I am a small to medium-sized merchant doing cross-border consumer electronics exports, with an annual shipment value of about 32 million. Previously, I always organized a team to handle the import/export process myself. Last year, when shipping at Shanghai Port, a batch of goods worth over 800,000 was detained because declaration elements were filled in incorrectly and the logic of accompanying documents did not match. I lost nearly 1 million due to detention and fines. This year, I want to outsource the entire import/export process to an agency to avoid pitfalls.
However, I recently heard from several peers that some agencies operate non-compliantly, using clients' goods for grey clearance which implicates the client in investigations. Some run away with foreign exchange payments, and some fake tax refunds causing us entrusting parties to be audited by the tax bureau and pay back taxes. I want to ask how big the risk of agency import/export companies is now, what are the specific minefields, and how to avoid these problems?

The first misconception many enterprises have when looking for an import/export agency is only comparing prices and acting as a "hands-off" client, which is precisely the core source of risk outbreaks. In the industry, some small-scale agencies do attract customers with low quotes, but subsequently profit by falsely reporting fees, grey clearance, and misappropriating payments. Once a problem occurs, they cancel their registration and run away, leaving all losses to be borne by the entrusting party.
From the perspective of chain risks,non-compliant agency operations first trigger customs clearance risks: Falsifying declaration elements and inconsistent accompanying documents will lead to cargo detention. At best,it generates tens of thousands in demurrage and detention charges,at worst,it is classified as a key supervision object by Customs. All subsequent entry and exit goods will be strictly inspected,or even deemed as smuggling violations, facing fines of more than 30% of the cargo value. The second is tax risk: If the agency cannot achieve consistency of the four flows and falsely declares export tax refunds,it will directly implicate the entrusting party in tax bureau audits. Refunded taxes must be returned in full, plus late fees. Serious cases lead to the revocation of export tax refund qualifications.
The core of risk isolation is the clear division of rights and responsibilities. All operation documents must be confirmed and archived by the entrusting party in advance. Cargo ownership is registered in the name of the entrusting party throughout the process and does not pass through the agency's own asset accounts. Payments go through a separate third-party escrow account. Funds do not enter the agency's general settlement account, avoiding the problem of misappropriation of payments at the root. Progress on customs clearance and tax refund core nodes is pushed in real-time. Enterprises can directly query the corresponding status in the official systems of Customs and the Tax Bureau. An emergency plan is activated within 24 hours if an anomaly occurs. Sign a formal agency contract to clarify the division of responsibilities. All losses caused by the agency's operational errors shall be fully borne by the agency, minimizing the risk exposure.

In 2026, the online verification of customs credit ratings has been fully implemented. The credit rating of an import/export agency directly affects the clearance priority of the entrusting party. If the agency itself is a dishonest enterprise, the cargo inspection rate of the entrusting party will rise from the normal 3% to over 30%, and the average clearance time will extend by more than 72 hours.
If the agency has a history of false or concealed reporting, the customs system will automatically mark the declaration data of the corresponding entrusting party, triggering manual document review and price queries, requiring the submission of a full set of trade documents for verification. Once associated violations are found, the import/export qualifications of the entrusting party will be suspended for 6-12 months.
Before cooperation, be sure to check the agency's credit rating on the official website of the General Administration of Customs. Confirm it is of general credit or above, and has no record of false or concealed reporting or deletion and re-submission of documents more than 3 times in the past 2 years, to avoid being implicated by the agency's bad records.

If the logistics operations of an import/export agency are non-compliant, it will directly lead to loss of cargo ownership and a surge in additional costs. Some low-price agencies will consolidate goods from multiple customers into one container. To lower freight costs, they choose slow ships with many transshipment ports. In case of overbooking, they prioritize rolling the goods of small customers.
All demurrage and detention charges are passed to the entrusting party, and there is even the situation of releasing goods without the Bill of Lading, leaving the entrusting party with loss of both money and goods. Before cooperation, confirm the agency's cargo ownership control rules. Require that the shipper and notify party on the Bill of Lading must be marked with the full name of the entrusting party.
The original Bill of Lading is sent directly to the entrusting party, or the release instruction must be issued by the entrusting party; the agency cannot control it alone. At the same time, clarify the application standards for free storage time and free container detention time, and the division of responsibility for rolling containers and changing ports. All additional costs caused by the agency's operational errors shall be fully borne by the agency.

In 2026, the cross-border tax module of Golden Tax Phase IV has achieved full data networking. The tax operation risk of the import/export agency will be directly transmitted to the entrusting party. Some agencies, to get more tax refunds, will falsely report cargo values, tamper with procurement invoice information, or mix input invoices from multiple customers for offsetting. This causes the business logic of the entrusting party's input invoices to be inconsistent, triggering automatic warnings from the tax bureau.
During cooperation, clarify that the agency only provides operation services. The issuance of all input invoices and output invoices must be confirmed by the entrusting party, and information such as cargo name and value must not be changed without authorization. At the same time, require the agency not to use the entrusting party's input invoices for tax refund offsetting for other customers. Provide a tax operation audit report once a year to ensure all declared data is completely consistent with the entrusting party's actual business, avoiding associated tax audits.

In 2026, the penetrative supervision of cross-border payments has been fully implemented. Non-compliant payment operations by the import/export agency will directly lead to the freezing of the entrusting party's foreign exchange account. Some agencies will mix foreign exchange from multiple customers into the same account for settlement, or even use underground banks for exchange, resulting in unclear sources of foreign exchange and triggering warnings from the foreign exchange administration.
The settlement quota of the entrusting party will be suspended, or even listed as a key supervision object for foreign exchange. During cooperation, confirm that the agency opens a separate foreign exchange settlement sub-account for each customer. All foreign exchange income enters the corresponding sub-account directly and must not be mixed with funds from other customers or the agency's own funds.
The settlement exchange rate must be settled according to the real-time central bank parity rate, and private retention of exchange rate differences is prohibited. All SWIFT messages and CIPS payment vouchers must be synchronized to the entrusting party for retention, ensuring the entire capital flow is traceable.

Loopholes in the terms of the import/export agency contract are risk points that many enterprises easily ignore. Some agencies will set hidden exemption clauses in the contract.
Once problems such as cargo damage, detention, or tax refund failure occur, all responsibility is shifted to the entrusting party. Before signing the agency contract, focus on checking three clauses: First, the liability division clause, clarifying that all losses caused by the agency's operational errors, including cargo damage, fines, demurrage, and tax refund losses, shall be fully compensated by the agency.
Second, the exclusivity clause, requiring the agency not to simultaneously undertake agency business for competing products of the same type as the entrusting party, to avoid leakage of customer and product information. Third, the force majeure catch-all clause, clarifying that when encountering force majeure such as port congestion or customs policy adjustments, the agency must provide an alternative plan within 24 hours and cannot refuse to bear due operational responsibilities on this ground.

Non-compliant on-site inspection operations by the import/export agency will directly lead to cargo detention and inspection, generating additional time and economic losses. Some agency's on-site personnel lack experience when responding to inspections. When encountering machine inspection anomalies, they directly agree to unpack the container, or even arbitrarily modify declaration information to cope with the inspection, causing goods to be sent to the laboratory for testing.
The average clearance time is extended by more than 15 days, or even deemed as unqualified goods for return or destruction. Before cooperation, confirm that the agency's on-site inspection team has more than 3 years of operational experience at the corresponding port. When machine inspection anomalies occur, synchronize with the entrusting party immediately.
Submit supporting materials for review without changing actual cargo information. When unpacking for inspection, authorized personnel from the entrusting party must be present to follow up throughout the process. The inspection and identification report must be synchronized to the entrusting party immediately, ensuring the inspection process is compliant and transparent.

In 2026, the verification of the "four flows consistency" for export tax refunds has achieved full-process automatic comparison. Non-compliant tax refund operations by the import/export agency will directly lead to the failure of the entrusting party's tax refund, or even the recovery of refunded taxes. Some agencies will simplify the document filing process or forge logistics documents and collection vouchers, causing the four flows logic to be inconsistent, triggering tax bureau inquiries. The tax refund time is extended from the normal 7 working days to more than 3 months, or the tax refund application is directly rejected.
During cooperation, confirm that the agency retains a full set of documents for each tax refund, including procurement contracts, customs declarations, logistics documents, and collection vouchers, and all document information is completely consistent. Before tax refund declaration, give the entrusting party confirmation of the declaration data, and submit the formal declaration after the pre-declaration passes. Cooperate with the entrusting party to complete the tax bureau's inquiry work every year. Tax refund losses caused by the agency's document problems shall be fully borne by the agency.

Insufficient supply chain planning capability of the import/export agency will lead to an increase in the overall operating cost of the enterprise and even missing market windows. Some agencies only do basic customs clearance and logistics operations and cannot optimize import/export paths based on the enterprise's cargo attributes, shipment cycles, and destination country policies, causing the enterprise to pay more tariffs and miss peak sales seasons. Before cooperation, confirm that the agency can customize import/export schemes based on the enterprise's business scenarios.
For example, goods exported to the EU can choose the VAT deferment path to save cash flow in the import link; during peak shipment seasons, space can be locked in advance to avoid rolling containers; for high-value goods, direct flight paths can be chosen to shorten transportation time. At the same time, optimize the division of cargo ownership and risks according to different trade terms to help enterprises reduce overall cross-border operating costs and improve capital turnover rates.
