I run a production factory for home storage products in the Jiangsu-Zhejiang-Shanghai region and have been doing export business for nearly 7 years. Previously, I always used the self-operated export mode. In the past two years, the proportion of small-batch scattered orders has risen to 40%, and the cost of maintaining a separate customs declaration and tax refund team is too high.

So I plan to find an import and export agent to undertake the full-process export services for these scattered orders. Now the most tangled issue is whether foreign customers should transfer the payment to my own corporate account or the agent company's account. If I choose the agent, I'm afraid of encountering irregular companies that hold funds or misappropriate them.

If I choose my own account, I'm worried it won't meet the 2026 foreign exchange regulatory requirements, affecting subsequent export tax refund declarations and even leading to tax inspections. I want to ask which party is more reliable to receive payments and what core dimensions should be considered?

First,we need to correct a common misunderstanding in the industry: many factories think receiving payments directly into their own accounts is safer, completely ignoring the requirement of consistency among the four flows under the agent export mode. Unauthorized self-collection of foreign exchange can easily trigger regulatory warnings. The latest 2026 SAFE (State Administration of Foreign Exchange) regulatory rules require that the customs declaration entity and foreign exchange collection entity for agent export business must be consistent. Otherwise, the tax refund application will be directly rejected. In serious cases,it may trigger tax correspondence investigations,SAFE administrative penalties, and even affect the normal operation of all subsequent import and export businesses of the enterprise.

If your scattered orders take tax refund as the core demand, priority should be given to choosing a compliant agent as the foreign exchange collection entity. As long as you clearly stipulate the clause "transfer within 2 working days after foreign exchange arrives" in the agent agreement in advance, you can completely avoid the risk of capital occupation. The foreign exchange collection accounts of formal agents are under real-time supervision by SAFE,so there is no room for misappropriating funds.

If your orders do not need to apply for export tax refunds, you can choose to collect foreign exchange by yourself, but you must upload the agent agreement to the Foreign Exchange Digital Supervision Platform for filing 3 working days in advance, clearly marking "entrustor collects foreign exchange by itself" to avoid being judged as abnormal foreign exchange collection. In addition, note that you cannot apply for tax refunds with the agent customs declaration form under the self-collection mode, just make cost calculations in advance.

If the value of your single shipment exceeds 100,000 US dollars,it is recommended to additionally require the agent to provide real-time SMS reminder service for foreign exchange arrival to further reduce capital risks.

In 2026, the national customs clearance integration system has realized real-time data interaction with the SAFE Digital Supervision Platform. The domestic consignor information on the customs declaration form will be automatically synchronized to the SAFE system. If the foreign exchange collection entity is inconsistent with the domestic consignor, the system will automatically trigger an abnormal warning.

If you choose the entrustor to collect foreign exchange by yourself, you must clearly mark "entrustor collects foreign exchange by itself" in the remarks column of the customs declaration form, and upload the filed agent agreement as an attached document. Otherwise, the customs declaration form will be directly returned and customs clearance cannot be completed.

If you find the inconsistency in the foreign exchange collection entity after completing the customs declaration, you need to submit an application for cancellation and re-declaration before the goods leave the country. Once the goods leave the country, it cannot be modified, and subsequent foreign exchange collection will be directly frozen.

The choice of payment collection entity directly affects the flexibility of cargo rights control. If you choose the agent to collect foreign exchange, it is recommended to mark the bill of lading consignee directly as the agent, and then endorse and transfer it to the customer designated by the entrustor after the foreign exchange arrives to avoid the risk of delivery without a bill of lading. For orders under FOB terms where the customer designates a freight forwarder, priority should be given to choosing the agent to collect foreign exchange.

As long as the agent holds the original bill of lading, even if the customer's designated freight forwarder operates in violation of regulations, the payment security can be guaranteed by withholding the bill of lading. If you choose the entrustor to collect foreign exchange by yourself, you should agree on the bill of lading endorsement rules with the freight forwarder in advance to avoid the situation where the cargo rights are transferred but the payment has not arrived.

From the perspective of tax costs, the comprehensive tax burden of choosing the agent to collect foreign exchange is lower. After the agent collects the foreign exchange, it can directly convert the payment into RMB and pay it to the entrustor.

The entrustor only needs to issue a VAT special invoice of the corresponding amount to apply for tax refund, without additional foreign exchange declaration or input deduction adjustment. If you choose the entrustor to collect foreign exchange by yourself, you need to declare and pay VAT as domestic sales income, and cannot enjoy the export tax refund policy.

The comprehensive tax burden will increase by 3%-9%, and the specific ratio corresponds to the export tax rebate rate of different commodities. If the commodity is applicable to a 0% tax rebate rate, the tax burden difference between the two collection modes is not significant, and you can choose according to your own needs.

In 2026, the scope of application of CIPS cross-border RMB settlement has covered more than 180 countries and regions around the world. Choosing the agent to collect foreign exchange can enjoy the CIPS settlement exchange rate discount of the agent. The exchange rate is 0.5‰-1‰ higher than that of the entrustor going to the bank to settle foreign exchange by themselves.

For a single order of 100,000 US dollars, you can earn an extra 500-1000 RMB. In addition, the agent has a special team responsible for SWIFT message verification, which can quickly identify fraud risks such as fake remittances and stop-payment messages to avoid payment losses. If you choose to collect foreign exchange by yourself, you should open the cross-border remittance early warning service at the bank in advance, and verify the initiating bank's qualification before confirming the entry after receiving the message.

When signing the agent agreement, you should clearly stipulate the rights and responsibilities clauses related to payment collection. If you choose the agent to collect foreign exchange, you should clearly specify the transfer time limit after arrival and the penalty rate for overdue transfer in the agreement. It is recommended to stipulate that "if overdue for more than 3 working days, a penalty of 0.05% per day will be paid", and at the same time require the agent to provide an equivalent bank guarantee as capital security.

If you choose the entrustor to collect foreign exchange by yourself, you should clearly define the responsibility division of customs declaration and foreign exchange collection in the agreement to avoid the situation where the entrustor bears the customs declaration violation responsibility due to foreign exchange collection issues. In addition, note that any collection mode should retain complete transaction documents and keep them for at least 5 years for inspection.

If the actual value of the goods deviates from the declared value by more than 5% during on-site inspection, the declared value of the customs declaration form will be directly adjusted, and the foreign exchange collection quota of SAFE will be updated synchronously. If you choose the agent to collect foreign exchange, the agent will receive the inspection adjustment notice immediately and inform the entrustor to adjust the collection amount to avoid the situation where the actual collection does not match the declared value of the customs declaration.

If you choose the entrustor to collect foreign exchange by yourself, you should agree on the notification time limit of inspection adjustment with the agent in advance, and inform the foreign customer to adjust the remittance amount within 24 hours after receiving the adjustment notice, otherwise there will be insufficient collection quota and the funds cannot be credited. In addition, if the goods are sent for inspection, the collection quota will be temporarily frozen until the test results are issued, so you should make capital arrangements in advance.

If the exported goods are dangerous goods, the choice of the collection entity should be bound to the division of packaging responsibilities. If you choose the agent to collect foreign exchange, you can require the agent to be responsible for the verification and declaration of UN dangerous goods packaging. Once the goods are detained or returned due to unqualified packaging, the agent should bear the corresponding payment loss.

If you choose the entrustor to collect foreign exchange by yourself, you should bear all losses caused by unqualified packaging, including port detention fees, return freight, customer liquidated damages, etc. In 2026, the inspection rate of customs on dangerous goods packaging has increased to 30%. It is recommended to give priority to choosing the agent to collect foreign exchange for dangerous goods export orders, binding the risk responsibilities of both parties to reduce their own loss risks.

Export tax refund requires complete consistency among the four flows: goods flow, capital flow, invoice flow, and customs declaration flow. Under the mode of choosing the agent to collect foreign exchange, the agent acts as the customs declaration entity and collection entity, and the entrustor issues a VAT special invoice to the agent. The four flows are completely matched, and the tax refund pass rate is 100%. Usually, the tax refund can be obtained within 3-5 working days after the goods leave the country.

If you choose the entrustor to collect foreign exchange by yourself, the capital flow is inconsistent with the customs declaration flow and collection entity, which cannot meet the requirement of four-flow consistency, so you cannot apply for export tax refund. Even if you have filed in advance, you can only enjoy the tax exemption policy and cannot get the tax refund. If you have collected foreign exchange by yourself and want to apply for tax refund, you need to return the payment to the original path and re-transfer it to the agent. The process takes at least 15 working days and will incur additional remittance fees.

From the perspective of long-term supply chain planning, if the proportion of your agent export orders exceeds 30%, you should give priority to choosing a fixed agent to collect foreign exchange. After accumulating collection data, you can apply to the bank for a lower financing interest rate, which can be up to 2 percentage points lower than the trade financing interest rate of ordinary enterprises.

In addition, under the mode of agent collection, you can entrust the agent to be responsible for the entire link of logistics, customs declaration, collection, and tax refund. The overall operating cost can be reduced by 15%-20%, and the efficiency is more than 40% higher than that of handling the entire process by yourself. If your agent export orders are all temporary scattered orders with a proportion of less than 10%, you can choose to collect foreign exchange by yourself without additional agent collection service fees, and the comprehensive cost is lower.
