I am the head of finance at a cross-border e-commerce export enterprise. We recently cooperated with a local export agency for a batch of goods shipped to Southeast Asia, and I am completely confused after receiving the VAT invoice for the agency fee. Our company used to handle customs declaration independently, and this is our first time dealing with tax treatment of agency service fees.

We do not know what taxes are applicable to this fee, whether the input tax can be deducted, and whether we need to withhold and pay taxes if we cooperate with overseas agency institutions in the future. In addition, the agency fee is paid in two installments: 30% deposit first, and the balance after shipment.

How should we grasp the time node for tax declaration? Also, regarding the four-flow consistency requirement mentioned by peers, do our agency contract, payment voucher, invoice and service process have to correspond one by one? Will there be tax risks if we fail to meet this requirement?

First, clarify the basic taxes applicable to export agency fees: Domestic agency services belong to brokerage agency services under the modern service industry subject to VAT. General taxpayers are subject to a 6% VAT rate, and small-scale taxpayers can continue to enjoy the preferential policy of paying VAT at a reduced levy rate of 1% in 2026. If the agency service occurs entirely overseas (such as agency operations at overseas destination ports),you can enjoy the VAT exemption policy and do not need to accrue output tax.

Tax Base shall be the total price and additional fees collected, and costs shall not be deducted at will unless the differential taxation filing has been completed (for example, agency customs declaration services can deduct the customs taxes collected and paid on behalf of others). In practice, the subject of the agency service shall be distinguished: The agency service fee independently selected by the seller does not need to be included in the dutiable value of the goods, but if the third-party agent is designated by the buyer, the service fee shall be included in the dutiable value of the goods for declaration.

Input Deduction Rules: After an enterprise obtains the special VAT invoice for agency service fees,if the fee is used for taxable export business, the input tax can be deducted normally,if it is used for tax-exempt or simplified taxation items,it cannot be deducted. Note that if the agency fee is invoiced together with the cargo transportation fee,the tax authority will not be able to accurately divide the deduction ratio,so the invoice shall be issued with separate items.

If the agency fee is paid to an overseas agency, the domestic payer shall withhold and pay VAT (at a rate of 6%) and corporate income tax (at a rate of 10%,if the overseas institution has not established an office or place of business in China),and complete the tax declaration and payment within 7 days from the date of withholding. At the same time, the withholding and payment tax payment vouchers, agency contracts and other materials shall be kept for future reference.

Four-Flow Consistency Requirement shall be strictly implemented: The agency contract,VAT invoice, fund payment voucher and service execution record shall correspond one by one to avoid abnormalities during tax letter investigation. The time when the tax obligation arises is the day when the agency fee is received or the voucher for claiming the sales payment is obtained. For installment payments, the revenue shall be confirmed and declared separately according to the nodes, and shall not be delayed or advanced.

In addition,if the enterprise enjoys the export tax rebate policy, the input tax deduction of the agency fee shall match the tax rebate rate of the exported goods: If the exported goods are subject to a 13% tax rebate rate, the input tax of the agency fee can be deducted in full,if the applicable tax rebate rate is 9% or 6%,the non-deductible input tax shall be divided proportionally to avoid tax early warning.

Tax compliance for export agency fees shall be judged in combination with the customs valuation logic. Some enterprises are prone to confusion about whether the agency fee is included in the dutiable value of goods.

According to the latest revised *Measures for the Examination and Determination of Dutiable Value of Import and Export Goods* by the General Administration of Customs in 2026, if the agency fee is the commission and brokerage fee borne by the buyer other than the purchase commission, it shall be included in the dutiable value of the goods, but if it is the export agency service fee paid by the seller on its own, it shall not be included in the dutiable value. In practice, the subject of the agency service shall be distinguished: If the agency is a third party designated by the buyer, its service fee shall be included in the dutiable value; if the agent is independently selected by the seller and the service fee is accounted for separately, it does not need to be included.

At the same time, the agency contract shall specify the service scope, charging standard and payment subject to avoid being identified as an undeclared additional price-related fee during customs valuation. In addition, the invoice title of the agency fee shall be consistent with the business unit on the customs declaration form, otherwise it will affect the subsequent tax rebate declaration process.

Some enterprises will issue a combined invoice for agency service fees, customs declaration fees and port miscellaneous fees, which makes it impossible to accurately divide the fees during customs valuation. It is recommended to list each fee separately and clearly note the service content.

If cross-border agency business is involved, the location of service occurrence shall be filed with the customs in advance to ensure the accuracy of dutiable value declaration and avoid late declaration fees or tax payment after valuation.

Tax declaration for export agency fees shall be accurately matched with logistics nodes. Many enterprises have the problem of confusing declaration of agency fees and logistics fees. In 2026, international logistics rates fluctuate frequently, and some enterprises issue combined invoices for sea freight, port miscellaneous fees and agency fees, leading to failure in tax review.

In practice, the agency fee shall be invoiced as a separate item, with clear notes on the content of the agency service (such as booking, customs declaration, trailer service, etc.). At the same time, if the agency service involves cross-border logistics links, the location of service occurrence shall be confirmed: If the agency service is fully completed domestically, VAT shall be declared as domestic service; if part of the service is performed overseas (such as overseas destination port agency), you can apply for tax exemption as a cross-border taxable activity.

Additional fees such as free detention period and container detention fee shall be distinguished from agency fees and accounted for separately, to avoid being recognized as additional price-related fees and incorporated into the agency fee for tax calculation by the tax authority.

In addition, enterprises shall keep logistics bills of lading, agency service confirmation forms and other materials to prove the actual occurrence of the agency fee, so as to avoid the tax authority questioning the authenticity of the service. If multimodal transport business is involved, the cost attribution of each link shall be clarified to ensure the accuracy of tax declaration.

Tax planning for export agency fees shall be combined with cross-border structure optimization. For related party agency situations, special attention shall be paid to BEPS risks. The latest OECD BEPS 2.0 rules have been implemented in most countries in 2026.

If a domestic enterprise signs an agency agreement with an overseas related party, it shall ensure that the pricing of the agency fee complies with the arm's length principle, that is, it is consistent with the charging standard of non-related third parties. In practice, contemporaneous documents can be prepared to prove the rationality of pricing, so as to avoid the tax authority adjusting the taxable income. In addition, if the enterprise enjoys the export tax rebate policy, the input tax deduction of the agency fee shall match the tax rebate rate of the export business: If the exported goods are subject to a 13% tax rebate rate, the input tax of the agency fee can be deducted in full; if the applicable tax rebate rate is 9% or 6%, the non-deductible input tax shall be divided proportionally.

Some enterprises will pay agency service fees through offshore companies, and shall pay attention to the compliance of cross-border payment and receipt of foreign exchange to avoid being identified as tax evasion.

At the same time, if an enterprise obtains an invoice issued by an overseas agency, it shall confirm the compliance of the invoice to meet the requirements of the Chinese tax authority, otherwise the input tax cannot be deducted. In addition, the withholding and payment of taxes shall be declared in time to avoid late fees and fines.

Compliance of foreign exchange receipt and payment for export agency fees is an important prerequisite for tax declaration. Some enterprises have tax early warnings due to the inconsistency between the amount of foreign exchange received/paid and the agency fee amount.

According to the latest regulations of the State Administration of Foreign Exchange in 2026, enterprises shall pay agency service fees through banks or the CIPS system, and shall not pay in cash or through third-party accounts. At the same time, the amount of foreign exchange received and paid shall be consistent with the amount specified in the agency contract and invoice.

If there is a difference, reasonable explanation materials shall be provided. In addition, enterprises shall keep foreign exchange receipt and payment vouchers, agency contracts and other materials to prove the actual occurrence of the service fee.

If cross-border agency business is involved, it shall be confirmed whether the foreign exchange receipt and payment for agency services comply with foreign exchange administration regulations to avoid the situation of being unable to settle foreign exchange.

Some enterprises will pay agency service fees through offshore accounts, and shall file with the foreign exchange administration department in advance to ensure compliance. In addition, tax filing for outward payment shall be handled in time to avoid being unable to make outward payment due to failure to file.

The compliance of export agency fees shall be clarified through contract clauses. Some enterprises have tax disputes due to unclear contract clauses. The agency contract shall specify the service scope, charging standard, payment method, subject of tax obligation and other contents to avoid disputes.

At the same time, the contract shall stipulate the issuing time, type and title of the invoice to ensure that it meets the requirements of the tax authority. In addition, if related party agency is involved, the pricing principle shall be specified in the contract to comply with the arm's length principle and avoid adjustment by the tax authority.

Some enterprises will sign exclusive agency agreements, and shall pay attention to whether the tax clauses in the agreement are compliant to avoid tax risks. In addition, the contract change records shall be kept.

If the contract content is changed, the tax declaration materials shall be updated in time. In case of tax disputes, professional lawyers shall be consulted in time and relevant materials shall be prepared for response.

The authenticity of export agency fees shall be verified through the on-site inspection link. Some enterprises fail to pass the inspection because they cannot provide service execution records. During on-site customs inspection, enterprises will be required to provide relevant materials of agency services, such as service confirmation forms, operation records, etc., to prove the actual occurrence of the agency fee.

If the enterprise cannot provide relevant materials, it will be recognized as issuing false invoices and face tax penalties. In addition, during inspection, it shall be noted whether the packaging and identification of the goods are consistent with the content of the agency service, so as to avoid the inconsistency between goods and documents.

Some enterprises will combine agency service fees with goods packaging fees, and shall pay attention to the tax treatment of packaging fees: Packaging fees belong to logistics auxiliary services, with a tax rate of 6%, and shall be invoiced as a separate item.

If dangerous goods packaging is involved, UN packaging certification shall be provided to ensure the compliance of packaging fees. In addition, payment vouchers and invoices for packaging fees shall be kept to prove the actual occurrence of the fees.

Export agency fees are highly correlated with export tax rebates. Some enterprises have their tax rebate progress affected due to improper tax handling of agency fees. According to the latest regulations of the State Taxation Administration in 2026, the invoices of agency service fees obtained by export enterprises shall meet the requirements of tax rebate document filing, and materials such as invoices, contracts and payment vouchers shall be kept. At the same time, the input tax deduction of the agency fee shall match the tax rebate rate of the exported goods.

If the deduction ratio does not meet the requirements, the tax rebate review will fail. In addition, attention shall be paid to the declaration time of the agency fee, which shall be consistent with the tax rebate declaration time of the exported goods, so as to avoid cross-period declaration.

Some enterprises will deduct agency service fees as the cost of export tax rebates. It shall be noted that agency service fees shall not be deducted repeatedly, and the deducted input tax shall be adjusted when declaring tax rebates.

In addition, if cross-border agency business is involved, the tax payment voucher of the overseas agency shall be provided to prove that the tax has been withheld and paid, otherwise the tax rebate policy cannot be enjoyed. At the same time, tax letter investigation shall be handled in time to avoid delay in tax rebate.

Cost control of export agency fees shall be combined with supply chain structure optimization. Some enterprises have increased costs due to unreasonable planning of agency services. The international logistics market is highly competitive in 2026, and enterprises can reduce agency fee costs by integrating agency service resources.

At the same time, by selecting appropriate agency institutions, optimizing service processes and improving efficiency, agency costs can be reduced. In addition, the payment time of agency fees shall be reasonably planned to make use of the time value of funds and reduce the financial cost of enterprises.

Some enterprises will choose the mode combining self-operated customs declaration and agency services, and shall reasonably divide various fees to ensure the accuracy of tax declaration.

At the same time, attention shall be paid to the impact of international exchange rate fluctuations on agency fee costs, and exchange rate risk hedging tools shall be used to reduce exchange rate risks. In addition, appropriate agency service modes shall be selected in combination with the export scale of the enterprise to avoid excessive costs or insufficient services.
