I am the person in charge of a micro and small enterprise that has just started agency import business. Recently I have received three agency import orders, and my main income comes from agency service fees. Currently I have two business modes: one is that I collect the full payment for goods on behalf of the customer and then pay it to the overseas supplier, and the other is that the customer remits the payment directly to the overseas seller, and I only charge a fixed agency fee.

I have long been confused about what counts as my agency import revenue and what taxes I need to pay for such revenue. I previously heard from peers that some enterprises confused agency revenue with the taxes payable on the imported goods themselves, which led to tax inspection and fines by the tax authority, and even damaged the enterprise's import and export filing qualification.

I am about to file tax returns this month, and I feel more and more uneasy, worrying that mistakes will lead to adverse consequences. I would like you to help me clarify what taxes shall be paid on my agency import revenue under different business modes, and what risks need to be avoided?

The most common misunderstanding in the industry is to confuse agency import revenue with the goods taxes levied in the import link on behalf of relevant parties. Many newly established enterprises that just enter the industry count the full payment from customers (including goods cost, import taxes) as their own revenue, thus paying unnecessary extra taxes. Some even mistakenly classify agency revenue as goods sales revenue, and apply the wrong tax rate.

The direct negative consequences of such mistakes are as follows. First, extra value-added tax and corporate income tax will be paid, increasing unnecessary costs. Second, wrong declaration leading to abnormal revenue data will trigger joint inspection by the tax authority and customs. In serious cases, the enterprise will be fined,or even its credit rating as an import and export enterprise will be downgraded. Afterwards, the enterprise's customs clearance will be subject to focused inspection, and its daily businesses including export tax refund processing will also be affected.

The core method for risk isolation is to clearly distinguish agency revenue from advance payment and collected payment on behalf of third parties. Only the part of agency service fee shall be recognized as the enterprise's own revenue. The payment for goods and import duties and value-added taxes paid on behalf of customers are all receivable and payable items under current accounts, which do not need to be included in revenue for tax payment.

For different business modes, only the agency service fee revenue is subject to value-added tax and corporate income tax. Small-scale taxpayers can enjoy the current applicable tax reduction and exemption policies, and general taxpayers shall pay value-added tax at the 6% tax rate applicable to modern services. Independently calculate agency revenue and advance payments on behalf of third parties, and properly keep the agency agreement and advance payment vouchers for record, then the enterprise can achieve full compliance, avoid extra or wrong tax payment, and isolate tax risks from the source.

Agency import revenue falls under the brokering agency service category in the modern service industry. The tax base for value-added tax is the total price and extra charges collected by the taxpayer from taxable sales activities, excluding government funds and administrative charges that are collected on behalf of others and paid to clients or third parties. It also does not include the current account items such as import link taxes and overseas goods payments paid on behalf of customers.

If the enterprise meets the conditions for value-added tax differential taxation, the balance after deducting the goods payment and import taxes paid on behalf of customers can be taken as the value-added tax tax base, to further reduce the enterprise's tax payment cost. In the operation process, complete materials including agency service agreements, advance payment vouchers, customs import duty payment receipts, and settlement documents between both parties shall be kept for future reference, to ensure the accuracy of the tax base and meet the requirements of tax verification.

The data in tax declaration for agency import revenue shall match the relevant data in the customs declaration link. If you carry out agency import business as the operating entity stated on the customs declaration form, you need to ensure that the accounting of agency revenue is clearly distinguished from the goods value declared to customs, to avoid triggering customs price assessment adjustment or early warning for inspection by the tax authority due to excessive deviation between the declared enterprise revenue and the declared goods value.

If the dual-head customs declaration mode is adopted, the division of tax obligations between the operating unit and the actual consignee shall be clarified in advance, and the agency attribute shall be clearly marked on relevant documents, to avoid repeated tax declaration and payment which will increase unnecessary costs.

In the cross-border receipt and payment of foreign exchange link, the declaration calibers of agency service fee and goods payment shall be clearly distinguished. The service fee revenue obtained from agency import shall be declared for cross-border receipt and payment under the trade in services item.

The advance payment for imported goods made on behalf of customers shall be declared under the goods trade item. Independent accounting and independent declaration for the two types of funds can not only meet the compliance requirements for cross-border foreign exchange receipt and payment, but also help enterprises clearly distinguish their own revenue from the collected and advanced current account funds during the tax authority's verification process, so as to avoid being mistakenly identified as concealing revenue or falsely increasing costs and triggering compliance risks.

When signing the agency import agreement, the specific amount of agency service fee, the scope of advance payments, and the liable party for various taxes and fees in the import link shall be clearly stipulated. Clear written agreements can be used as valid supporting materials during the verification by tax authority and customs, to avoid the situation that no valid proof can be provided when disputes arise, which leads to the requirement of supplementary tax payment or even fines.

Meanwhile, the division rule for relevant liabilities caused by wrong tax declaration shall be clearly stipulated in the agreement, to avoid unnecessary legal disputes and reduce potential losses of the enterprise.

According to the overall scale of the enterprise's agency import business, the business structure can be optimized, and the agency service business can be accounted for independently. Enterprises that meet the conditions for small low-profit enterprises can enjoy corresponding corporate income tax preferential policies, and those that meet the conditions for small-scale taxpayers can enjoy value-added tax reduction and exemption policies, effectively reducing the overall tax burden of the enterprise.

Meanwhile, the enterprise can sort out the tax cost corresponding to different business modes, and select the more favorable settlement method for the enterprise combined with customers' demands, balancing compliance and overall cost benefit, to improve the profit margin of the business.

If the enterprise also carries out export tax refund related business, the revenue obtained from agency import shall be independently accounted for separately from the business revenue and cost corresponding to export tax refund, to ensure that the four-party consistency required by export tax refund verification will not be affected by chaotic accounting of import business, so as to avoid the situation that export tax refund verification via letter fails due to unclear accounting of import business revenue, which will affect the normal processing of export tax refund, occupy the enterprise's cash flow for a long time, or even lead to failure to obtain tax refund, causing direct economic losses to the enterprise.
