I am a textiles foreign trade salesperson with an annual export volume of around USD 5 million, mainly coordinating with European supermarket clients. Due to exchange rate fluctuations and buyer credit issues over the past two years, I often worry about failing to collect payments.
Recently, there is an order of 300,000 euros for autumn and winter clothing, and the European buyer requires 90-day open account payment. I heard both export factoring and confirmed factoring can solve the open account collection problem, but I can’t tell if they are the same thing.
If I choose the wrong one, I may not only fail to get financing but also get into compliance trouble. Now I want to clarify the specific differences between the two and which one is more suitable for enterprises of our scale. Can you help me sort it out?

Export factoring and confirmed factoring are not completely identical services. Confirmed factoring is a sub-type of export factoring with 100% without-recourse bad debt guarantee. In the 2026 cross-border trade service system, ordinary export factoring usually includes three core services: accounts receivable financing, account collection, and credit risk guarantee (partially with recourse). Confirmed factoring additionally adds the payment guarantee responsibility of the import factor. Even if the buyer goes bankrupt or defaults, the factor must pay on time, completely transferring credit risk.
For your enterprise scenario,an annual export volume of around USD 5 million qualifies as a small and medium-sized foreign trade enterprise. The current bad debt rate in the European market is about 1.2%,and this 300,000-euro order is a large open account order, making confirmed factoring more suitable. 2026 compliance requirements must match CIPS settlement and tax rebate document filing. Confirmed factoring business needs to provide customs declaration forms, bills of lading, commercial invoices, and factoring agreements for filing. Collection must be completed via CIPS or SWIFT marked with "confirmed factoring" for compliance declaration.
Ordinary export factoring usually retains the exporter’s recourse right. If the buyer defaults, recovery can be pursued from your side. However, confirmed factoring completely avoids this risk, but its financing cost is 1.2-1.5 percentage points higher than ordinary factoring. You can calculate based on the order’s profit margin. At the same time, confirmed factoring can also link to the export tax rebate advance payment policy launched in 2026,allowing you to receive tax rebate funds 7 working days in advance and further optimize cash flow.

In the customs declaration process, there are obvious differences in declaration details between export factoring and confirmed factoring. In the "Cross-border Trade Service Document Specifications" updated by the General Administration of Customs in 2026, the collection method on the customs declaration form for ordinary export factoring can be marked as "accounts receivable transfer", with no additional factoring agreement filing required.
Confirmed factoring business needs to mark "confirmed factoring" in the "special trade method" column of the customs declaration form and upload the electronic filing document of the factoring agreement; otherwise, it will trigger a document review alert. If not marked as required, it may cause the customs declaration form to be returned and delay customs clearance progress. In addition, the consignee of the bill of lading under confirmed factoring must be marked as the consignee designated by the factor, while ordinary export factoring can retain the original shipper’s consignee without affecting normal customs clearance of goods.

Logistics operations directly affect the approval pass rate of the two factoring businesses. In the risk control standards updated by Factors Chain International (FCI) in 2026, confirmed factoring business prioritizes goods transported via direct flights.
Orders with more than 1 transit will have their approval pass rate reduced by over 30%. Also, confirmed factoring requires the freight forwarder to send a copy of the bill of lading to the factor within 24 hours after goods are loaded on board, while ordinary export factoring only needs to provide a copy of the bill of lading before financing disbursement.
In case of port change or cargo rejection, the factor under confirmed factoring may require re-submission of cargo transportation track proof, while the adjustment process for ordinary export factoring is more flexible. In addition, the application for free detention period under confirmed factoring must be coordinated by the factor, while ordinary export factoring is handled by the exporter itself.

In terms of tax treatment, the differences between the two factoring businesses mainly lie in the tax recognition of accounts receivable transfer and financing interest deduction. In the "Cross-border Financing Tax Guidelines" issued by the State Taxation Administration in 2026, the accounts receivable transfer under ordinary export factoring is regarded as an ordinary creditor’s right transfer.
The exporter can declare income based on the actual received financing amount, and financing interest can be deducted before enterprise income tax. The accounts receivable transfer under confirmed factoring business is regarded as a "without-recourse creditor’s right transfer".
The exporter must declare income based on the full amount of accounts receivable, and the deduction ratio of financing interest must comply with the pricing requirements of cross-border related party transactions. In addition, confirmed factoring business can apply for the VAT deferral policy, where the importer’s VAT can be delayed until after sales, reducing the exporter’s capital occupation cost.

Cross-border payment and collection compliance is the core difference between the two factoring businesses. In the "Cross-border RMB Settlement Specifications" updated by the State Administration of Foreign Exchange in 2026, the collection for ordinary export factoring can be directly transferred from the buyer to the exporter’s settlement account, only needing to mark "factoring financing" during declaration.
The collection for confirmed factoring business must be transferred from the buyer to the factor’s designated account first, then the factor will transfer the amount after deducting financing fees to the exporter’s account. Meanwhile, the "business code" column of the SWIFT message must be marked with "21 (factoring)" and "40 (confirmed factoring)"; otherwise, it will trigger foreign exchange compliance inspection.
In addition, confirmed factoring business needs to file the factoring agreement number in the CIPS system, while ordinary export factoring does not require this operation. If cross-border payment and collection declaration is not completed as required, the enterprise may be listed as a key foreign exchange supervision target.

Differences in legal clauses are the key to distinguishing between the two factoring businesses. In the updated clauses of the International Factoring Model Law in 2026, ordinary export factoring agreements usually include a recourse clause. If the buyer defaults, the factor has the right to recover the paid financing amount from the exporter.
Confirmed factoring agreements clearly stipulate no recourse, and the factor must bear the buyer’s credit risk on its own. In addition, confirmed factoring agreements usually include an intellectual property verification clause. The factor will require the exporter to provide intellectual property certificates for goods to avoid buyer default due to infringement issues.
Ordinary export factoring only requires the exporter to provide basic trade documents, with no additional intellectual property verification required. If the recourse clause is not clearly stipulated in the confirmed factoring business, it may lead to legal disputes and cause the factor to refuse disbursement.

In the customs on-site inspection process, the focus of response differs between the two factoring businesses. In the 2026 customs inspection specifications, the goods inspection for ordinary export factoring only requires providing conventional trade documents, including invoices, packing lists, and bills of lading.
The goods inspection for confirmed factoring business needs to additionally provide a copy of the factoring agreement and the goods ownership certificate issued by the factor. In case of abnormal machine inspection results, the factor under confirmed factoring will require the inspector to take photos of the seal and goods appearance and send the photos to the factor for review, while ordinary export factoring does not require this operation.
In addition, the goods seal for confirmed factoring business must be affixed by personnel designated by the factor, while ordinary export factoring can be affixed by the exporter or freight forwarder. If relevant documents are not provided as required, it may cause the goods to be detained and delay the inspection progress.

In terms of export tax rebate, there are differences in document filing and tax rebate subjects between the two factoring businesses. In the updated "Export Tax Rebate Document Management Specifications" by the State Taxation Administration in 2026, the tax rebate subject for ordinary export factoring is the exporter, who needs to provide documents such as the factoring agreement, customs declaration form, and payment collection voucher for filing. The tax rebate subject for confirmed factoring business is the factor.
The exporter must transfer the tax rebate documents to the factor, which will handle the tax rebate procedures. In addition, the tax rebate declaration for confirmed factoring business must be completed after the factor receives the full amount, while ordinary export factoring can declare tax rebate in advance after financing disbursement. If tax rebate documents are not filed as required, the tax rebate application may be rejected and delay the arrival of tax rebate funds.
