I have been a merchant specializing in large home appliance exports to the EU for three years. Last month, I shipped a full container of goods of a well-known international floor washer brand to the Port of Hamburg, but as soon as the cargo arrived at the port, it was detained by the local customs.
The reason given was that the brand authorization I provided was only for domestic regional distribution rights, without compliant export sales authorization, suspected of infringement. Currently, the demurrage fee is increasing daily, and the domestic agent of the brand has also sent me a lawyer's letter stating that I have exceeded my authority to sell.
The previous freight forwarder I cooperated with said that as long as there is a regular domestic purchase voucher, the shipment can be made, but I did not expect to step into such a big pit. Now I want to figure out who exactly owns the export agency rights of big brands, what qualifications are required to be legally valid, and whether there are differences in the verification requirements for such authorizations at different domestic ports?

First,it is necessary to clarify the most common misconception in the industry: many merchants believe that as long as they hold domestic regional distribution authorization and regular purchase vouchers, they have the right to export brand goods externally. This misunderstanding has led to over 1,200 export cargo detentions nationwide due to ownership issues in the first half of 2026. Once stepping into such a pit,the losses range from demurrage fees and cargo confiscation (generally 1.5 to 3 times the value of the goods) to being sued by the brand owner for infringement, being included in the customs' intellectual property dishonor list, and having the inspection ratio of all subsequent export goods increased, directly affecting normal business operations.
There are only two types of subjects for the ownership of export agency rights of big brands: one is the brand headquarters itself, and the other is the official export authorized distributors globally or in specific regions designated by the brand's written authorization. The authorization obtained by ordinary domestic regional distributors only covers the domestic sales scenario and does not have the authority to authorize third parties to export goods. Even if the source of goods is purchased through regular channels, the act of exporting without clear export authorization constitutes infringement.
There are two loss-reduction paths for detained goods currently: If you can contact the brand owner, apply for supplementary export authorization documents immediately. The documents must clearly specify that the authorized sales scope covers the destination country, the authorization validity period, and the corresponding SKU list of exported goods, and submit them to both the domestic export port and the destination country's customs for ownership verification. If supplementary authorization cannot be obtained, apply for return shipment immediately to avoid further losses from accumulated demurrage fees.
Before conducting export business of big brands in the future,it is necessary to first verify whether the authorizing party holds the official export authorization filing certificate issued by the brand owner, and log in to the customs intellectual property protection system in advance to compare the right holder's filing information. Only after confirming that the authorization scope matches can you prepare goods for shipment. Do not trust verbal promises from freight forwarders or suppliers.

2026 Customs Intellectual Property Protection System has realized global brand filing information network verification. When exporting goods of big brands, the system will automatically compare the right holder's filing information of the declared brand. If the declarant cannot provide the export authorization document issued by the right holder, manual inspection will be triggered directly, and the goods will be detained.
If supplementary authorization is obtained, it must be submitted to the intellectual property department of the port customs within 7 working days, and the electronic version must be uploaded to the intellectual property filing module of the single window. After verification is passed, the goods can be released normally.
If authorization cannot be provided, you can apply for deleting the declaration and returning shipment voluntarily, which will not be included in the administrative penalty record. If the compliant certificate is not submitted within 15 working days, the customs will directly confiscate the goods and synchronize the information to the brand owner.

The free storage period at the terminal for detained goods involving brand ownership disputes can be extended by a maximum of 10 days. The container demurrage fee beyond this period will be charged at 1.5 times the standard rate.
If it is determined to return shipment, you can directly contact the shipping company to apply for changing the port back to the original departure port without additional transfer fees, only bearing the cost of the one-way sea freight. After returning to China, it can be declared as returned goods without paying import tariffs.
If you want to try to supplement authorization for release, you can first apply to transfer the goods to a bonded warehouse near the terminal. The storage cost is only 30% of the terminal demurrage fee, which can effectively reduce the cost loss during the waiting period.

If the goods are finally judged as infringing and confiscated, the corresponding input value-added tax cannot be deducted, nor can export tax refund be applied. Those who have already declared tax refund will be required to return the already refunded tax amount and will be included in the tax verification list, and the review level of all export tax refund applications within the next 12 months will be improved.
If the goods are returned, you can apply for input tax adjustment to the competent tax authority with the return declaration form and the non-tax refund certificate, which will not generate additional tax costs and will not affect subsequent tax refund qualifications. If supplementary authorization is obtained for normal release, ensure that the authorization documents are consistent with the purchase vouchers and declaration form information to avoid problems of inconsistent "four flows" during subsequent tax refund verification.

In the subsequent foreign exchange collection and payment process, if foreign exchange collection is involved for big brand goods, the bank will require the export authorization document as the verification material for trade background. If it cannot be provided, it will be judged as abnormal trade, the foreign exchange collection will be frozen, and normal foreign exchange settlement cannot be carried out.
After obtaining the export authorization, upload the scanned copy of the authorization document to the supporting material library of the "Enterprise List for Trade Foreign Exchange Receipt and Payment". The system will automatically verify during subsequent foreign exchange collection, and no repeated submission of materials is required. If RMB settlement via CIPS is used, the verification requirements are consistent with SWIFT, and the authorization document must be uploaded in advance for background filing to avoid posting problems.

The export authorization issued by domestic regional distributors has no legal effect. The brand owner has the right to pursue the infringing liability of the exporter, and the compensation amount is usually 1 to 5 times the value of the goods. If the distribution agreement signed by both parties previously explicitly prohibits export, breach of contract liability will also be pursued, requiring compensation for the brand owner's market losses.
If a settlement can be reached with the brand owner, a formal settlement agreement must be signed, clearly stipulating that the brand owner will no longer pursue infringing liability, and issuing a temporary export authorization to ensure that the goods can be normally cleared through customs. For future cooperation, a special export authorization agreement must be signed, clearly specifying the authorization scope, validity period, and liability division to avoid ownership disputes.

During on-site port inspection, if the goods are found to be well-known brands, the outer packaging marks and anti-counterfeiting codes will be verified against the brand information filed in the system immediately. If the authorization document cannot be provided, a detention voucher will be issued directly and sent to the intellectual property department for follow-up processing.
If the authorization document is held, ensure that the brand official seal and authorized person's signature on the document are consistent with the system filing. If there are differences, a notarization certificate proving the authenticity of the authorization document will be required. Do not attempt to tamper with the authorization scope of the authorization document during inspection; if found, it will be transferred to the customs anti-smuggling department, and criminal liability will be borne if it is suspected of smuggling.

Big brand goods usually have exclusive brand marks, anti-counterfeiting codes, and sales area marks printed on the packaging. If exporting, ensure that the sales area mark on the packaging is consistent with the authorized destination country.
If the packaging has the mark "For sale only in the Chinese territory", even if there is an export authorization, it will be judged as non-compliant and cannot be normally cleared through customs. If repackaging is needed, obtain the repackaging authorization from the brand owner, repackage according to the brand owner's standards, ensure that the packaging marks meet the requirements of the destination country, and retain the entire repackaging process records for inspection.

When applying for export tax refund, the export authorization document is one of the four necessary documents, which must be retained for inspection together with the declaration form, purchase voucher, and foreign exchange collection certificate, and the retention period is 5 years. If the tax authority initiates a document verification later, the original authorization document will be required for inspection.
If it cannot be provided, it will be judged as not meeting the tax refund requirements, the already refunded tax amount will be recovered, and a fine of not less than 1 time but not more than 5 times the tax amount will be imposed. If the authorization is a multi-level authorization, a complete authorization chain document must be provided to prove that each level of authorization is legal and valid to pass the tax refund verification.

When planning the supply chain for big brand exports, give priority to selecting suppliers with official export authorization from the brand owner. Do not choose goods from ordinary regional distributors just to get lower purchase costs; although you can get a 5% to 10% price advantage, once an ownership dispute occurs, the loss will be several times the value of the goods. When signing a supply contract, clearly stipulate that the supplier shall bear the responsibility for authorization compliance.
If cargo detention, confiscation, or infringement compensation occurs due to authorization issues, all losses shall be borne by the supplier, which can effectively hedge your own risks. Merchants who have long-term experience in big brand exports can directly apply for exclusive export authorization from the brand owner; the purchase cost can be reduced by 10% to 15%, and at the same time, they can enjoy logistics and marketing support from the brand owner.
