I am a small and medium-sized manufacturer of household goods in the Pearl River Delta. We used to supply goods only to domestic traders, and received several direct orders from Southeast Asia at the beginning of this year. The buyers require us to export directly.

Our factory does not have self-operated export qualifications, nor have we hired a professional foreign trade team. I heard from friends before that we can find an agent to handle export operations, but now I can't figure out what export agency services exactly mean. Is it equivalent to domestic sales if we sell the goods to the agent?

Will they deduct our tax refund? Who owns the title of the goods if something goes wrong? I just want to figure out the exact definition of export agency services, see if a small factory like ours can use this service, and whether there are any hidden risks.

The core definition of export agency services is that service providers with legal export qualifications accept the entrustment of cargo owners who do not have export qualifications or do not want to handle export operations on their own,and handle the full set of export procedures such as export customs declaration, foreign exchange settlement, tax refund and other processes on their behalf. The title of the goods always belongs to the entrusting party throughout the process, and the service provider only charges the agreed agency service fee, which is essentially different from "buyout export" where goods are directly sold to traders.

Under the traditional model, small and medium-sized factories can only adopt buyout export when receiving overseas orders, selling goods to traders at low prices, all the proceeds from export tax refunds are fully taken by traders, and factories also lose direct control over overseas customers, making follow-up orders easily intercepted. If you apply for export qualifications on your own,you need to maintain a professional team every year, and the labor cost alone will increase by more than 100,000 yuan per year, which is very uneconomical for small and medium-sized factories with unstable order volumes.

Under the export agency model, factories can retain the ownership of goods and control over customers, and also enjoy the full proceeds of export tax refunds. Service providers can help factories obtain an additional 0.5%-2% of extra revenue through centralized exchange rate difference optimization, and can also apply for VAT deferment according to the order situation, reducing the capital occupation of port of destination taxes and fees.

The access threshold for export agency is very low. As long as the goods are compliant and the corresponding value-added tax invoices can be provided, the operation can be carried out. The service provider can dynamically calculate the revenue according to your order volume scale. In most cases, after deducting the agency service fee,the revenue you get is 8%-15% higher than that of buyout export, and you do not need to bear additional operational compliance risks.

In export agency, the header of all customs declaration documents will show the agent as the operating unit and the entrusting party as the production unit/consignee. The declaration logic of the customs system is fully compliant, and there will be no valuation abnormality caused by double-header declaration. If the entrusting party has the demand for the application of certificate of origin, the agent can cooperate to issue relevant materials with corresponding headers to meet the origin verification requirements of the port of destination customs.

For cross-port export business requiring integrated customs clearance, the agent has the qualification of national port linkage, can complete document pre-review in advance, eliminate declaration logic errors, avoid document deletion and re-declaration caused by inconsistent declaration, and incur additional port detention costs. All declaration data will be archived and saved to meet the file transfer requirements of subsequent customs verification.

Under the export agency model, the responsibility of the tax subject is clear. As the owner of the goods, the entrusting party can normally enjoy the corresponding tax preferences for export. The agent is only responsible for handling the declaration process related to tax refund, and will not intercept the tax refund proceeds.

For entrusting parties engaged in cross-border e-commerce B2B direct export, the VAT deferment scheme can be adapted according to the destination country of goods export, so there is no need to advance the import VAT of the destination country at the time of export, reducing the capital occupation cycle and lowering the capital turnover cost. For entrusting parties with cross-border related transactions, we can assist in completing reasonable pricing arrangements, avoid tax risks related to base erosion and profit shifting, and maintain the compliance of the tax structure.

Under the export agency model, foreign exchange settlement can be handled by the agent on behalf of the entrusting party. The agent has legal qualifications for receiving and paying foreign exchange, can connect with the CIPS RMB cross-border payment system, and can also handle foreign currency settlement.

The foreign exchange settlement exchange rate can be operated at the most favorable time for the entrusting party to reduce exchange rate difference losses. All foreign exchange settlement processes fully comply with the compliance requirements of the State Administration of Foreign Exchange.

Each foreign exchange receipt corresponds to real export customs declaration data, so there will be no abnormal foreign exchange settlement, and will not affect the subsequent tax refund operations. For entrusting parties who need to receive and pay foreign exchange on their own, we can also cooperate to provide corresponding documents to meet the verification requirements of the State Administration of Foreign Exchange, ensuring that the entire process is compliant and risk-free.

Standard entrustment agency agreements will be signed for export agency services, clarifying the ownership of goods and agreeing on the boundary of responsibilities of both parties. The entrusting party always owns the ownership of the goods throughout the process, and the agent is only entrusted to handle export procedures and has no right to dispose of the goods.

For common letter of credit clauses in export business, we can assist in reviewing the clause content, identify potential soft clause risks, and prepare response plans in advance. If there are abnormal situations such as refusal to pick up goods at the port of destination, we can cooperate with the entrusting party to prepare legal documents related to the transfer of goods ownership, assist the entrusting party in disposing of the goods, and protect the legitimate rights and interests of the entrusting party.

The tax refund subject of export agency services is the entrusting party, and the tax refund funds will be directly transferred to the corporate account of the entrusting party. The agent does not touch the tax refund funds, and is only responsible for handling document sorting and declaration processes throughout the process.

The agency operation will strictly sort and file all documents in accordance with the requirements of consistency of four streams, and the cargo flow, capital flow, invoice flow and contract flow corresponding to each export are fully matched, meeting the requirements of letter verification from tax authorities, and there will be no tax refund failure caused by non-standard documents. For common problems such as cross-month declaration and pre-declaration verification, pre-review will be completed in advance to eliminate errors and ensure smooth tax refund process, and tax refund can be completed and credited to the account within three months after customs declaration at the earliest.

Export agency services can adapt to different trade term conversion schemes according to the order scale, cargo characteristics and delivery requirements of the entrusting party, helping the entrusting party control logistics costs and lock in profit margins.

For entrusting parties with long-term and stable shipments, export agency services can be incorporated into the overall supply chain planning, linking the whole process of customs declaration, logistics and tax refund, reducing communication costs and operation costs at each node, dynamically optimizing the cost structure, and improving the overall profit margin. For entrusting parties with large order fluctuations, the agency scheme can be adjusted flexibly without long-term fixed investment, adapting to export needs at different stages.

Export agency services can simultaneously handle international logistics related procedures on behalf of customers, can connect with major global shipping companies and airlines, obtain more advantageous freight space prices, and avoid the risk of space shortage and container dumping in peak seasons. If there is a demand for port change, transshipment, etc., the manifest change can be completed quickly, and the transportation route can be adjusted, reducing unnecessary demurrage charges and port detention expenses.

For cargo ownership control, the bill of lading with corresponding header can be issued according to the requirements of the entrusting party, and cooperate with operations such as bill of lading endorsement and transfer, ensuring that the process of cargo ownership transfer is clear and controllable, meeting the needs of different transaction scenarios.
