We are a company that has just transformed into an export foreign trade agency, obtained the agency qualification last year, and currently undertake export agency business for more than ten small and medium-sized manufacturing enterprises. Previously, we only provided customs clearance and logistics support for clients, and this is the first time we need to complete the whole process of tax declarations independently this year, which makes us very uncertain.

Previously, we heard from peers that some companies were inspected by tax authorities due to non-compliant declarations, which delayed the export tax refunds of entrusting enterprises, and took more than half a year to resolve, not only paying late fees to clients, but also losing several long-term cooperative clients. Now we want to figure out, under the latest requirements of 2026, how our export foreign trade agency should correctly and compliantly declare taxes, what preparations need to be made in advance, and what common risks need to be avoided in advance.

The core requirement for tax declarations of export foreign trade agencies is to meet the compliance standard of "consistency of four flows",and the whole process can be divided into four core links:

The first is pre-document verification, which needs to check in advance the four types of documents including the entrusting party's sales contract, export customs declaration form, purchase and sale voucher, and foreign exchange receipt slip, confirm that the value, product name, quantity, and export port of all documents are completely consistent, and eliminate batches with inconsistent document information to avoid subsequent declaration anomalies.

The second is core node coordination. Within the VAT declaration period of the next month after the goods are declared for export, complete the tax-free declaration of exported goods. After the foreign exchange is received, organize the tax refund materials to handle the tax refund declaration. In 2026,all declaration materials need to be uploaded electronically, and electronic signature registration needs to be completed in advance to avoid system review failure.

The third is the exception response plan. If a tax letter investigation is triggered after declaration, complete the complete transaction materials within 3 working days and submit them, cooperate with the tax authority's inspection, and must not hide any transaction details. For batches with delayed foreign exchange receipt, you can first handle the tax-free declaration, and adjust the tax refund declaration after the foreign exchange is received.

The last is compliance implementation. All declaration materials need to be archived and retained for at least 10 years to meet the follow-up inspection requirements of the tax authority. Complete the annual liquidation declaration of export tax refunds for the previous year in January each year, check the consistency of annual export data and declaration data, adjust misdeclarations and omissions in time, and isolate declaration risks from the process.

In the tax declaration link, the declaration information of the export customs declaration form and the tax declaration information need to be checked synchronously. If the value and product name code of the customs declaration form are modified, the tax declaration information needs to be adjusted synchronously in the next month after the customs declaration form is modified, to avoid inconsistency between customs declaration information and tax declaration information.

If cross-port export occurs under the integrated customs clearance mode, it is necessary to confirm whether the export tax refund rate copy of the customs declaration form is issued normally. Some remote ports may have delays in issuance, so the port customs should be urged to issue the documents as soon as possible to avoid delaying the declaration deadline. For goods declared at low prices or with valuation adjustments, the valuation conclusion documents issued by the customs need to be retained and submitted as attached materials to the tax declaration to prove the compliance of the declared value and avoid triggering price abnormal inspection.

For export business of different types of agency clients, different tax declaration methods need to be distinguished: If the agency is for self-export of manufacturing enterprises, only the declaration process needs to be handled by the agency, and the tax refund subject is still the manufacturing enterprise. It is necessary to clearly mark the agency identity when declaring to avoid risks caused by wrong identification of the tax refund subject.

If the agency is for a trading enterprise without export qualification, it needs to declare with itself as the tax refund subject, complete tax registration in advance, clarify the entrustment agency relationship, and retain the agency agreement as reference materials. VAT deferral can be applied for according to business conditions to optimize capital occupation cost and reduce cash flow pressure, but it needs to meet the compliance requirements of offshore business, and must not fabricate transactions to obtain tax refund benefits.

Tax declaration is directly linked to foreign exchange verification. In 2026, all export tax refund businesses must complete foreign exchange receipt before applying for tax refund.

For special circumstances where foreign exchange cannot be received, official documents certifying the inability to receive foreign exchange need to be provided to enjoy the tax refund policy. For businesses using CIPS (Cross-Border Interbank Payment System) RMB cross-border receipts, screenshots of CIPS payment messages need to be retained, and each receipt corresponding to the export batch needs to be clearly marked to avoid mismatch between foreign exchange receipt and export batch, which will lead to failure of tax refund review.

For businesses receiving payments through offshore accounts, registration with the foreign exchange administration needs to be completed in advance, and all offshore income needs to be declared. Offshore funds must not be kept privately without being recorded to avoid compliance risks of foreign exchange receipts and payments and affecting tax declaration results.

For tax declarations of agency export business, the division of responsibilities for tax declaration and tax refund needs to be clearly defined in the entrustment agency agreement, to avoid legal disputes caused by unclear rights and responsibilities after declaration errors. If the entrusting party provides false transaction materials or documents, the agreement shall clearly stipulate that the entrusting party shall bear the responsibility, to avoid the agency company bearing unnecessary penalties.

For businesses requiring tax refunds, the circulation time limit after the tax refund arrives needs to be agreed to avoid legal disputes caused by tax interception. At the same time, the authenticity of the entrusting party's transactions needs to be verified in advance, and the agency must not assist the entrusting party in handling tax declarations for any false export, otherwise it will be recognized as joint illegal and bear joint and several legal liabilities.

Export tax refund declaration is the core link of tax declarations for export foreign trade agencies, and needs to meet the verification requirements of consistency of four flows, namely, the contract flow, goods flow, capital flow, and invoice flow are completely matched. Any mismatch in any link will trigger a tax letter investigation.

Pre-declaration verification needs to be done before declaration, check whether the declaration data is consistent with the customs declaration data in the system, and submit the formal declaration only after the pre-declaration passes, to reduce the probability of formal declaration errors. All declaration documents need to be bound and archived by batch, including agency agreements, customs declaration forms, invoices, foreign exchange receipt slips, and copies of bills of lading.

The retention period shall not be less than 10 years to cope with subsequent tax authority inspections. Annual tax refund liquidation shall be completed every year, and batches of omissions or misdeclarations shall be adjusted in time to avoid accumulating large amounts of tax supplementary or fines.

The declaration structure can be adjusted according to the tax policies of different export markets to reduce the overall tax cost. For export business under FOB terms, the deduction rules for freight and insurance premiums need to be clarified, and overseas freight must not be included in the export value to inflate the tax refund amount, which will lead to declaration errors. For export business under CIF terms, freight and insurance premiums need to be correctly separated from the export value, and tax refunds shall be declared based on the deducted value to meet tax requirements.

Pre-declaration arrangements can be made for long-term stable orders to optimize capital turnover efficiency, lock in the tax refund time in advance, match the capital plan of the supply chain, and reduce capital occupation costs. For different categories of export goods, declare separately according to different tax refund rates, and must not mix low tax refund rate goods with high tax refund rate goods to defraud tax refund benefits.

The actual export information of goods is the basis of tax declarations. If goods are redirected, returned, or resold, the tax declaration information needs to be adjusted in time, and shall not be declared according to the original export information. If goods are shut out, the amended declaration needs to be filed with the tax authority within 30 days after the shut-out is completed, the original tax refund declaration shall be withdrawn, and the refunded tax shall be paid to avoid tax omission risks.

For transit export goods, copies of through bills of lading need to be retained to prove that the goods have actually been exported and departed, as reference materials for tax declarations, to avoid being deemed as not actually exported and having the tax refund qualification cancelled. If goods are damaged or lost, official certificates issued by the carrier need to be provided, tax exemption or declaration shall be handled as required, and the actual situation must not be concealed.

If the exported goods are identified as inconsistent with the declaration in terms of product name, specification, and quantity through on-site inspection, the inspection conclusion documents issued by the customs need to be obtained, and the tax declaration information shall be adjusted in time. The original incorrect information shall not be used to continue the declaration. If classification disputes are found for goods during the inspection process, a timely application for laboratory identification shall be made.

After obtaining the formal classification conclusion, the tax refund rate for tax declarations shall be adjusted according to the correct commodity code, to avoid incorrect application of the tax refund rate due to commodity code errors, either losing benefits due to under-refund or causing compliance risks due to over-refund. After the inspection is completed, all inspection documents and appraisal reports shall be retained and archived as attached materials for tax declarations to cope with subsequent inspections.
