Reliable sourcing and import agency services.
I am a handling staff of a trade company engaged in the import of precision electromechanical equipment. Recently we received an urgent order imported from Germany, and plan to entrust a professional agency company to handle the entire import procedures. I heard from peers before that some agency import services are exempt from VAT, but I have no clear idea of the specific rules.
Our company used to handle customs declaration and logistics on our own, and we want to outsource this time due to tight schedule. We are worried that the agency service fee will add extra tax burden, for example, does the agency fee charged by the agency company need to pay VAT?
If the batch of equipment will be re-exported to Southeast Asia later, will the VAT policy for agency services change? In addition, will the settlement between our company and the agency company using RMB or foreign currency affect the VAT payment? We hope these situations can be explained clearly, so as to avoid tax violation or overpayment of tax later.

First of all,it should be made clear that the 2026 domestic VAT policy for agency import services is not uniform, and it is necessary to judge whether exemption is applicable based on the business scenario. VAT exemption for agency import services only applies to specific cross-border scenarios, not all agency import businesses can enjoy the tax exemption preference.
Scenario 1: If the goods imported by your company entrusting a domestic agency company are finally for re-export outside the territory, and all relevant procedures of the agency service (such as order negotiation, document processing, settlement) meet the definition of cross-border service "fully consumed outside the territory",you can apply to the competent tax authority for VAT exemption. Under this scenario, the complete set of documents including agency agreement, export customs declaration form,cross-border receipt and payment voucher must be kept, none of which is dispensable.
Scenario 2: If the goods imported by your company entrusting a domestic agency company are for domestic sales, the agency fee charged by the agency company falls under the category of "brokerage agency services",and VAT shall be levied at a tax rate of 6%,with no applicable tax exemption policy. Some enterprises mistakenly believe that the payment for goods collected and paid on behalf also needs to be taxed. In fact, the payment for goods collected and paid on behalf is not included in the VAT calculation base, and only the agency fee part is taxable.
Scenario 3: If the entrusting party is an overseas entity, and the agency company is a domestic enterprise that acts as the agent to import goods to the domestic market for sales, the agency fee shall also be subject to VAT at 6% and cannot enjoy tax exemption.
In addition,in 2026,some free trade zones piloted the VAT refund after collection policy for agency import services. If your business is settled in the pilot area, you can additionally apply for refund of part of the paid VAT,but conditions such as registering within the area and ensuring real business must be met. Enterprises that do not keep complete business documents as required cannot enjoy any tax exemption or refund policies, which requires special attention.

The VAT calculation base for agency import services only covers the agency service fee, and the payment for goods, customs duty, consumption tax and other amounts collected and paid on behalf are not included in the taxable scope. If the agency company provides integrated services including customs declaration and logistics at the same time, the agency fee and logistics fee shall be accounted for separately. Failure to conduct separate accounting will lead to application of the higher applicable tax rate.
During the price verification process, the customs authority will check the authenticity of the agency agreement. If it is found that the agency service fee is significantly lower than the fair market value, a price verification adjustment may be initiated. It is recommended to prepare service cost details, market quotation references and other materials in advance. If you are involved in the free trade zone pilot policy, you need to submit a business filing application to the customs in advance to ensure that the customs clearance process is synchronized with the tax declaration.
In addition, in 2026, the customs added a new electronic document verification module for VAT documents of agency import services. Enterprises no longer need to submit paper agency agreements, and only need to upload the agreement document with electronic signature to complete the verification.
However, it is necessary to ensure that the electronic document is consistent with the actual business. In case of inconsistency between the customs declaration form and the agency agreement, the VAT declaration may be abnormal, and you need to contact the customs in time to cancel the original declaration and re-declare.

There are differences in VAT policies for the logistics link and customs declaration link in agency import services. If the international freight forwarding service meets cross-border conditions, it can enjoy VAT exemption. However, the customs declaration service for imported goods agency is not classified as freight forwarding service and needs to be taxed separately.
If the agency company entrusted by your company provides logistics services such as international sea freight and air freight at the same time, the logistics fee and agency fee shall be invoiced separately. Otherwise, the tax authority may levy VAT on all income at the 6% tax rate.
In addition, you need to pay attention to the VAT treatment of logistics surcharges such as free storage period and container detention fee: if the container detention fee is advanced and collected by the agency company, it shall be incorporated into the agency service fee to calculate and levy VAT; if the container detention fee is paid directly by the cargo owner to the shipping company, it is not included in the taxable scope of agency services.
When choosing the logistics route, the choice of transit port will also affect the VAT cost. The logistics service of direct shipping routes usually more easily meets the cross-border tax exemption conditions, while transit routes need to provide additional business supporting documents of the transit place.

VAT planning for agency import services shall be combined with the overall tax structure of the enterprise. If your company carries out both import and export businesses, you can build a cross-border service platform to include the agency import services into the scope of cross-border taxable activities and enjoy the VAT exemption policy.
It should be noted that the "fully consumed outside the territory" requirement for cross-border services must meet four conditions at the same time: the service provider is located within the territory, the service recipient is located outside the territory, the actual consumption place of the service is outside the territory, and the service is not directly related to the immovable property or goods within the territory.
In addition, the implementation of the BEPS Multilateral Convention in 2026 requires that the pricing of agency services comply with the fair market principle. If the agency service fee is significantly lower than the market price, the tax authority may conduct transfer pricing adjustment.
It is recommended to sign an advance pricing arrangement with the agency company in advance to clarify the pricing standard of the service fee and avoid subsequent tax risks. If VAT deferral is involved, it is necessary to ensure that the agency company has completed the VAT deferral filing in the importing country, otherwise it will affect the domestic VAT declaration.

The compliance of receipt and payment of foreign exchange for agency import services directly affects the VAT declaration. If your company settles with the agency company in foreign currency, you need to complete the international revenue and expenditure declaration within 15 working days after the receipt and payment of foreign exchange, otherwise it will affect the tax authority's recognition of cross-border services.
If you use CIPS for cross-border RMB payment, you need to ensure that the payment information is clearly marked with "agency import service fee" to avoid confusion with the payment for goods.
In addition, in 2026, the State Administration of Foreign Exchange added a new electronic verification system for the receipt and payment of foreign exchange for agency import services. Enterprises need to file the agency agreement in the system in advance, otherwise the receipt and payment operation cannot be completed.
In case the amount of receipt and payment is inconsistent with the agency service fee, you need to submit a difference explanation document, otherwise it will be regarded as illegal receipt and payment of foreign exchange, which will affect the enterprise's foreign exchange credit rating. At the same time, you need to note that the receipt and payment cycle of agency services shall not exceed 90 days. If it exceeds the cycle, you need to apply for extension to the State Administration of Foreign Exchange.

The VAT risks of agency import services shall be clearly specified in the contract. The agency agreement shall clarify the tax calculation method, tax rate, invoice type and other contents of the agency service fee to avoid subsequent tax disputes.
If it is agreed that the entrusting party shall bear the VAT, the invoicing time and content shall be clearly specified in the agreement to ensure that the entrusting party can normally deduct the input tax. If the agency company fails to issue the special VAT invoice as agreed, the entrusting party can require it to bear the corresponding liability for breach of contract.
In addition, in 2026, China revised the relevant provisions on agency services in the Civil Code, clarifying that the agency company shall be responsible for the authenticity of the services it provides. If the agency company provides false documents resulting in the entrusting party being unable to enjoy the VAT exemption or refund policy, the agency company shall bear the compensation liability.
It is recommended to require the agency company to provide its tax compliance certificates of the past three years before signing the agency agreement, and avoid selecting agency companies with tax violation records.

During on-site customs inspection, the customs authority will focus on verifying the relevant documents of agency import services, including agency agreement, service fee invoice, receipt and payment voucher, etc. If it is found that the service content in the agency agreement is inconsistent with the actual business, the enterprise may be required to make up the VAT payment and pay late payment surcharge. Before the inspection, all documents related to agency services shall be sorted out in advance to ensure that the contents of the documents are consistent.
In addition, in 2026, the customs added a new machine inspection and comparison module for agency service fees. The system will automatically compare the difference between the agency service fee and the fair market value.
If the difference exceeds 20%, manual inspection will be triggered. In this case, you need to prepare service cost details, market quotation references and other materials in advance to explain the reason for the difference to the customs.
If the customs determines that the service fee is on the low side, the tax calculation base needs to be adjusted and the VAT shall be supplemented. It is recommended to negotiate with the agency company in advance to adjust the amount of the service fee to avoid inspection delay.
