I am a small and medium-sized industrial and trading enterprise that has just transitioned to providing agency export services. Previously, I only did self-operated exports. This year, I have received many agency export orders entrusted by peers and need to issue VAT invoices for agency commission fees to the entrusting parties.

I am currently unclear about the exact applicable tax rate for agency export commission fees under different circumstances, and whether there is a difference between the rates applicable to small-scale taxpayers and general taxpayers. I am worried that if we issue the invoice with the wrong tax rate, it will affect the entrusting party's ability to handle export tax refunds.

It is currently quarterly filing, and I am anxious to clarify this issue; otherwise, I dare not issue invoices and fear that incorrect filing will leave compliance hazards. I would like to ask for the accurate tax rate application rules to help us avoid potential risks.

Many small and medium agency export service providers habitually mismatch tax rates when issuing invoices for agency export commission fees. Either general taxpayers illegally issue invoices at a low levy rate,or they confuse it with the goods tax rate and issue the wrong invoice. This incorrect operation will directly lead to non-compliant input deduction for the entrusting party. Once subjected to a tax audit, not only will the full amount need to be voided via red-letter credit and re-issued,but it will also implicate the entrusting party by pausing their export tax refunds, generating late fees and extra communication costs. The provider itself will also leave a record of tax violation, affecting subsequent business operations.

According to the latest VAT collection and administration rules for 2026,agency export commission fees belong to brokerage and agency services under commercial auxiliary services. General taxpayers are subject to a 6% VAT rate, while small-scale taxpayers are subject to a 3% levy rate. Small-scale taxpayers meeting the conditions for tax reduction can enjoy a preferential tax rate of 1%.

The core drawback of traditional tax rate mismatching operations is touching the compliance red line to save tax, which instead brings higher hidden costs. The optimization path is to select the corresponding tax rate based on one's own tax qualification, truthfully declare and issue invoices. If the annual invoicing amount is below the mandatory recognition standard, one can maintain small-scale qualification to enjoy the low levy rate,if serving large clients year-round requires issuing 6% special invoices, one can apply to register as a general taxpayer.

The entry threshold for this rule is only bound to one's own taxpayer qualification and does not require additional approval. One can dynamically adjust based on the volume of one's own business calculated quarterly, balancing tax rate costs and client needs, thereby avoiding compliance risks from the root.

Incorrect declaration of the tax rate for agency export commission fees will trigger a risk warning in the comparison of the miscellaneous items in the export customs declaration form. Customs will conduct cross-checks with the tax authorities.

If it is found that the agency fee amount listed on the customs declaration form does not match the invoiced amount and tax rate, it will be deemed as a false declaration. Lightly, it will require changing the document and re-declaring; severely, it will suspend the paperless clearance qualification, affecting the clearance efficiency of all subsequent export goods.

When declaring exports, the column for agency fees must be consistent with one's own invoicing tax rate and amount. Do not arbitrarily adjust data to under-report miscellaneous fees. All data must be traceable.

The application of the tax rate for agency export commission fees is directly bound to the service content. If the agency export contract simultaneously includes other services such as customs clearance and logistics, the sales amounts of different services need to be calculated separately, and the corresponding tax rates applied separately.

If they are not calculated separately, the higher tax rate will apply, increasing unnecessary cost expenditures. If all services are merged into the agency export commission fee, they can be uniformly subject to the corresponding tax rate for brokerage and agency services without splitting. This operation complies with the current VAT collection and administration rules for mixed sales and will not trigger compliance issues.

In the foreign exchange payment and receipt link for agency export commission fees, if the commission fee is deducted directly from the export payment, it is necessary to clearly mark it as a commission or agency fee when declaring the foreign exchange payment. The corresponding invoicing tax rate needs to match the foreign exchange collection amount.

If tax rate mismatching causes a large discrepancy between the foreign exchange collection amount and the invoiced tax-inclusive amount, it will trigger a compliance review by the State Administration of Foreign Exchange, affecting the enterprise's foreign exchange payment and receipt rating. Subsequent cross-border payments and receipts will be subject to key supervision. When declaring foreign exchange payments and receipts, accurately mark the nature of the fees and match the corresponding invoicing tax rate and amount.

When the entrusting party handles export tax refunds, the tax authorities will verify the compliance of the agency service fee invoices.

If the tax rate on the agency fee invoice is issued incorrectly, it will be directly judged as non-compliant documents, triggering an export tax refund verification letter, extending the tax refund cycle, or even directly refusing the refund, causing losses to the entrusting party and also affecting the credit of the agency party, hindering subsequent business undertakings. After invoicing is completed, verify the invoice's tax rate, amount, and title information, and keep them archived for future inspection.

The agency export contract needs to clearly agree on the tax rate, invoice type, and invoicing time for the agency fee. If policy adjustments lead to tax rate changes, adjustment rules need to be agreed in advance to avoid subsequent contract disputes.

If the agency party issues the wrong tax rate causing losses to the entrusting party, the entrusting party has the right to claim compensation according to the contract agreement. Clarifying tax rate clauses can avoid unnecessary legal disputes.

In the cost accounting of agency export business, the input cost brought by the tax rate needs to be included in the overall quotation. If one is a general taxpayer subject to a 6% tax rate, one can issue special invoices that can be fully deducted to the entrusting party, and the quotation can be adjusted appropriately to balance tax rate costs and quotation benefits.

One can adjust qualifications based on the needs of one's own client group to optimize the overall benefit structure and adapt to the needs of different types of entrusting parties.

If the agency export business includes logistics and transportation additional services in the commission fee, note that the tax rate for logistics and transportation services is different from that for agency brokerage services. The general taxpayer tax rate for transportation services is 9%, while agency services are 6%.

Mixing them in one invoice will lead to tax rate mismatching and trigger compliance risks. It is necessary to separately calculate the sales amounts of different businesses and issue invoices with corresponding tax rates respectively to ensure declaration compliance.
