxed and which parts are taxable, leading to unnecessary overpayments and even fines for violating compliance rules.
Core Criteria for Determining Taxation of Import & Export Agent Incomes

The core of determining taxation for import & export agent incomes lies in whether the business operates under a pure agency model or a buyout agency model. The tax rules for these two models are completely different, and tax authorities have clearly updated their inspection standards in 2026.Please refer to the table below for specific differences:
| Business Model | Income Accounting Scope | Applicable Tax Rules | 2026 Latest Preferential Policies |
|---|---|---|---|
| Pure Agency Model (Service Fee Only) | Only agency service fees are accounted for; collected/paid goods payments/taxes are not included in income | Pay VAT at 6% applicable to modern service industry; eligible for differential taxation | VAT exemption for annual service fee income below RMB 1.2 million |
| Buyout Agency Model (Treated as Self-operated) | Full cargo value is included in revenue; purchase costs are deductible as input tax | Pay VAT at the applicable tax rate for goods (13%/9%); eligible for export tax refund | 10% additional input tax deduction for originating goods under RCEP |
Many agency enterprises run into trouble because even though they operate under a pure agency model, they are identified as buyout agencies by tax authorities due to non-compliant contracts, accounting records, and documents, and are required to pay tax based on the full cargo value, which unnecessarily multiplies their tax burden several times over.
Practical Notes on 2026 Latest Taxation Rules
In 2026,real-time data sharing has been realized among tax authorities, customs, and foreign exchange bureaus.Information on the operating entity and consignor/consignee on customs declarations, foreign exchange collection and payment records, and invoicing and declaration data from tax authorities are automatically cross-checked.A system alert will be triggered if any item fails to meet the requirements. To meet the taxation requirements for pure agency models, the following three conditions must be satisfied:
- Check contract terms: Only contracts clearly stating "amount of agency service fee, principal bears all cargo title risks,collected/paid funds are merely passed through without ownership rights" can be recognized as pure agency models, with taxation applied only to service fees
- Check fund flow: Collected goods payments must be recorded in a separate current account, must not be mixed with self-operated income, and each transaction must match the agency agreement, customs declaration, and the principal’s invoicing information
- Check document retention: Customs declarations for all agency businesses must include both the principal’s and agent’s information as consignor/consignee.Full sets of agency agreements, cargo title transfer certificates, and foreign exchange collection/payment slips must be retained for inspection, with a retention period of no less than 10 years
Two newly updated rules in 2026 require special attention: First, for service fee incomes under pure agency models, annual cumulative income below RMB 1.2 million is exempt from VAT,and no input tax deduction is required.Second, for agency services involving import and export of originating goods from RCEP member states,a 10% additional deduction for income tax can be applied to service fees, provided that the corresponding certificate of origin is retained.
Common Compliance Risks and Pitfall Avoidance Guidelines
Last year,I also handled the case of Ms.Zheng from Ningbo,Zhejiang, who operates a cross-border e-commerce import & export agency. For convenience in account handling, she recorded both collected goods payments from clients and her own service fees under the "main business income" account.During a tax audit in 2026,the tax authorities directly identified the RMB 32 million collected payments in her account as self-operated income, requiring her to pay an additional RMB 4.16 million in tax plus RMB 830,000 in late fees.We helped her organize 3 months’ worth of documents, including all agency agreements, customs declarations, foreign exchange collection slips, and the principal’s goods receipt certificates, which finally proved that these funds were merely collected and paid on behalf of others, exempting her from the tax supplement obligation. However, due to mixed accounting records, she still received an administrative fine of RMB 50,000.
Currently, there are two absolute red lines for import & export agency businesses: First,do not mix collected goods payments with self-operated income in accounting.Once discovered, unless you can provide a full set of supporting documents, these funds will be regarded as self-operated income for taxation purposes.Second,do not issue fraudulent agency service fee invoices. The 2026 tax control system can directly compare the service content on invoices with the corresponding customs declaration information.Service fee invoices without matching customs declarations will be directly marked as fraudulent, with the lightest penalty being three times the amount of the invoice.
