We are a foreign trade company engaged in cross-border export of small home appliances, and we mainly rely on domestic agency companies to handle procedures including customs declaration, logistics and tax refund. Recently, we have an order to be shipped to Europe, and the overseas customer asked whether they can remit the payment directly to our own offshore account, or must send it to the account of the agency company.
We once had a small order whose foreign exchange was withheld by the bank due to inconsistency between the receiving account and the customs declaration entity, which also delayed the tax refund, so we are very concerned about similar problems occurring again. We want to know who the legal payment recipient is, as well as the specific operation procedures and compliance requirements, to avoid making mistakes again.

According to the 2026 new regulations on cross-border foreign exchange receipt and payment and customs supervision, the payment recipient of agency export business shall strictly follow the "four-stream consistency" principle, and the legal recipient shall be determined in combination with the type of agency agreement, which can be divided into two specific scenarios:
The first is the buyout agency model, where the agency company purchases the ownership of the goods and completes the customs declaration for export. Under the 2026 new cross-border foreign exchange receipt and payment supervision regulations, the payment recipient must match the operating entity indicated on the customs declaration. The payment shall be uniformly remitted to the compliant foreign exchange receiving account of the agency company. The agency company shall transfer the fund to the entrusting party's account after foreign exchange settlement, and issue the agency export goods certificate for the entrusting party to handle tax refund.
The second is the intermediary agency model, where the agency company only provides services such as customs declaration and logistics, and the ownership of the goods remains with the entrusting party. For intermediary agency, the entrusting party shall complete the customs entrustment filing in advance before receiving foreign exchange directly. The entrusting party shall submit the agency agreement and qualification certification to the competent customs authority in advance, and after passing the examination, the entrusting party can directly receive the payment from the overseas customer, provided that the receiving account is consistent with the filing entity of the entrusting party.
In case of abnormality caused by inconsistent payment recipient, you shall submit materials such as agency agreement and situation explanation to the customs for document modification and re-declaration within 3 working days,to avoid risks of port detention or customs clearance hold. Retaining a full set of documents for tax letter verification and inspection is the core of avoiding tax refund risks. Documents including agency agreement, customs declaration form, foreign exchange receipt voucher, bill of lading shall be retained and filed as required,to cooperate with the subsequent four-stream consistency inspection by the tax authority.
In addition, the cross-border RMB settlement facilitation policy launched in 2026 can help the entrusting party receive foreign exchange directly under the intermediary agency model without transfer through the agency company, further shortening the fund return cycle, but the account filing in the Cross-border Interbank Payment System (CIPS) shall be completed in advance.

In agency export business, the operating entity indicated on the customs declaration form must be consistent with the foreign exchange receiving entity, which is one of the core inspection points of customs document examination in 2026. If the buyout agency model is adopted, the operating entity is the agency company, so the payment shall be remitted to the account of the agency company. If the payment is forcibly remitted to the entrusting party's account, it will trigger a document examination warning, leading to temporary detention of the customs declaration form, or even requiring document deletion and re-declaration.
If the intermediary agency model is adopted, the entrusted agency filing shall be completed through the single window of customs in advance. After the filing is approved, the operating entity can be indicated as the entrusting party, and the entrusting party can receive the payment directly. It should be noted that the filing information must be completely consistent with the terms of the agency agreement, including the agency term, scope of goods, etc., otherwise it cannot pass the examination. In addition, for multi-batch agency export, separate filing for each batch or annual agency agreement filing application is required, to avoid inconsistency between filing information and actual business.

In the international logistics link, the consignee information on the bill of lading shall correspond to the foreign exchange receiving entity, which is the core point of cargo right control. In the buyout agency model, the consignee on the bill of lading is usually the agency company or its designated party, and the payment shall be remitted by the overseas customer to the account of the agency company. The agency company completes the cargo right handover with the overseas customer by virtue of the bill of lading.
If the intermediary agency model is adopted, the consignee on the bill of lading can be directly indicated as the entrusting party or its designated party, and the overseas customer can directly remit the payment to the account of the entrusting party, but the change procedure of the bill of lading title shall be confirmed with the freight forwarding company in advance, to avoid cargo right disputes caused by inconsistency between bill of lading information and foreign exchange receiving entity. In addition, the electronic bill of lading filing system launched in 2026 can realize real-time linkage between bill of lading information and foreign exchange receiving accounts. If there is information inconsistency, the system will automatically issue an early warning, and adjustment shall be made in time before arranging shipment.

One of the core requirements for export tax refund is that the foreign exchange receipt voucher is completely matched with the information of the customs declaration form and agency agreement. The letter verification system of the tax authority in 2026 will automatically compare the consistency between the foreign exchange receiving entity and the operating entity.
In the buyout agency model, after the agency company receives the payment, it shall issue the agency export goods certificate to the entrusting party, and the entrusting party shall handle the tax refund with this certificate and the foreign exchange receipt voucher. At this time, the collection of agency fees shall comply with the arm's length principle, to avoid being identified as related party transactions leading to BEPS risks.
In the intermediary agency model, after the entrusting party receives the foreign exchange directly, it shall retain the foreign exchange receipt voucher and agency agreement as the fund flow certificate for tax refund. If cross-border related party transactions are involved, pricing filing shall be completed in advance to meet the requirements of OECD BEPS action plan.

The compliance of cross-border foreign exchange receipt and payment is the core risk point of agency export business. In 2026, the SWIFT message and CIPS system will automatically compare the information of the foreign exchange receiving entity and the customs declaration operating entity.
If the buyout agency model is adopted, the agency company shall use its own foreign exchange receiving account to receive the payment, and transfer it to the entrusting party after foreign exchange settlement, with the remark "agency export payment transfer" in the transfer, to avoid being identified as unknown fund transaction by the bank. If the intermediary agency model is adopted, the entrusting party shall use the account that has completed cross-border settlement filing to receive the payment, and the amount of foreign exchange received shall be completely consistent with the FOB amount on the customs declaration form.
If there are commissions or other fees, they shall be collected in a separate account to avoid mixing with the payment. In addition, the compliance status of the foreign exchange receiving account shall be checked regularly to avoid affecting the payment return due to account freezing or restriction.

The terms of the agency export agreement shall clarify the foreign exchange receiving entity and the division of rights and responsibilities, which is the core of avoiding legal risks. The agreement shall specify whether it is a buyout or intermediary agency. If it is an intermediary agency, it shall be clarified that the entrusting party has the right to receive the payment directly, and the agency company shall cooperate in completing customs filing and document issuance.
If the overseas customer refuses to remit the payment to the designated account, it shall be handled in accordance with the dispute resolution terms in the agreement, usually through arbitration or litigation. In addition, attention shall be paid to the compliance of letter of credit terms. If letter of credit settlement is adopted, the beneficiary of the letter of credit shall be consistent with the foreign exchange receiving entity, to avoid soft clauses leading to failure of normal foreign exchange receipt.

In the on-site customs inspection link, the consistency between the customs declaration information of the goods and the foreign exchange receiving entity will be checked. If it is found that the customs declaration operating entity is inconsistent with the foreign exchange receiving entity, the agency agreement and situation explanation will be required. In the buyout agency model, the name or code of the agency company shall be marked on the outer packaging of the goods.
If it is an intermediary agency, the name or code of the entrusting party shall be marked, to avoid inspection delay caused by inconsistent marking. In addition, for release after inspection, the information of the foreign exchange receipt voucher shall be consistent with the information of the inspection form, otherwise it will affect the subsequent tax refund process. It should be noted that the customs inspection system in 2026 will automatically compare the information of the foreign exchange receiving entity, and if the filing is completed in advance, the probability of inspection can be reduced.

The four-stream consistency inspection for export tax refund includes contract flow, cargo flow, fund flow and document flow, among which the core of fund flow is the consistency between the foreign exchange receiving entity and the operating entity. In the buyout agency model, the main body of the fund flow is the agency company.
It shall be ensured that the foreign exchange receipt voucher of the agency company is consistent with the operating entity on the customs declaration form, and the voucher transferred to the entrusting party shall clearly indicate the agency export payment. In the intermediary agency model, the main body of the fund flow is the entrusting party.
It shall be ensured that the foreign exchange receipt voucher of the entrusting party is consistent with the operating entity on the customs declaration form, and the agency agreement shall be retained as the proof of the fund flow. In addition, the tax refund pre-inspection system launched by the tax authority in 2026 can compare the information of the foreign exchange receiving entity and the operating entity in advance. If there is any inconsistency, adjustment can be made in time to avoid rejection after formal declaration.

The supply chain structure of agency export shall be optimized in combination with the needs of the foreign exchange receiving entity. The cross-border supply chain integration service in 2026 can help enterprises choose the most appropriate agency model. If the entrusting party wants to receive foreign exchange directly, the intermediary agency model can be adopted, and customs filing and CIPS account filing can be completed in advance to shorten the fund return cycle.
If the entrusting party wants to simplify the operation process, the buyout agency model can be adopted, and the agency company will uniformly handle foreign exchange receipt and tax refund matters, reducing the compliance cost of the enterprise. In addition, the appropriate settlement currency shall be selected in combination with exchange rate fluctuations. If RMB settlement is adopted, exchange rate risks can be avoided, and the cross-border RMB settlement subsidy policy launched in 2026 can be enjoyed at the same time.
