Talk to a Trade Expert

I am the operation director of a foreign trade enterprise. We plan to change the name of the export agency we have cooperated with for 3 years, and currently have no clue about the process at all.

We previously heard that name change may affect the title of customs declaration forms, tax refund account information, and even lead to blockage of bank foreign exchange receipt and payment. Last week, we heard from peers that one of their shipments was detained after their agency completed name change.

Now we have to fulfill year-end export orders on schedule, while worrying about errors in the name change process. We want to know the specific steps to follow, key notes for each link, and whether we can smoothly connect all previous businesses.

The name change of an export agency shall be promoted following the full process of "pre-change of industrial and commercial registration - multi-department filing connection - full business chain adjustment",with the core of ensuring information consistency across all cross-border business nodes.

First, complete the name change of the industrial and commercial entity. After obtaining the new business license, you shall handle the change of filing for consignors and consignees of import and export goods with the customs,as well as the directory filing with the foreign exchange administration within 15 working days, which is the foundation for all subsequent businesses. It is necessary to focus on verifying that the unified social credit code filed with the customs fully matches the information on the new business license,to avoid declaration rejection caused by inconsistent customs declaration information.

Second, connect the logistics and foreign exchange receipt and payment links. You need to update the agency name on bill of lading endorsements and bank foreign exchange collection account information, inform overseas customers of the new payment path simultaneously, and mark the name change instruction in SWIFT messages to prevent interception by the banking system. For issued but unsettled bills of lading, contact the freight forwarder to handle bill of lading endorsement correction to avoid cargo right disputes.

Finally, complete the adjustment of tax and tax refund filing. Bring the new business license and customs change receipt to the competent tax authority to update export tax refund filing information, and sort out customs declaration forms and foreign exchange receipt vouchers of the past 3 months to complete the four-stream consistency verification,to avoid abnormal tax correspondence and verification. For batches that have been declared but not yet granted tax refund, you need to submit a name change explanation to the tax authority in advance to ensure the tax refund process is not affected.

It is recommended to reserve a 20-working-day buffer period for the whole process, and connect with offline windows of the customs and tax authorities in advance to complete pre-audit,to avoid business stagnation caused by delayed information synchronization of the online system.

After the export agency changes its name, the core of customs filing is to ensure that the consignor and consignee information fully matches the information on the customs declaration form. You need to bring the new business license and official seal to the local customs to handle filing change, submit the Registration Form of Customs Declaration Entities on site, and simultaneously update the unified social credit code associated with the customs registration code.

If the agency has previously handled integrated customs clearance filing, you need to simultaneously update the filing information of all national ports to avoid information verification failure during cross-port customs declaration. For declared customs declaration forms that have not been concluded, you can contact the on-site customs staff to handle document detail correction, without deleting the form for re-declaration.
