I am a small and medium-sized merchant engaged in cross-border home goods exports, with an annual export volume of about 3.2 million euros. Previously, our team handled the entire process of customs declaration, tax refund, and foreign exchange settlement by ourselves.

This year, we expanded the business position, leading to a shortage of back-office operation manpower, so we plan to find an agency company to undertake end-to-end export services, including all tax-related declarations and tax refund operations. Last week, a friend in the same business circle told me that some merchants who used non-compliant agencies for tax-related operations were inspected by the tax bureau, and the entrusting party was also fined nearly one million yuan and suspended from export tax refund qualifications for six months.

Now I am very tangled and want to know: are tax-related operations related to agency exports legal? How to judge whether the agency's operations are compliant? If something goes wrong, what legal responsibility will I bear as the entrusting party?

Industry generally has two cognitive misunderstandings: one is that as long as an agency is entrusted, all legal responsibilities for export tax-related operations are borne by the agency, and the entrusting party does not need to ask about operation details, the other is that as long as the tax refund can be obtained, whether the agency's operation process is compliant is irrelevant.

If stepping into these two misunderstandings, subsequent chain risks may be triggered: if the agency has operations such as issuing false input VAT invoices, forging customs declaration documents,or fabricating trade background, the tax bureau will directly characterize this business as tax fraud. First,it will recover the already refunded tax from the entrusting party, and impose a 1 to 5 times the amount of the refunded tax fine. In serious cases, the qualification for export tax refund will be directly canceled, and even the relevant responsible persons will be transferred to judicial organs. The entrusting party's responsibility will not be exempted just because the operation was done by the agency.

To achieve risk isolation, first verify the agency's qualifications before cooperation, confirm that it holds necessary certificates such as the Registration Certificate for Customs Declaration Units and Tax Agency Qualifications. When cooperating, sign a formal agency export agreement, clearly define the division of responsibilities and rights for tax-related operations, and keep copies of all original customs declarations, input invoices, foreign exchange receipts, and transport documents. Check the tax bureau's declared data against the actual business data every month, and do not be a "hands-off manager".

If abnormal operations of the agency are found, suspend all cooperation projects immediately, organize all materials that can prove the authenticity of trade, take the initiative to explain the situation to the competent tax bureau, apply for starting the self-inspection and tax payment process if there is a risk of tax fraud, and minimize subsequent penalties as much as possible. In 2026,the tax bureau's Golden Tax Phase IV system has realized real-time linkage of customs, tax, foreign exchange, and logistics data,so there is no room for evasion of any irregular operations. Only by controlling compliance throughout the process can legal risks be avoided.

Tax-related business of agency exports itself is a legal operation, but the authenticity of information in the customs declaration process is the core premise of compliance. In 2026, the Customs' intelligent price verification system has been fully connected with Golden Tax Phase IV. If the agency modifies the HS code or falsely declares the goods value without permission to inflate the tax refund rate, it will directly trigger dual early warnings: the Customs will launch price verification immediately, and the tax bureau will simultaneously suspend the corresponding batch of tax refund applications.

In serious cases, the entrusting party will be directly included in the abnormal list of export tax refunds. Before the agency declares, check all information on the draft, confirm that the goods name, code, and value are completely consistent with the actual goods and input invoice information before approving the formal declaration, and do not allow the agency to adjust the declaration information at will.

Logistics documents are one of the core vouchers for tax verification. If the agency forged logistics documents such as ocean bills of lading, manifests, and warehouse receipts, it will be directly characterized as fabricating trade background, and subsequent tax-related penalties will be directly associated with the entrusting party. When cooperating, clearly require the agency to provide a complete set of traceable logistics documents, including booking confirmation, original ocean bill of lading, land transport documents, and yard warehousing records.

Every quarter, verify the authenticity of the bill of lading through the corresponding shipping company's official website using the bill number, and do not accept logistics documents provided by the agency without traceability path. If the actual transport route is inconsistent with the declared route, immediately require the agency to issue a statement and keep it for future reference.

The compliance of the capital flow chain in tax-related operations directly determines the division of legal responsibility. Do not allow the agency to touch the capital flow chain of foreign exchange receipt and payment, otherwise it may easily be regarded as capital backflow and suspected of defrauding export tax refunds. All export foreign exchange receipts must directly enter the entrusting party's corporate foreign exchange account; the agency is only responsible for submitting relevant materials for foreign exchange receipt verification, and do not allow the agency to hold the foreign exchange account or collect foreign exchange on behalf of others.

Before input VAT invoices are used for tax refund declaration, verify the authenticity of the invoices and the qualification of the invoice issuer one by one on the VAT Invoice Comprehensive Service Platform. Do not accept third-party invoicing provided by the agency, to avoid bearing criminal responsibility due to false invoicing.

In 2026, the Foreign Exchange Bureau's Digital Foreign Exchange Management Platform has realized real-time data synchronization with the tax bureau system. If the agency uses other customers' foreign exchange receipt quotas to make up for the foreign exchange receipt gap of your export business, it will directly trigger an early warning of abnormal foreign exchange receipt data. The tax bureau will require you to provide genuine foreign exchange receipt vouchers for the corresponding business within a time limit; if you fail to provide them, the already refunded tax will be recovered.

Every month, log in to the Digital Foreign Exchange Management Platform to check the completion of foreign exchange receipts for exported business, confirm the correspondence between the foreign exchange receipt amount, receipt time, and the export customs declaration form. If abnormal data is found, immediately require the agency to provide an explanation, to avoid tax-related risks caused by inconsistent foreign exchange receipts.

When signing an agency export agreement, clearly define the scope of responsibilities and rights for tax-related operations, and do not sign unfair clauses that exempt the agency from liability. The agreement needs to clearly stipulate that if losses such as tax fines or cancellation of tax refund qualifications caused by the agency's operational errors shall be fully compensated by the agency, and at the same time stipulate that the entrusting party has the right to verify all materials related to tax-related operations at any time.

Do not sign authorization clauses that allow the agency to sign tax-related documents on behalf of others; all documents that need to be submitted to the tax bureau and customs must be confirmed by your side before submission, to avoid legal risks caused by the agency submitting false materials without permission.

Customs on-site inspection records will be directly synchronized to the tax bureau system. If the agency intentionally conceals the actual situation of the goods during inspection, leading to inconsistencies between the inspection records and the declared information, the tax bureau will directly characterize it as fabricating the goods name during subsequent inspections, suspected of tax fraud.

After the customs issues an inspection notice, it is best to arrange your own personnel to accompany the inspection on site; if you cannot be present, require the agency to provide full-image materials of the inspection process simultaneously. After receiving the inspection record, immediately check whether it is consistent with the declared information; if there is an error in the record, raise objections on site and apply for reissuing the inspection record, instead of waiting until the tax bureau sends a verification letter to appeal.

In 2026, the export tax refund verification requires the four flows to be completely consistent. If the agency adjusts the correspondence of the four flow data at will, it will directly trigger the tax bureau's letter inquiry process; in serious cases, a case will be filed for inspection.

Before each tax refund declaration, check the correspondence of the four flow data with the agency, confirm that all data are completely matched before submitting the declaration. All tax-related documents shall be kept for at least 10 years in accordance with the tax bureau's requirements, including customs declarations, input VAT invoices, foreign exchange receipts, logistics documents, sales contracts, etc. Do not let the agency keep them alone, to avoid losing documents and being unable to prove compliance.

The choice of trade terms directly affects the calculation of export tax refund amount. If the agency chooses trade terms at will, it will lead to incorrect calculation of the tax refund amount; if there is an over-refund of tax, the tax bureau will require the return and impose a fine; if there is an under-refund of tax, it will cause direct economic losses.

Choose the corresponding trade terms according to the actual situation of your business, and clearly require the agency to declare and calculate tax refunds in accordance with the agreed trade terms. After each tax refund calculation is completed, check the calculation logic of the tax refund amount by yourself, confirm that it is consistent with the amount that should be refunded for the actual business before submitting the declaration, to avoid tax-related risks caused by calculation errors.
