I am a factory manufacturing small home goods. This year, I just obtained independent export rights. Previously, I sold directly to domestic trading companies, but now I plan to take small overseas orders myself and find an agency company to handle the entire export process.
I am currently very confused about whether agency exports actually require tax payment. Friends doing foreign trade tell me that requirements vary by situation. I fear that paying too much tax will squeeze my already thin profits, but I am also afraid of underpayment triggering tax risks that affect future exports.
I cannot distinguish what tax payment responsibilities I, as the principal, and the agency need to bear respectively, and whether requirements differ for different products. I want to understand the latest rules for 2026. Please explain clearly.

Many foreign trade practitioners assume that agency exports require both the principal and the agent to pay taxes. This is a core cost drawback of traditional operating models: In the past, many small and medium-sized factories used informal individual agents, resulting not only in double VAT levies but also an inability to enjoy export tax rebates due to unclear entity status, adding an extra 10%-15% to operating costs. Some non-compliant agents would also transfer hidden tax costs to the principal, which could subsequently trigger tax audit risks.
According to current 2026 import and export tax rules, the tax payment obligation for agency exports follows the principle of "who exports collects foreign exchange, who refunds tax pays tax." The principal is the actual taxpayer for the exported goods. The agent only charges a fixed agency service fee and only needs to pay VAT on the service fee portion, they do not bear relevant taxes and fees for the export goods link.
For agency export goods that meet the conditions, the principal can normally apply for export tax rebates and does not need to pay VAT on the export link. The access threshold for tax exemption without tax payment is clear: Production enterprises without import and export operation rights that entrust agents to export self-produced goods can directly enjoy the VAT exemption policy, only for goods where the state has explicitly cancelled export tax rebates does the principal need to pay VAT according to regulations.
You can dynamically calculate the benefit ratio based on the actual cargo type and trade method: If the goods meet tax rebate conditions, choosing compliant agency export yields profits 3%-8% higher than selling to domestic trading companies after deducting agency service fees from the rebate income. If the goods do not meet tax rebate conditions, compliant enjoyment of the tax exemption policy can avoid extra tax expenditures while clearing compliance obstacles for subsequent exports.

The tax payment determination for agency exports requires first clarifying the duty paid value of the exported goods. The customs valuation link determines the duty paid value based on the actual transaction price of the goods. If there is a discrepancy between the payment requirements for agency export goods and the transaction price, a valuation dispute will be triggered, leading to incorrect tax fee calculation.
If there is under-reporting or failure to report the transaction price, not only will tax payment be required, but late fees will also be incurred, affecting the enterprise's customs credit rating. When declaring agency exports, it is necessary to organize sales contracts, invoices, packing lists, and other transaction proof materials in advance to ensure the declared price is consistent with the actual transaction, avoiding extra tax expenditures due to valuation anomalies. If a valuation dispute occurs, complete price proof materials can be provided to file a reconsideration, recalculating taxes after correcting the duty paid value to avoid unnecessary losses.

The destination country VAT taxes involved in agency exports need to be planned in advance. If exporting to regions like the EU or the UK where import VAT is required, VAT deferral can be applied for through a compliant structure, eliminating the need to pay VAT in advance at the import link and relieving pressure on funds.
If agency export involves cross-border related party transactions, the independent transaction principle must be met, and transaction prices must be set reasonably to avoid triggering BEPS-related investigations and being required to pay back taxes and fines. Tax rules vary significantly by country, so it is necessary to sort out the destination country's tax requirements in advance, plan ahead, and avoid the risk of double taxation to reasonably reduce overall tax costs.

The collection and payment of foreign exchange in agency exports directly affects tax determination. If the subject of collection/payment differs from the export subject, tax authorities will deem it an abnormal declaration and require back payment of taxes. The usage rate of the RMB cross-border payment CIPS system continues to rise in 2026.
For agency exports settled in RMB, it is necessary to ensure the collection/payment path is clear and retain complete SWIFT or CIPS message vouchers for tax authority compliance verification. Compliant collection/payment operations can prove the authenticity of the export business, ensuring the principal normally enjoys tax exemption or rebate policies, avoiding tax back payment risks caused by non-compliant collection/payment, and can also reduce exchange difference costs by optimizing the timing of foreign exchange purchase and settlement.

When processing export tax refunds for agency exports, it is necessary to ensure the consistency of the four flows: the flow of goods, invoices, capital, and contracts. If any link is inconsistent, a tax inquiry letter will be triggered, suspending the refund or even requiring back payment of refunded taxes.
Document filing for agency exports needs to retain materials such as the agency export agreement, export goods customs declaration form, foreign exchange collection voucher, and purchase invoice for tax authority verification. The pre-verification check for export tax refunds in 2026 will automatically check tax payment status.
If there are unpaid taxes, the refund declaration will be directly intercepted, and taxes must be paid before proceeding. Organizing documents and checking the four flows in advance can avoid tax losses due to compliance issues.

Tax payment responsibilities in agency exports need to be clearly agreed upon in the agency export agreement to avoid mutual shirking when tax back payments occur subsequently. If the tax subject is not clearly agreed in the agreement and taxes are underpaid, both the principal and the agent need to bear joint liability, and customs and tax authorities can recover taxes from either party.
The agreement needs to clearly stipulate: If tax back payment, late fees, or fines are caused by the agent's operational errors, the agent bears full responsibility; if tax issues are caused by inaccurate goods information or transaction prices provided by the principal, the principal bears responsibility. Clarifying rights and responsibilities can avoid subsequent legal disputes.

The agency export structure can be adjusted based on the type of exported goods and order scale to optimize tax costs. If there is a long-term stable agency export demand, agency export services can be integrated into the overall supply chain structure, reducing agency service costs through batch operations while integrating tax difference benefits to improve overall profits.
For orders with different trade terms, adjust the tax bearing structure: Under FOB terms, export link taxes are borne by the principal; under CIF terms, the duty paid value can be calculated after deducting freight and insurance premiums, reducing the tax base for the export link, reducing tax expenditures reasonably and legally, and improving the overall supply chain income level.

Logistics operations for agency exports do not directly generate additional export taxes, but abnormal logistics operations may trigger tax changes. If goods undergo a change of port or return, they need to be re-declared for export.
If the original export already enjoyed tax rebates or exemptions, the exempted taxes need to be paid back before proceeding with the new export process. If goods are detained at the port for an extended period and handled by customs according to law, it will also involve the settlement of taxes.
If taxes are not settled, it will affect the enterprise's credit. Planning the logistics path in advance to avoid unnecessary diversions or returns can avoid the risk of tax back payments, while reasonably applying for free storage time and demurrage/detention reductions to lower extra costs in the logistics link.

When agency export goods encounter on-site inspection, if the inspection reveals discrepancies in the goods name, quantity, or specifications compared to the declaration, the duty paid value will be recalculated, and the payable taxes adjusted. If the originally declared taxes are insufficient, taxes must be paid back in time, and late fees may be incurred.
During the inspection, it is necessary to cooperate with customs by providing complete goods data and explaining the actual situation of the goods. If there is an objection to the tax adjustment, relevant proof materials can be provided on the spot to apply for re-verification, avoiding incorrect tax determination. Checking that goods information matches declaration information in advance can avoid tax adjustments during the inspection link, reducing unnecessary extra expenditures.
