I am a small and medium-sized merchant engaged in cross-border e-commerce export of home goods in the Yangtze River Delta. Last month, I entrusted an agent company to export a batch of outdoor storage cabinets worth 280,000 euros to Germany. After the goods arrived at the port, the buyer maliciously refused to pay the full amount on the grounds of slight scratches on the packaging.

Now the agent says that normal foreign exchange settlement is not possible. I not only cannot get the export tax refund of nearly 120,000 RMB, but also have to advance the previous logistics and customs declaration fees. Last week, the State Administration of Foreign Exchange (SAFE) sent me a regulatory warning notice for non-settlement.

I am worried that this will affect my subsequent export qualification. I am so anxious that I can't sleep. I want to know how to handle this situation compliantly, so that I can recover losses as much as possible without leaving a regulatory stain?

Your current core issues are the superposition of three types: non-settlement accounts receivable, regulatory warnings, and tax refund losses. First, you need to trace back the source loopholes, verify the actual basis for the buyer's refusal to pay immediately, and simultaneously retrieve the customs declaration form, packing list,pre-shipment quality inspection report, and logistics arrival certificate retained by the agent. Confirm whether the so-called "quality problem" meets the refusal standards agreed in the contract,or if it is the buyer's malicious price pressure or capital chain breakage.

Priority should be given to handling regulatory warning risks. You can entrust the agent to submit complete trade background documents and communication records with the buyer to the SAFE to apply for differential settlement filing. As long as the materials are true and valid, the warning record can be eliminated within 3 working days, which will not affect subsequent export qualifications and customs declaration priority.

If the goods are still at the destination port and not picked up,you can coordinate with the overseas freight forwarder to return the goods or resell them to other interested customers to minimize the loss of goods value. The returned goods can go through the "Duty-Free Channel for Returned Goods" launched in 2026,without paying additional import duties. For tax refund losses,as long as you can submit legal proof materials for inability to receive foreign exchange, you can apply for tax refund under the deemed foreign exchange receipt policy in accordance with the latest export tax refund policy. There is no need to cancel the previous tax refund declaration, and you can get up to the full amount of tax refund.

Before conducting agent exports in the future,it is recommended to purchase export credit insurance in advance and agree on a minimum 30% advance payment clause. In case of refusal to pay,the credit insurance can compensate up to 90% of the goods value loss, avoiding similar risks from the source.

For tax refund applications with non-settlement, first, you need to organize a complete set of trade documents, including agency agreements, customs declaration forms, export invoices, communication records with the buyer, and proof materials of refusal to pay. Upload the corresponding materials in the "Deemed Foreign Exchange Receipt" module of the tax refund declaration system, and note the specific reason for inability to receive foreign exchange. As long as the document logic chain is complete, you can process the tax refund normally without providing additional foreign exchange receipt slips.

If a tax verification letter has been triggered, you need to cooperate with the tax authority to submit the agent's foreign exchange receipt status explanation and trade authenticity supporting materials. The verification letter review can be completed within 15 working days, and there will be no situation where the tax refund is recovered. In addition, please note that according to the latest tax refund policy in 2026, the deemed foreign exchange receipt application for non-settlement must be submitted within 90 days after export. Exceeding the time limit will be regarded as a violation, and you will not only fail to get the tax refund but also be fined 10%-30% of the tax refund amount.

If you choose to return the goods, you need to submit the original export customs declaration form, the overseas buyer's refusal to pay certificate, and the quality inspection explanation (if returning due to quality problems) when declaring the return. Mark "Return due to overseas buyer's refusal to pay" in the remarks column of the customs declaration form. You can apply for the duty-free policy for in-kind compensation goods without consideration, and do not need to pay import duties and value-added tax.

If the previous export customs declaration form has been associated with foreign exchange receipt verification, you need to apply to the customs to modify the foreign exchange receipt association mark of the customs declaration form first to avoid early warnings caused by mismatches between customs declaration data and foreign exchange data. If you choose to resell to other customers, you need to modify the consignee information on the bill of lading, submit the resale agreement to the customs simultaneously, and go through the procedures for modifying the customs declaration form to ensure that the new foreign exchange receipt path matches the customs declaration information and does not trigger a secondary regulatory warning.

When applying for differential settlement filing, the materials to be submitted include trade contracts, agent export agreements, email/instant messaging communication records with the buyer, goods inspection certificates issued by third-party institutions (if it is a quality problem), and a statement of non-receipt of foreign exchange. All materials need to be stamped with the agent company's official seal and scanned and uploaded to the SAFE's digital service platform.

In 2026, the SAFE's intelligent review system will automatically compare the authenticity of the trade background. As long as the materials are logically consistent, the filing can be completed on the same day, which will not affect the enterprise's foreign exchange classification level. If part of the payment is recovered later, the funds can be directly transferred to the agent company's verification account, which will automatically offset the previous differential filing quota, and there is no need to submit the application repeatedly.

If the goods are still in the yard of the destination port, first contact the freight forwarder to apply for an extension of the free detention period. In 2026, the normal free detention period for European basic ports is 7 days. After submitting the refusal to pay certificate, you can apply for an extension of up to 21 days without additional container detention fees and storage fees.

If you choose to resell, you only need to endorse and transfer the bill of lading, no need to transport the goods back to the yard. The consignee change can be completed in as fast as 2 working days without additional logistics costs.

If you choose to return the goods, priority should be given to the return space of the original shipping company. The freight can be about 30% lower than normal booking, and it can directly connect to the original customs declaration data, reducing the time-consuming customs clearance process for return.

If the buyer maliciously refuses to pay, you can submit an arbitration application to the agreed arbitration institution according to the dispute resolution clause in the trade contract. In 2026, arbitration awards between China and the EU can be directly enforced in EU member states without additional judicial recognition procedures.

If there is no arbitration clause in the contract, you can apply to the China Council for the Promotion of International Trade (CCPIT) for a force majeure certificate (if payment is impossible due to policy changes in the buyer's location) as supporting material for deemed foreign exchange receipt. In addition, please note that all communication records with the buyer should be notarized and retained as legal basis for subsequent recovery and regulatory filing. Do not reach a settlement agreement through informal channels privately to avoid the situation of being unable to provide evidence.

When conducting similar business in the future, it is recommended to adjust the trade term from FOB to CIF to grasp the control of logistics. Do not release the bill of lading until the buyer pays the full amount to avoid the situation of inability to receive foreign exchange after the transfer of goods ownership from the source.

In addition, you can classify customers by credit level: customers in high-risk areas require 100% advance payment; customers in medium-risk areas require at least 50% advance payment plus letter of credit settlement; customers in low-risk areas can accept payment against a copy of the bill of lading. If the annual export volume exceeds 5 million euros, you can set up an offshore settlement account to retain part of the profits overseas to hedge against exchange rate fluctuations and foreign exchange receipt risks.

If it is finally confirmed that the payment cannot be recovered, the corresponding loss can be deducted before corporate income tax. The materials to be retained include trade contracts, refusal to pay certificates, recovery records, and documents from the court or arbitration institution (if any). You only need to fill in the asset loss declaration module during the annual corporate income tax final settlement, and there is no need to file with the tax authority in advance.

In addition, if you export through an agent company, do not reach a debt offset agreement with the buyer privately to avoid being identified as capital reflux by the tax authority and triggering the risk of verification for false value-added tax invoices. If there are multiple non-settlement businesses, you can package them uniformly for asset loss write-off to reduce the workload of declaration.
