I am a seller engaged in cross-border supply of small home goods. I just started my business this year, the value of each shipment is not high, and I ship about 2 to 3 containers per month. The process of handling export tax refund on my own is too cumbersome, so I found a small agent introduced by a friend.

Recently I heard that many non-compliant export agents cannot handle tax refunds at all, and will also be audited by the tax authority. My batch of goods is ready to be shipped next week, and I am very panicked now. I don't know if the agent I found can handle tax refund normally, nor do I know what situations will lead to failure to get tax refund after using an agent.

If I cannot get the tax refund, I will directly lose money on this batch of goods. I want to figure out whether export agency can get tax refund at all, and how I should operate in my situation to successfully get the tax refund.

Many export sellers have misunderstandings, believing that as long as they hire an export agent, they will definitely get tax refund,or that export agency itself cannot handle tax refund. Both are common wrong perceptions in the industry. Whether an export agency can handle tax refund depends on whether the consignor's goods and qualifications meet the tax refund requirements, and whether the agent's operations are compliant, rather than the agency model itself being unable to handle tax refund. As long as the tax refund conditions are met,a compliant export agency can not only handle tax refund, but also help sellers simplify processes and improve tax refund efficiency.

The most common misunderstanding in the industry is unqualified small agents using others' tax refund qualifications. Once this operation is detected by the tax authority during audit,it will not only directly freeze the tax refund process, but also mark the consignor's export information as abnormal. Subsequent self-operated exports will also be subject to continuous key verification, and in serious cases,it will also affect the qualifications for foreign exchange receipt, payment and customs clearance, even lead to cargo detention and port detention, generating high detention fees and order liquidated damages, and the chain reaction will eat up the profit of the entire batch of goods.

To isolate such risks, first of all,you should confirm the agent's practical tax refund qualification before cooperation, and request the agent to provide tax refund completion receipts for the past three months. Do not choose agents whose tax refund quotation is much lower than the normal market price,to avoid the other party taking non-compliant paths to cut costs.

Secondly, complete the pre-audit of core documents before shipment, require the agent to check the consistency of information on the purchase invoice, customs declaration form and foreign exchange receipt voucher, and confirm the matching of four flows. If the goods themselves are within the tax exemption scope,or do not meet the tax refund conditions, you can make a compliant tax exemption declaration in advance,to avoid risks brought by non-compliant operations. For goods that have been handed over to non-compliant agents for operation, you should request to delete the declaration and re-declare as soon as possible, switch to a compliant model for re-declaration,block the risk transmission in time, and avoid more serious penalties later.

The premise of export agency tax refund is accurate filling of customs declaration information. If the filling of the operating unit and consignor on the customs declaration form does not meet the requirements, it will directly lead to failure to get tax refund. Under the export agency model, the operating unit should be filled with the agent enterprise with tax refund qualification, the consignor should be filled with the actual consignor, and the information of product name, quantity and cargo value must be completely consistent with the purchase invoice and contract. Once there is a filling error, you need to delete the declaration and re-declare in time.

If you fail to modify it after the declaration period, you will directly lose the tax refund qualification. If you encounter a valuation dispute, you should provide the purchase contract and payment voucher in time to prove the cargo value, to avoid incorrect cargo value verification affecting the tax refund amount, or even directly failing the tax refund review. Under the integrated customs clearance model, customs declaration information of all ports across the country is shared, and any abnormality at one port will be connected to all ports, so the filling link must be done correctly at one time.

Export agency tax refund requires the consistency between logistics documents and customs declaration information. The consignor, cargo name, container number and seal number on the bill of lading must completely match the information on the customs declaration form. In case of port change or container replacement, you need to notify the agent to modify the customs declaration information and re-synchronize the documents in time, otherwise you will be unable to get tax refund due to inconsistent documents.

For transshipment goods, you should keep the full logistics waybill, not only provide the bill of lading of the last leg. The full logistics documents are required to prove the authenticity of the cargo flow during the tax authority's letter verification. For re-stowage after container rollover, you should replace the new bill of lading in time, to avoid inconsistency between the container number on the bill of lading and the customs declaration form leading to failure of tax refund verification. In addition, you should confirm the free storage period and the bearer of detention charges with the agent in advance, to avoid additional logistics costs caused by tax refund delay.

Export agency tax refund involves cross-border tax structure adjustment, and the tax refund subject varies under different entrustment models. If the consignor is a small-scale taxpayer, it can only enjoy the tax exemption policy and cannot handle tax refund, which is not the problem of the export agent, but the subject qualification itself does not meet the requirements. If you are a general taxpayer, you can handle tax refund compliantly through the agent, and you can also combine VAT deferral to optimize capital occupation and reduce the comprehensive tax cost of exports.

Note that the pricing of cross-border related party transactions must comply with the arm's length principle, and the cargo value cannot be declared too low or too high, otherwise it will trigger anti-tax avoidance verification by the tax authority, leading to suspension of tax refund. If a non-resident enterprise entrusts export, it should prepay the withholding tax for non-resident enterprises in advance, and complete the tax payment certificate before handling tax refund normally, to avoid process jams.

Export tax refund requires that the foreign exchange receipt information must match the export cargo value. For exports through agents, the foreign exchange receipt should go through the agent's compliant settlement account, or complete the foreign exchange receipt declaration in accordance with the compliant path. Private accounts cannot be used to receive foreign exchange, otherwise you will be unable to get tax refund due to non-compliant foreign exchange receipt.

The full message of foreign exchange receipt through CIPS RMB cross-border payment should be retained, and the counterparty and cargo value information cannot be missing. SWIFT messages should be fully retained, and need to be provided as foreign exchange receipt vouchers during letter verification.

If you receive foreign exchange through an offshore account, you should complete the foreign exchange receipt declaration in accordance with the requirements of the foreign exchange administration, to ensure the compliance of the foreign exchange receipt path, and avoid tax refund being rejected due to non-compliant foreign exchange receipt and payment. The foreign exchange settlement and account reconciliation should be checked separately for each shipment, and multiple shipments cannot be mixed, otherwise it will lead to inconsistency of the four flows and affect the tax refund.

A formal agency agreement should be signed before cooperation with export agents, to clarify the tax refund subject, payment time of tax refund funds, and responsibility division for tax refund failure, to avoid situations where the agent withholds the funds after getting the tax refund, or the two parties shirk responsibilities to each other after tax refund failure. You should clarify the avoidance of soft clauses of the letter of credit, and the payee of the letter of credit should be consistent with the tax refund subject.

Inconsistency between the payee and the tax refund subject will lead to inconsistent documents and failure to get tax refund. If you need to handle cargo right transfer, you should clarify in the agreement that the cargo right transfer does not affect the qualification of the tax refund subject, and keep the complete documents of cargo right transfer for tax authority verification. You should also agree on the force majeure clause in advance, such as the responsibility division for failure to get tax refund caused by policy adjustment, to avoid subsequent legal disputes.

If the goods under export agency encounter on-site inspection, you should provide cargo materials consistent with the declaration information in time, including the brand, specification, quantity and cargo value of the goods, to ensure consistency with the information on the customs declaration form and purchase invoice. If the inspection finds that the goods do not match the declaration, it will directly lead to tax refund failure. The seal information should be consistent with the one filled on the customs declaration form.

If the seal is damaged, you should ask the customs to replace it with a new seal in time, and update the customs declaration information synchronously, to avoid suspicion caused by inconsistent seal information. When sending samples for inspection and identification, you should provide the real composition and specification of the goods, and cannot provide false materials. False identification reports will directly lead to tax refund being rejected, and will also leave a violation record.

If you handle export agency tax refund for dangerous goods or special goods, the packaging compliance documents should be consistent with the declaration information, the information on the MSDS must match the actual composition of the goods, and the UN number of dangerous goods packaging should be correctly filled on the customs declaration form, otherwise it will lead to customs clearance failure due to non-compliant packaging, and thus cannot handle tax refund. The dangerous goods classification identification report should be within the validity period, and expired identification reports cannot be used as declaration vouchers, which will directly lead to failure of tax refund verification.

You should keep relevant vouchers for special packaging schemes such as moisture-proof and reinforcement. If the goods are damaged during transportation due to packaging problems, the issued insurance claim materials should also be retained, for the tax authority to verify the authenticity of the cargo flow, to avoid affecting the tax refund.

Export agency tax refund needs to meet the requirement of four-flow consistency, that is, consistency of cargo flow, capital flow, invoice flow and contract flow. Mismatch in any link will lead to failure to get tax refund. During tax letter verification, you should provide complete document filing materials in time, including purchase contract, agency agreement, customs declaration form, bill of lading, and foreign exchange receipt voucher.

No material can be missing, and the tax refund application will be directly rejected if you do not reply to the letter verification twice. There should be no capital backflow, that is, the supplier cannot transfer the payment back to the private account.

Once capital backflow is found, it will be directly identified as tax fraud, you will not be able to get tax refund and will also be punished. For cross-month declaration, you should pay attention to the declaration deadline. If you declare after the deadline, you will lose the tax refund qualification and can only make tax exemption declaration.

The actual income of export agency tax refund can be combined with supply chain structure optimization. According to different export cargo volumes and frequencies, you can choose a suitable agency model.

For large cargo volumes, you can apply for centralized declaration on a monthly basis, and for small cargo volumes, you can apply for combined declaration, to reduce the operation cost of the agent and improve the efficiency of tax refund. You can adjust the foreign exchange receipt time according to exchange rate changes, and combine exchange differences to optimize the actual income of tax refund.

The choice of trade terms will also affect the tax refund. Under FOB and CIF models, the declaration requirements for freight and insurance premiums are different. You should choose appropriate trade terms according to the tax refund requirements, optimize the tax refund amount, and avoid reduction of tax refund amount or even failure to get tax refund caused by incorrect filling of trade terms.
