At the end of last year,Mr.Jiao from Suzhou reached out to us.His business focuses on agent import of hardware tools,he helped 3 local factories purchase Japanese-origin electric screwdrivers, and his company undertook the full remittance work. However,he filled one of the 3 factories as the domestic consignee on the customs declaration form, which led to direct remittance rejection by SAFE.The cargo was detained at Yangshan Port for 8 days, with generated demurrage fee of RMB 27,000.Besides,China Customs launched control price verification, suspecting that he under-declared the cargo value. We encounter 3 to 5 similar cases every month. Many enterprises fail to clarify the declaration requirements for inconsistent remittance party and importer when conducting agent import operations, and accidentally violate the regulatory red line.
Core Regulatory Requirements for Agent Mode Where Remittance Party Is Not the Importer in 2026

In 2026,the General Administration of Customs and the State Administration of Foreign Exchange jointly launched the "Cross Verification System for Customs Declaration and Foreign Exchange Remittance Information",which realizes real-time comparison between customs declaration data and foreign exchange remittance data.As long as the remittance subject is inconsistent with the consignor/consignee on the customs declaration form, the system will automatically trigger an alert, and applications without valid compliance agent supporting documents will be directly rejected. The core differences between the two modes are shown in the table below:
| Comparison Item | Self-operated Import Mode | Agent Import Mode (Remittance Party Is Not the Importer) |
|---|---|---|
| Requirements for subject filling on customs declaration form | Both the consignor/consignee and the consumption and usage entity are the actual import enterprise | Fill the agent remittance party as the consignor/consignee,and fill the actual import principal as the consumption and usage entity |
| Remittance subject requirement | Only needs to be consistent with the consignor/consignee on the customs declaration form | Needs to be consistent with the consignor/consignee on the customs declaration form, and supported by official agent agreement |
| Core document requirements | Purchase contract, proforma invoice and waybill are sufficient | Additionally provide the agent import agreement sealed by both parties, which clearly specifies remittance responsibility and ownership of cargo |
| Foreign exchange verification cycle | Normally 1-2 working days | Normally 3-5 working days; additional transaction background statement is required for remittance over USD 500,000 |
| Compliance responsibility attribution | The actual import enterprise bears full responsibility | The agent party and the principal bear joint and several liabilities |
Common Compliance Risk Points Under This Mode
Many enterprises are not familiar with the regulatory requirements for this mode, and easily encounter four core risks:
- Risk of incorrect declaration: Filling the actual importer as the consignor/consignee on the customs declaration form leads to mismatch between remittance subject and customs declaration subject, and SAFE will directly reject the remittance application.Enterprises need to submit situation statement and modify the declaration form, which will delay customs clearance for at least 3-7 days, and generate extra costs such as demurrage fee and storage fee.
- Risk of price verification and inspection: Failure to fully preserve complete agent agreement and principal’s purchase demand documents, enterprises cannot prove the authenticity of transaction during customs price verification, and are very likely to be judged as under-declaring cargo value, facing supplementary tax payment and penalty of 0.5 to 5 times of the payable tax.
- Risk of hidden foreign exchange loss: If the agent party does not lock the exchange rate in advance before paying remittance, once the exchange rate fluctuation exceeds 2% during the settlement period, foreign exchange loss ranging from tens of thousands to hundreds of thousands of RMB will be generated. This cost is usually not agreed in advance, and easily leads to disputes between the agent and the principal.
- Risk of hidden charges: Some freight forwarders and customs brokers will charge extra "subject verification service fee" or "agent qualification affiliation fee" for agent mode, which is not clearly notified in advance. They force the extra charge during document exchange, and will not release relevant documents before the payment is completed.
Practical and Rigorous Operation Guide for Implementation
Combined with our first-line practical experience, all risks can be fully avoided as long as work in the following three links is completed properly.
Pre-document Review Link
All documents shall be prepared 3 days in advance, the core documents include the agent import agreement sealed by both parties. The agreement shall clearly specify that the remittance responsibility is borne by the agent party, and the cargo ownership belongs to the agent party before the remittance is fully completed. The HS code, cargo value and quantity of the imported goods under entrustment shall also be marked on the agreement.According to the 2026 new regulatory rule, applications missing any of the above items cannot pass foreign exchange verification. In addition, the principal’s purchase demand letter and communication records between the two transaction parties shall be prepared to support the authenticity of the transaction. If the goods are from RCEP member states, confirm in advance that the consignee on the certificate of origin is filled as the agent remittance party, otherwise the enterprise cannot enjoy the tariff reduction exemption.

Customs Declaration Link
The filling of customs declaration form shall strictly comply with regulatory requirements: fill the agent remittance party as the consignor/consignee,and fill the actual import principal as the consumption and usage entity. If there are multiple principals, mark the full name and Unified Social Credit Code of all consumption and usage entities in the remarks column of the customs declaration form. The HS code classification shall be pre-reviewed in advance. In 2026,the AI price verification system of Shanghai ports has realized automatic comparison between HS code and declared value. If the classification deviation exceeds 2 digits, the system will directly trigger control inspection. We can assist clients to complete HS code pre-classification in advance with a 99.7% accuracy rate,to avoid troubles brought by incorrect classification.
Foreign Exchange Settlement Link
3 working days before remittance, upload the agent import agreement, electronic customs declaration information and transaction background supporting documents on the Digital Foreign Exchange Management Platform, submit for verification in advance, and do not submit on the very day of remittance to avoid declaration block. If the remittance amount exceeds USD 500,000,submit the transaction background statement in advance, specify the final usage of the goods and the pricing basis of the purchase value,to shorten the verification cycle. If you worry about exchange rate fluctuation, you can sign forward foreign exchange settlement and sale agreement with the bank to lock the exchange rate and avoid foreign exchange loss risk.
Reference of Real Risk Avoidance Case
For the case of Mr.Jiao mentioned earlier, the situation was very urgent at that time: the 3 factories had suspended production waiting for raw materials, with a daily loss of about RMB 150,000,and he required us to complete compliance rectification and release the cargo within 3 days. Our Shanghai team accepted this case, first guided Mr.Jiao to supplement and prepare 3 separate agent import agreements signed with each of the 3 factories, clearly marked the HS code, cargo value and quantity of each batch of goods, then submitted the customs declaration modification application, changed the consignor/consignee to Mr.Jiao’s company, and filled the 3 factories as the consumption and usage entities respectively. At the same time,we uploaded all transaction supporting documents to the system of China Customs and SAFE,coordinated the price verification window of Shanghai port to conduct priority verification, and provided import price data of similar goods in the past 6 months to prove that the declared value is the fair market price. Finally, the customs declaration modification and foreign exchange verification were completed in 2 days, the cargo was released smoothly,no extra penalty was generated, and we helped Mr.Jiao save at least RMB 120,000 of compensation for factory work delay.
We are based in Shanghai, with remote declaration authorization covering all ports across China, and more than 200 cooperative agent outlets all over the world. For goods from Europe,America,Southeast Asia or any other regions,we can complete document pre-review in advance, predict potential risks, and help clients save customs clearance time and costs.
The 2026 joint supervision has become normalized.Do not take chances to forge agent agreements or fill in false customs declaration information.Once verified, the enterprise will be included in the dishonesty list of China Customs and SAFE,100% of all its import and export businesses will be subject to control inspection, which will affect normal operation. If you are not familiar with the declaration requirements,it is recommended to cooperate with professional agent institutions to avoid unnecessary risks.
