I'm the owner of a small factory producing consumer electronics. Recently, I received several orders from Southeast Asia, but I don't have import and export rights, so I want to cooperate with an export agency company. However, I heard that foreign trade policies will change in 2026. I don't know what conditions I need to meet when looking for an export agency company.
For example, what materials does our factory need to provide? What qualifications must the agency company have? Also, regarding tax refunds, what conditions do we need to meet to get them? I heard from a peer that choosing the wrong agency led to cargo detention at the port and a lot of container detention fees deducted. I'm particularly afraid of this situation, so I want to figure out all necessary conditions to avoid pitfalls.

The core conditions for export agency cooperation in 2026 can be broken down from two dimensions: "qualification matching between both parties + full-link compliance implementation".
First, the necessary qualifications for the agency company: must hold Customs AEO Advanced Certification (in 2026,the customs will raise the credit rating requirements for agency enterprises, general certification will no longer meet the needs of cross-border e-commerce orders),agency foreign exchange collection and payment qualifications filed with the State Administration of Foreign Exchange, and export tax refund agency qualification (must complete filing registration with the tax department). In addition,if the order involves RCEP member countries, the agency company must have the right to self-issue certificates of origin (in 2026,the electronic coverage rate of RCEP certificates of origin will reach 95%,without self-issuing rights, tariff preferences cannot be enjoyed).
Second, the conditions that the principal (factory) needs to meet: 1. Provide a true and valid business license (the business scope must include production/sale of related products) and product testing reports (such as 3C,CE,etc。according to the requirements of the destination country),2. Ensure "consistency of four flows" — contract flow (sign a formal agency agreement with the agency company),capital flow (payment is collected and paid through the agency company, avoiding third-party account transfers),invoice flow (issue special VAT invoices to the agency company),and cargo flow (transport documents such as bills of lading are consistent with the goods),3. If tax refund is involved, complete the electronic port filing of the export goods declaration form, and the foreign exchange collection time shall not exceed 180 days after the export date on the declaration form (in 2026,the State Taxation Administration will extend the foreign exchange collection period to 180 days, which was previously 90 days).
Regarding emergency plans: If customs inspection is encountered, prepare materials such as product manuals and copies of packing lists in advance,if a letter of inquiry occurs during tax refund declaration, cooperate with the agency company to provide raw material purchase invoices, production records, etc。to avoid tax refund delays due to incomplete information.
Finally, note that starting from 2026,the export agency contract must clearly specify the "cargo ownership transfer node" (e.g。under FOB terms, the cargo ownership is transferred to the agency company after the goods cross the ship's rail) to avoid losses due to cargo ownership disputes.

The core conditions for export agency involving customs declaration links: First, the agency company must have a "Customs Declaration Unit Registration Certificate" (required by the General Administration of Customs in 2026; the certificate needs to be verified every 2 years; if not verified after expiration, the customs declaration authority will be suspended). Second, the principal needs to provide accurate commodity codes (HS codes).
In 2026, the customs will refine HS codes to 10 digits; if the code is wrong, it will lead to price review disputes or an increase in inspection rate by more than 30%. In addition, the "transaction method" on the customs declaration form must be consistent with the trade contract (e.g., CIF must include details of freight and insurance premiums), otherwise it will affect foreign exchange verification. If it involves RCEP member countries, the "RCEP Certificate of Origin Number" must be filled in the remarks column of the customs declaration form, otherwise tariff reduction cannot be enjoyed.

The agency conditions for the logistics link include: The agency company must have "international freight forwarding qualifications" (in 2026, it is required to provide a Non-Vessel Operating Common Carrier (NVOCC) filing certificate) and have stable cooperation with the destination port agent (to avoid container dropping or port change). The principal needs to clarify the "transportation requirements" of the goods (e.g., dangerous goods need to provide a UN packaging identification report), and confirm the "free storage period" (in 2026, the free storage period at Shanghai Port will be shortened from 7 days to 5 days; overstay will incur container detention fees).
In addition, the bill of lading must be endorsed by the agency company before being delivered to the consignee; if the principal endorses it by himself, it will lead to loss of cargo ownership control. For cold chain goods, temperature monitoring records must be provided (in 2026, the customs requires full-process temperature data to be traceable), otherwise customs clearance will not be possible.

Agency conditions in terms of taxation: The agency company must complete "export tax refund agency filing" with the tax department (in 2026, the filing needs to provide no tax penalty records in the past 3 years). The principal must be a general VAT taxpayer (small-scale taxpayers cannot enjoy export tax refunds; the policy will not be adjusted in 2026), and the exported goods must be "commodities allowed to be exported by the state" (if prohibited export commodities are involved, the agency company shall not undertake them).
In addition, the "VAT deferral" policy will be implemented in 2026; the agency company needs to assist the principal in completing the deferral declaration (need to provide cargo transport documents, customs declaration forms, etc.) to avoid occupying funds due to early payment of VAT. If the principal has behaviors such as "false invoicing", the agency company needs to bear joint tax liability, so it is necessary to review the authenticity of the principal's invoices in advance.

Agency conditions for foreign exchange settlement: The agency company must have "foreign exchange agency collection and payment qualifications" (in 2026, it is required to provide the "Agency Collection and Payment Filing Form" from the State Administration of Foreign Exchange) and handle cross-border collection and payment through the CIPS system (to avoid exchange rate fluctuations in the SWIFT system). The principal needs to provide real trade background materials (such as order contracts, bills of lading); if the source of funds is unknown, it will lead to the "large-value transaction report" by the State Administration of Foreign Exchange, affecting subsequent collection and payment.
In addition, in 2026, the State Administration of Foreign Exchange requires that the "matching rate between collection and payment under trade items and customs declaration forms reaches 100%"; if the matching rate is insufficient, the agency company will be suspended from collection and payment authority. For offshore account collection and payment, a "source explanation of offshore account funds" must be provided to avoid being identified as a "money laundering risk".

Agency conditions at the legal level: The agency company must sign a "formal export agency agreement" with the principal (in 2026, the agreement must include "cargo ownership transfer clause", "risk-bearing clause", and "tax refund liability clause") to avoid disputes caused by oral agreements. In addition, the agreement must clearly specify the "force majeure clause" (e.g., port strikes in some Southeast Asian countries in 2026; the division of responsibilities must be clear).
If intellectual property rights are involved, the principal needs to provide "trademark/patent authorization certificates"; otherwise, the agency company will bear legal responsibility for "export of infringing goods". In addition, the agency company must have "international trade dispute handling capabilities" (e.g., resolving disputes through arbitration); in 2026, it is required that the agency company provide no dispute records in the past 3 years.

Agency conditions for on-site inspection: The agency company must arrange an "on-site customs declarer" (in 2026, the declarer must hold a "Customs Inspection Response Qualification Certificate") and prepare an "inspection data package" in advance (including product manuals, packing lists, testing reports, etc.). If the goods involve "sensitive commodities" (such as chips for electronic products), a "source certificate of imported chips" must be provided (in 2026, the customs inspection rate for chip commodities will increase to 40%).
In addition, during inspection, it is necessary to cooperate with the customs for "container unpacking inspection"; if the goods packaging is damaged, a "packaging inspection report" must be provided (in 2026, the packaging must meet UN standards). If the inspection finds that the goods are inconsistent with the declaration, the agency company must submit a "situation explanation" within 3 working days; otherwise, the goods will be detained.

Agency conditions for packaging compliance: If the goods are dangerous goods, the agency company must have "dangerous goods packaging identification qualifications" (in 2026, it is required to provide a UN packaging design certificate) and paste "dangerous goods labels" on the packaging (such as explosives, flammable goods, etc.). If the goods are fragile, a "buffer packaging test report" must be provided (in 2026, the test drop height is required to be 1.2 meters) to avoid damage during transportation.
In addition, if the goods involve "wooden packaging", a "fumigation certificate" must be provided (in 2026, the fumigation treatment must meet IPPC standards); otherwise, the destination port customs will detain the goods. For cold chain goods, a "packaging insulation test report" must be provided (in 2026, the insulation time is required to be no less than 72 hours).

Agency conditions for tax refund audit: The agency company must have "export tax refund audit qualifications" (in 2026, it is required to provide an audit certificate from a tax firm) and establish a "tax refund document filing system" (in 2026, document filing must be electronic, with a retention period of 10 years). The principal needs to provide materials with "consistency of four flows" (contracts, invoices, bills of lading, foreign exchange collection vouchers); if the four flows are inconsistent, it will lead to tax letter inquiries (the letter inquiry rate will increase to 25% in 2026).
In addition, in 2026, tax refund declaration must be completed within 30 days after the export date on the customs declaration form (previously 60 days); if the declaration is delayed, the tax refund amount will be reduced by 10%. If the principal has an "uncollected foreign exchange" situation, the agency company needs to assist in handling "delayed foreign exchange collection filing" (need to provide order contracts and bank collection records).

Agency conditions at the supply chain level: The agency company must have a "global supply chain network" (in 2026, it is required to cover major RCEP member countries) and provide "cost optimization solutions" (e.g., choosing a transit port to reduce freight; in 2026, the transit port for Southeast Asian routes will be changed from Singapore to Haiphong, Vietnam, which can reduce freight by 15%). The principal needs to clarify the "delivery date" (in 2026, the delivery date error is required to be no more than 3 days; otherwise, it will lead to customer claims) and establish an "inventory linkage mechanism" (e.g., the agency company notifies stock preparation 10 days in advance).
In addition, the agency company must have "trade term conversion capabilities" (e.g., converting FOB to CIF, which requires calculating freight and insurance premiums); in 2026, trade terms must comply with the INCOTERMS 2020 standard. If cross-border e-commerce orders are involved, the agency company must have "overseas warehouse services" (in 2026, the overseas warehouse coverage rate is required to reach 80%) to avoid order delays.
