I am a financial specialist at a foreign trade company who has just taken over the accounting work related to agency import business. Last week I processed an agency business of importing mechanical equipment from the European Union. The invoice issued by the counterparty covers agency fee, port sundry charges, tariff paid on behalf of the client, and a port detention fee incurred due to shipping schedule delay.

I checked the old accounts which are all records before 2025, but the policies were updated in 2026, so I am not sure if those old practices are still applicable. Besides, it is said that tax authorities have implemented stricter verification on import expenses now, and I am afraid that non-standard posting will lead to risks such as mandatory account adjustment or fines, hoping to get clear and systematic guidance.

First of all,it shall be clarified that expenses involved in agency import are divided into three categories: agency service fees, customs clearance related taxes and fees, and logistics sundry charges. Different categories correspond to different posting items and compliance requirements, which can be handled in accordance with the following logic combining the latest 2026 cross-border fiscal and taxation policies.

Agency service fees fall into the category of commercial auxiliary services, which shall be recorded in Administration Expenses - Agency Fee or Selling Expenses - Agency Fee. For goods imported for production purposes, corresponding input VAT can be deducted, and it is required that the name of the specific agency import project shall be clearly noted on the invoice.

Tariffs and import VAT belong to tax-related expenditures. Tariffs shall be recorded into the procurement cost of goods, and carried over to inventory goods or fixed assets together with the goods,if import VAT meets the deduction conditions,it can be deducted as input tax. In 2026,Chinese customs has fully implemented electronic tax payment receipts, which requires compliant collection and comparison through the VAT Invoice Comprehensive Service Platform to avoid non-deductibility caused by overdue operation.

For logistics sundry charges such as port sundry fees and port detention fees,if they are directly related to the imported goods, they shall be recorded into the procurement cost,if they are extra expenses incurred due to operation errors of the agent, they can only be recorded after the responsible party undertakes such expenses in accordance with the contract agreement. In 2026,Chinese customs has optimized the electronic process of import documents,it is recommended to keep all expense vouchers for future reference,so as to avoid the situation that no valid supporting documents can be provided during tax document verification.

Special attention shall be paid that the posting of agency import expenses shall maintain the Consistency of Four Flows (contract, invoice, capital flow, goods flow). If there are related party transactions between the entrusting party and the agent, pricing record-filing shall be completed in advance to avoid the risk of tax base erosion. In addition, extra expenses such as port detention fee and port modification fee shall clearly define the division of responsibilities in the contract to avoid disputes during posting.

Declaration of agency import expenses shall be handled in compliance with customs valuation rules. In 2026, the General Administration of Customs upgraded the import expense valuation system, which will focus on verifying whether the agency service fee meets the industry fair standard. If the agency fee stipulated in the contract is higher than the average level of similar businesses in the same period, the customs may initiate a valuation procedure, and require the enterprise to provide pricing basis, cost details and other materials. For extra expenses such as port detention fee and port modification fee, they shall be truthfully declared in the import customs declaration form.

If the expenses are incurred due to reasons of the entrusting party, they shall be marked separately and recorded into the cost of the entrusting party; if the expenses are incurred due to errors of the agent, they shall be undertaken by the agent and shall not be recorded into the cost of imported goods. In addition, for the deduction of customs tax payment receipts, it shall be ensured that the payer name on the receipt is consistent with the name of the agent or the entrusting party. Expenses paid across borders in 2026 need to keep SWIFT messages, payment vouchers and other documents synchronously for customs verification.

Tax-related handling of agency import shall focus on VAT deferral and related party transaction compliance. In 2026, the European Union has implemented new cross-border VAT collection and management rules. If the entrusting party adopts VAT deferral for import, the agency service fee shall be subject to VAT at the applicable domestic tax rate, and shall not enjoy the deferral policy.

For agency import businesses between related parties, pricing shall be made in accordance with the independent transaction principle, and the profit margin of agency service fee shall conform to the industry average level, so as to avoid the situation that the taxable income is adjusted by the tax authority. In addition, the agency fee collected by the agent shall withhold and remit VAT.

If the entrusting party is an overseas enterprise, 10% corporate income tax shall be withheld and remitted in accordance with the provisions of non-resident enterprise withholding tax. Cross-border payment expenses shall be settled through the CIPS system, and payment vouchers and tax record-filing forms shall be kept to ensure the compliance of the payment route.

Receipt and payment of foreign exchange for agency import shall strictly follow the latest provisions of the State Administration of Foreign Exchange in 2026. First of all, the capital flow of agency import shall be consistent with the contract and invoice. The entrusting party shall pay the goods payment, agency fee, sundry charges and other funds directly to the agent, and then the agent pays to overseas suppliers, direct payment to overseas suppliers by the entrusting party is not allowed.

If offshore accounts are used for settlement, it shall be ensured that the accounts are compliant, and account opening certificates and transaction background documents shall be kept. In 2026, the State Administration of Foreign Exchange optimized the expense declaration function of the CIPS system. All cross-border payment expenses shall be marked with clear purpose during declaration, such as "agency import agency fee", "port sundry charge", to avoid overdue account hanging problems caused by vague declaration. In addition, the selection of foreign exchange settlement rate shall conform to the requirements of accounting standards, and the spot exchange rate on the transaction date or the average exchange rate can be adopted, to avoid the situation that the exchange loss caused by exchange rate fluctuation is not recorded in time.

The terms of agency import contract shall clearly define the expense undertaking and risk division to avoid subsequent disputes. First of all, all expense items including agency fee, port sundry charges, tariff, VAT, port detention fee and other items shall be clearly listed in the contract, and the responsible party and payment method of each expense shall be clarified. For imported goods related to intellectual property rights, the ownership and posting method of patent fee, trademark fee and other expenses shall be clearly specified, to avoid being recognized as royalty by tax authorities and leading to tax adjustment.

In addition, the force majeure clause shall clearly specify which party undertakes extra expenses caused by natural disasters, policy adjustments and other reasons, for example, the division of responsibility for port detention fee caused by epidemic situation shall be stipulated in the contract.
