Is Agent Export Considered Export?Official Rules Give Clear Answer
First,a clear conclusion: Compliant agent exports that meet regulatory requirements are fully part of legitimate exports and enjoy the same policy treatment as self-operated exports. The 2026 latest revision of the "Regulations on the Management of Entrusted Export and Agent Customs Declaration" by the General Administration of Customs clearly states that as long as the entrusting party and the entrusted party sign a valid agency agreement, with complete document chains and clear ownership of goods,it can be recognized as a legitimate export. The entrusting party can normally apply for export tax refunds, enjoy local export subsidies, and have export performance recognized.

Last year,I met Mr.Tian from Suzhou who runs a hardware tool business. He used to mistakenly think that using an agent for exports wouldn’t count as his own export performance. To meet the export targets for high-tech enterprise certification,he reluctantly hired his own customs declaration and finance teams to do self-operated exports, spending over 300,000 yuan more in labor costs a year.Later,we helped him sort out the compliance certification rules for agent exports, adjusted the agency agreement and customs declaration form filling standards. His agent export data was fully included in the export performance statistics for high-tech certification, saving him about 400,000 yuan a year from reduced labor costs plus additional tax refunds.
Now,all ports across the country have realized export data networking. The entrusting party can directly log in to the Single Window for International Trade, query all customs declaration data corresponding to their agent exports with their own enterprise qualifications,no longer needing to ask the agent company for paper certificates. The recognition of export data is completely consistent with self-operated exports.
Comparison of Compliance Certification Standards Between Self-Operated and Agent Exports
| Comparison Item | Self-Operated Export | Agent Export |
|---|---|---|
| Declaration Entity | The export enterprise declares to customs on its own | The entrusted foreign trade agency declares to customs on behalf of the entrusting party |
| Ownership of Goods | Owned by the declaring export enterprise | Owned by the entrusting party; the agent only provides declaration, logistics, foreign exchange collection and other services |
| Tax Refund Entity | The declaring export enterprise | The entrusting party (requires the agent to issue a formal "Agent Export Goods Certificate") |
| Compliance Certification Standard | Consistency of three flows: documents, goods ownership, and foreign exchange collection | Consistency of three flows: agency agreement + documents + foreign exchange collection; accurate filling of the production and sales unit in the customs declaration form |
| Policy Access Rights | Can enjoy all export-related policy benefits | Under compliant operations, enjoys the same policy rights as self-operated exports |
3 Essential Conditions for Agent Exports to Be Recognized as Legitimate Exports
Not all agent exports can be recognized as legitimate exports. To enjoy the same treatment as self-operated exports, the following three conditions must be met simultaneously:
- Must sign a written "Entrusted Agent Export Agreement".The agreement must clearly specify the ownership of goods, rights and responsibilities of both parties, tax refund ownership, and foreign exchange collection path.Oral agreements or purchase and sale contracts cannot be used as substitutes. In 2026,customs added a verification requirement: when declaring agent exports,a scanned copy of the agency agreement must be attached. Those without an agreement will be directly subject to control and inspection.
- Customs declaration forms must be filled in accordance with standards. The domestic consignor should be the agent company’s name, and the production and sales unit must be the entrusting party’s full name and unified social credit code (not the agent company). If the production and sales unit is filled incorrectly, the entrusting party not only cannot have its export performance recognized but may also be determined as "buying export documents" and face a fine of more than 5% of the goods value.
- The foreign exchange collection path must comply with the latest 2026 requirements of the State Administration of Foreign Exchange. In the case of agent collection, the agent company must issue a stamped foreign exchange collection certificate to the entrusting party within 3 working days after receiving the payment, and register the entrusting party’s information in the foreign exchange monitoring system. It cannot privately retain or misappropriate the entrusting party’s collected foreign exchange.
Guide to Avoiding Common Compliance Risks in Agent Exports
Many enterprises are not familiar with the rules of agent exports and easily fall into pitfalls.I have sorted out two high-frequency risk points for everyone to check against:
The first risk is the compliance loophole of "fake agency, real self-operation".Some agent companies,to simplify processes, sign purchase and sale contracts with entrusting parties instead of agency agreements, and fill the production and sales unit in the customs declaration form as the agent company. In this operation mode, the export performance will be recognized as the agent company’s,and the entrusting party cannot apply for tax refunds or local subsidies. It may also be warned by the tax bureau due to inconsistency between invoices and goods. If exporting to countries with anti-dumping policies such as the EU and the US,it may be required to pay an additional 20%-40% anti-dumping tax due to unclear ownership of goods.
The second risk is tax refund failure due to incomplete document retention. In 2026,the tax bureau’s verification requirements for export tax refunds have been upgraded. When applying for tax refunds for agent exports,in addition to the conventional customs declaration form, input invoice, and foreign exchange collection certificate, the agency agreement, goods ownership transfer certificate, and full logistics track record must also be provided.Missing any item may result in the tax refund application being rejected,or even being required to pay taxes as domestic sales.
