I work for an outdoor furniture factory in Guangzhou. We just obtained the self-operated export right this year. Previously, we only sold goods to domestic traders for export, and now we want to directly take orders from overseas customers, so we plan to find an export agency to handle procedures including customs clearance, tax refund and foreign exchange settlement for us.

We consulted several agencies, and the quotation difference is nearly double. Some claim that they can cover all channels, but they even do not understand the latest RCEP certificate of origin rules.

I am afraid that choosing the wrong agency will affect on-time shipment, we cannot afford losses from customs detention and port demurrage, and we also worry about tax refund problems leading to pending accounts and unrecoverable funds. I would like to ask how to find a reliable and suitable export agency, and whether there are specific screening standards for reference?

There are three most common misunderstandings in the industry when looking for export agencies: only focusing on quotation level while ignoring qualifications, believing verbal promises without verifying practical operation experience, and only paying attention to single-link services while neglecting full-chain risk control. Many small agencies will quote prices below cost to attract customers for order grabbing, and then make profits by charging various additional fees after receiving orders. What is worse, they have no compliant qualifications and operate under the name of other affiliated companies, and will directly shirk responsibilities once problems occur.

The chain risks caused by such irregular agencies are far more than extra charges: operating under affiliated names will lead to failure of tax refund verification, and tax refund funds will be temporarily withheld by tax authorities. In serious cases,it will be identified as illegal tax refund, which affects the factory's own export qualification. Non-standard customs declaration will lead to customs detention and inspection of goods, resulting in port demurrage fees and container unpacking fees. Missing the customer's delivery date will also require payment of liquidated damages, and even lose overseas customers that have cooperated for many years.

The core method to physically isolate risks is to verify the independent operation qualifications of the agency, require the other party to provide import and export operation right filing, customs declaration qualification and tax registration qualification, and confirm that all qualifications are held by the agency itself rather than affiliated to other institutions. Secondly, check the average tax refund disbursement time in the past year to confirm the agency's tax refund operation capability and avoid long-term pending accounts.

Finally, the exclusive loss mitigation tip is that when signing the entrusted agency agreement, clearly stipulate the collection standards of various additional fees,as well as the responsibility division and compensation clauses after problems such as customs detention and tax refund failure occur,so as to lock risks at the contract level and avoid the situation of no way to safeguard rights after problems occur. In the screening process, priority is given to institutions covering full-chain services, and do not make blind decisions only based on quotations.

When verifying the customs declaration qualification of an export agency, it is necessary to confirm whether it has customs integration operation authority and filing qualification of the corresponding export port. Some small agencies are only filed in a single port, and cross-port operations require secondary order transfer, which is prone to errors and omissions in declaration information during the transfer process, leading to price review disputes. If export goods involve pre-classification and pre-valuation, you need to require the agency to provide past processing records of similar goods to confirm its mastery of classification rules.

For goods that need to enjoy preferential tariffs under trade agreements, confirm whether the agency can accurately issue certificates of origin that meet the requirements, so as to avoid trade disputes caused by irregular filling of certificates of origin, which leads to overseas customers being unable to clear customs and enjoy preferences. When there are errors and omissions in customs declaration information that require deletion and re-submission of declarations, formal institutions can complete the modification operation within 1 to 3 working days without affecting goods shipment, while small agencies often need more than a week, which seriously delays the shipping schedule.

It is necessary to confirm the qualifications of logistics suppliers that the export agency cooperates with, as well as its operation experience in different routes. For export of full-container large goods, confirm whether the agency can lock shipping space in advance to avoid space shortage and container rejection in peak seasons. If port change or transshipment is required, confirm whether the agency can directly connect with shipping companies to modify bill of lading information, instead of transmitting information through multiple layers of intermediaries, which will lead to information errors and omissions and make goods unable to transship normally.

At the same time, confirm whether the agency can help apply for reasonable free storage period and free container period, so as to avoid high container detention fees and port demurrage fees caused by cargo inspection or customs clearance delay. For full-container goods, confirm that the agency can provide full cargo right tracking service, and you can query the location and status of goods at any time, so as to avoid cargo right out of control.

The tax operation capability of export agencies directly affects comprehensive costs, especially for exports to the European Union and Southeast Asia, it is necessary to confirm whether the agency can operate VAT deferment to help revitalize cash flow and reduce capital occupation. If export goods involve cross-border related transactions, confirm that the agency can set reasonable prices that meet relevant BEPS requirements, so as to avoid transfer pricing investigation by tax authorities.

At the same time, confirm that the agency can carry out tax risk isolation, and will not involve its own tax risks in the export business of the entrusting party. For different export modes, the agency can sort out tax costs under different modes, help select the optimal export scheme, reduce unnecessary tax expenditure, and ensure that all operations meet current tax supervision requirements.

Compliance of payment and collection in export links is a core risk point. It is necessary to confirm whether the export agency supports CIPS RMB cross-border payment and compliant processing of SWIFT messages, so as to avoid abnormal payment and collection being monitored by the State Administration of Foreign Exchange. Confirm that the agency can help carry out foreign exchange settlement and hedging according to real-time exchange rates, optimize the exchange rate of foreign exchange purchase and settlement, and reduce foreign exchange losses.

If customers need to settle through offshore accounts, confirm that the agency has compliant offshore account operation experience, can help complete compliant declaration of payment and collection, and avoid the situation of pending accounts and inability to settle foreign exchange. All payment and collection operations must correspond to export goods information, meet the supervision requirement of "who exports, who collects foreign exchange", and avoid compliance risks caused by inconsistency between the payment and collection subject and the export subject.

When signing the export agency agreement, it is necessary to clearly stipulate the rights and obligations of both parties, especially the two core parts: cargo ownership and responsibility division. It is necessary to check whether there are hidden unreasonable clauses in the agency agreement, such as requiring the entrusting party to bear all responsibilities for customs clearance and inspection, or vague clauses for arbitrarily charging additional fees.

For export orders paid by letter of credit, the agency can help review soft clauses of the letter of credit to avoid inability to collect foreign exchange caused by soft clauses. If goods need to be filed for intellectual property customs protection, the agency can assist in completing the filing process to avoid goods being implicated and detained by counterfeit and infringing goods. In case of trade disputes, the agreement should clearly stipulate the dispute resolution method and jurisdiction to guarantee legitimate rights protection.

One of the core demands for looking for an export agency is to successfully obtain export tax refund. It is necessary to confirm that the agency can achieve "consistency of four streams", that is, contract stream, goods stream, fund stream and invoice stream are fully matched, meeting the verification requirements of tax authorities. Confirm that the agency has a perfect document filing management system, which can help sort out and retain all documents required for tax refund, and can quickly provide complete materials when responding to tax verification, shorten the verification time and speed up tax refund disbursement.

Confirm whether the agency has past records of tax refund violations, and whether it has been included in the key verification list by tax authorities. For cross-year export business, the agency can complete the declaration on time, and will not fail to enjoy tax refund due to missed declaration, resulting in loss of tax refund funds.

It is necessary to select a suitable export agency according to export business volume, shipment frequency and destination. If it is small-batch and multi-batch shipment, choose an agency that can handle LCL operations and connect with multiple sales channels; if it is large-batch full-container annual shipment, choose an agency that can get more favorable logistics prices and handle large amount of tax refunds.

Confirm that the agency can convert trade terms according to needs, such as converting FOB to CIF, to help optimize the overall trade structure and reduce logistics and insurance costs. The agency can help carry out actuarial calculation of export costs, clearly list all costs including customs clearance, logistics, tax refund and foreign exchange settlement, there will be no hidden consumption, and at the same time, it can optimize capital arrangement according to shipment rhythm, reduce capital occupation and improve overall operation efficiency.
