I operate a small home furnishing processing factory. This year, I have just started stably receiving small retail orders from overseas. Previously, I always used an agent for export procedures. Now, the overseas clients are developed and maintained by me, and they are accustomed to remitting directly to my offshore account.

I do not want to transfer the payment to the agent's account, as it not only slows down capital turnover efficiency but I also worry about funds getting stuck. Recently, I heard from peers that foreign exchange regulations were updated with detailed rules at the end of 2025. I am unsure if I can collect payments myself in agency export now? Will it violate rules and trigger regulatory warnings?

Will it affect my subsequent export tax refund processing? Is there a compliant operational method that allows me to use the agent for customs clearance and tax refunds while retaining the right to collect payments myself? I dare not act rashly now, fearing problems might affect future exports, so I want to ask clearly about the specific requirements.

The most common misconception in the industry is believing that agency export either requires the agent to collect payment or that self-collection is possible with just a verbal agreement. Both perceptions do not comply with current 2026 regulatory rules. Many small and medium-sized exporters skip filing to save processes and collect payments directly, ultimately triggering regulatory risks.

Under current full-link networked supervision rules,self-collection without compliant filing will directly trigger warning signals in the foreign exchange enterprise directory. The chain reaction will extend from settlement to customs clearance and tax refunds: First, the local foreign exchange bureau will require a situation explanation and verify fund flows. If it cannot match the corresponding export goods information,it will be judged as abnormal. Subsequent export tax refunds will be suspended. In serious cases, already refunded taxes will be recovered, the enterprise export classification grade will be lowered, affecting all future export declaration processes, and there may even be situations where goods are detained or seized at the port, unable to clear customs.

The risk isolation measure compliant with current rules is very clear: As long as the rights and responsibilities agreement is signed and information is filed, compliant self-collection is possible. The core of operation is to sign a written supplementary agreement with the agency export enterprise, clearly defining the division of rights and responsibilities for goods ownership and funds. Then, through the State Administration of Foreign Exchange's digital platform, complete the matching and filing of settlement information with the corresponding agency export declaration form, ensuring that information on the four flows is checkable and traceable.

If you have already collected payment without filing, the exclusive tip for stopping losses is: You must complete retroactive filing within 15 natural days. Ask the agency export enterprise to assist in issuing a statement on the division of rights and responsibilities, and submit it to the local foreign exchange bureau to explain the situation. The vast majority of unintentional violations can have warnings lifted without leaving a negative record.

Agency export self-collection does not directly affect the customs clearance process, but it is necessary to ensure that the information on the foreign exchange verification link of the declaration form matches the actual payment information. The 2026 customs clearance integration system has achieved real-time data interaction with the foreign exchange bureau system. If the payment subject marked on the declaration form is inconsistent with the actual payment subject, and subject information filing has not been done in advance, the system will automatically trigger the price review and verification link, extending customs clearance time by 1-3 working days.

If supporting materials cannot be supplemented in time, the declaration will be rejected directly. Materials to be supplemented include the agency agreement, proof of rights and responsibilities of the payment subject, and the export goods contract. All materials need to be stamped with the official seal of the agency export enterprise and scanned and uploaded to the customs clearance integration platform to complete the information update. If a rejection has already occurred, you can directly apply to delete the declaration and re-report. After supplementing materials, a new declaration can be issued within 24 hours without leaving a violation record.

Agency export self-collection does not affect cargo title control and logistics operations, but attention needs to be paid to the consistency of the Bill of Lading consignee information. If collecting payment yourself, overseas buyers usually require the Bill of Lading consignee to be made directly to themselves or a designated entity, without endorsement by the agency export enterprise. In this case, it is necessary to ensure that the Bill of Lading information matches the buyer and seller information in the trade contract and declaration form.

If changing ports or adjusting Bill of Lading information is required, as long as proof of rights and responsibilities between the payment subject and the agent is provided, the port change operation can be processed normally without generating additional procedure fees. Applications for demurrage and detention and free time are the same as the conventional agency export process; you only need to inform the freight forwarder of the actual payment subject information in advance to avoid inability to pick up goods due to subject inconsistency.

Agency export self-collection does not directly generate additional tax costs, but attention must be paid to tax filing requirements for cross-border funds. If collecting foreign currency payments yourself, during the settlement phase, you need to provide the agency export agreement and declaration form information to the bank to prove the trade background of the funds.

If it meets VAT deduction requirements, process deductions normally; no additional withholding tax will be generated. If using RMB received via CIPS, you only need to confirm that the source of funds meets tax requirements; no additional tax registration is needed. If there are cross-border related-party transactions, pricing filing needs to be done in advance to avoid being identified as base erosion, triggering tax audits.

The 2026 cross-border settlement compliance rules are clear: in agency export mode, the principal is allowed to collect payments themselves, requiring only subject information filing. If using an offshore account to collect payment, you need to truthfully declare the offshore account collection records in the annual foreign exchange inspection, matching them with domestic export goods information.

The SWIFT message needs to clearly mark the declaration form number of the corresponding export goods to facilitate bank and foreign exchange bureau verification. For RMB collection via CIPS, simply mark the operating unit code of the agency export in the remittance message, and the system will automatically complete information comparison.

The compliance pass rate exceeds 98%. As long as there is no capital round-tripping, it will not trigger compliance warnings.

Agency export self-collection requires a clear agreement on the division of rights and responsibilities in the agency contract to avoid subsequent cargo title or payment disputes. It must be clearly agreed that the agency export enterprise is only responsible for handling procedures such as customs clearance and tax refunds and does not bear the risk of payment collection.

The responsibility for the overseas buyer failing to pay on time is borne by the principal. At the same time, it must be agreed that if regulatory risks are triggered due to self-collection, the principal must bear full responsibility.

If losses are caused to the agency export enterprise, the principal must make corresponding compensation. The contract must be stamped with the official seals of both parties, and a copy kept for filing with the local customs and foreign exchange bureau to avoid inability to provide evidence in case of future disputes.

Agency export self-collection will not increase the probability of on-site inspection, nor will it trigger additional verification during inspection due to inconsistency between the payment subject and the declaration operating subject. If an on-site inspection is encountered, you only need to provide the agency export agreement and proof of rights and responsibilities of the payment subject to explain the self-collection situation.

The core of customs inspection is still to verify whether the cargo name, quantity, and specifications match the declaration form. As long as there is a compliant agreement, the difference in payment subject will not affect the inspection result result.

If there is a seal anomaly, contact the port area seal inspection personnel directly and provide a letter of introduction for agency export to reseal. No additional payment-related materials are needed. The process is the same as routine inspections.

As long as agency export self-collection meets the requirement of consistency of the four flows, it will not affect the processing of export tax refunds. The four flows refer to cargo flow, invoice flow, contract flow, and capital flow. As long as the contract clearly stipulates that the principal collects payment themselves and the capital flow matches the export goods amount, it meets the requirements of tax refund verification.

During tax correspondence inquiries, you only need to provide the agency agreement, payment voucher, and filing information. It will not fail tax refund verification just because the payment subject is not the agent. If non-compliant capital round-tripping has already occurred, timely supplementary explanatory materials and information matching adjustments are needed to avoid being identified as illegal tax refunds and recovering already refunded taxes.

Agency export self-collection is suitable for small and medium-sized sellers who do long-term small-batch and multi-batch exports, as it can improve capital turnover efficiency and reduce capital occupation in intermediate links. If the order scale is stably below 5 million USD in annual export value, the benefit ratio of self-collection is far higher than agency collection. It saves agency collection fees and allows flexible arrangement of settlement time to capture exchange rate gains.

If the annual export value exceeds 10 million USD, it is recommended to combine partial agency collection and partial self-collection to balance compliance risks and capital efficiency. Adjust the collection mode according to the payment habits of different overseas buyers to optimize the overall supply chain capital turnover efficiency and fit your own business development rhythm.
