Reliable sourcing and import agency services.
I am engaged in cross-border beauty product trade. Recently, the supplier requires settlement via a Hong Kong company, and I want to use our cooperative Hong Kong agency company to handle import customs declaration to the domestic warehouse. We have always used mainland agencies before and never tried using a Hong Kong company directly for import.
I checked the latest 2026 customs regulations but didn’t understand them clearly. A colleague did this before and had their goods detained due to non-compliant qualifications, leading to over ten days of port detention and tens of thousands of container detention charges.
My current shipment is arriving at Shanghai Port next week, and I am very anxious. I urgently need to confirm whether the Hong Kong agency company can legally conduct imports, what qualifications need to be prepared in advance, and whether there are hidden risks. I hope to get clear answers and actionable operational guidelines

A common industry misconception is that a Hong Kong company can directly serve as a declaration entity for Chinese mainland imports as long as it holds a Hong Kong Business Registration Certificate. This is completely wrong. According to the General Administration of Customs’ 2026 management rules for overseas declaration entities,a Hong Kong company that has not completed domestic customs filing and does not have corresponding import and export operation rights does not have the qualifications to directly act as an import declaration entity
If a Hong Kong agency company is forcibly used as the declaration entity, customs will directly reject the declaration. Subsequent transfer of the goods to another port or re-declaration after deleting the original declaration will take at least 7-10 working days, possibly extended to half a month during peak seasons. This will generate high container detention charges and port detention charges, leave abnormal declaration records, affect the clearance speed of the same batch of goods in the future, and may even be judged as illegal declaration, facing cargo detention penalties
The core method of physical risk isolation is adopting a dual-entity linkage model of "Hong Kong agency + domestic clearing entity". The Hong Kong agency is responsible for overseas cargo pickup and transit storage in Hong Kong, while a qualified third-party domestic agency handles import declaration, tax payment and customs clearance. This not only meets the supplier’s Hong Kong settlement requirements but also complies with domestic import compliance requirements
Exclusive loss-prevention tip: If the goods have already arrived at the port, you can apply for a temporary port detention extension to customs within 48 hours, and simultaneously complete dual-entity filing for re-declaration to minimize additional costs

Overseas enterprises serving as import declaration entities must complete the Overseas Import and Export Enterprise Filing Registration in advance and obtain a 10-digit code assigned by domestic customs to have declaration qualifications. If a Hong Kong agency company fails to complete this filing, direct declaration will be automatically rejected by the system. Even if declared through special channels, it will be subject to key audit during the price verification process, easily leading to price verification disputes and requiring a large number of related transaction supporting materials.
For cases where the declaration has been rejected or put on hold, organize materials such as the Hong Kong agency company’s Business Registration Certificate, cargo sales contract, and payment vouchers, apply to the port customs for deleting the original declaration and re-declaring, replace the qualified domestic declaration entity, and restart the declaration process. The entire process must ensure that the declared price, cargo name, and specifications are exactly consistent with the original declaration information to avoid triggering secondary audits

When selecting a Hong Kong agency company for import operations, key logistics points to confirm include the cargo ownership of the transit warehouse and the validity of the bill of lading endorsement. If goods are shipped directly from an overseas port to a domestic port, using the Hong Kong agency as the consignee of the bill of lading requires a complete bill of lading endorsement from the Hong Kong agency to take delivery of the goods by exchanging documents. Incomplete endorsement will lead to failure to exchange documents and generate additional amendment fees.
If cargo needs to be consolidated and unpacked in Hong Kong, confirm the free detention period of the Hong Kong warehouse in advance. Ordinary goods usually have a free detention period of 3-5 days, after which a fee of HKD 15-20 per cubic meter per day will be charged. During peak seasons when storage space is tight, cargo may be skipped, so it is necessary to reserve a 1-2 day buffer period in advance to avoid delaying subsequent port clearance arrangements. If cargo needs to be re-routed, notify the shipping company 72 hours in advance to change the consignee information to avoid additional re-routing fees

When using a Hong Kong agency company for import operations, you can apply for VAT Deferral based on Hong Kong’s tax advantages to reduce capital occupation costs. The value-added tax in the import link does not need to be prepaid and can be deducted in the sales link, effectively improving capital turnover. It should be noted that as an offshore entity, the Hong Kong company needs to clarify the pricing of related transactions in the import link to comply with the arm’s length principle, avoiding being deemed by tax authorities as profit shifting and triggering BEPS anti-tax avoidance investigations.
Non-resident enterprises shall pay non-resident enterprise withholding income tax on agency service fees related to imports according to regulations. It is recommended to make tax structure planning in advance, utilize the tax arrangement preferences between the mainland and Hong Kong to reduce the withholding income tax rate and legally optimize tax costs

In the payment and receipt links, payments received by the Hong Kong agency company comply with current foreign exchange management regulations. Only keep complete transaction documents such as sales contracts, invoices, and bills of lading to complete settlement via CIPS (Cross-Border Interbank Payment System) RMB cross-border payment without additional filing. If settling in foreign currency, confirm in advance that the Hong Kong agency company’s offshore account has the qualification to receive and make payments to avoid account freezing.
During foreign exchange settlement and clearing, ensure the consistency of capital flow, cargo flow, and document flow. If there is a mismatch between capital and goods, explain the situation to the foreign exchange management department in advance and provide corresponding supporting materials to avoid being deemed as abnormal payment and receipt and affecting subsequent payment and receipt quotas

When entrusting a Hong Kong agency company to handle imports, clarify the cargo ownership transfer point and risk-bearing scope in the contract to avoid cargo ownership disputes. For L/C payment, carefully check the L/C terms regarding the consignee and declaration entity to avoid soft clauses that may prevent normal negotiation.
In case of force majeure such as port congestion or customs policy adjustments, include a fallback clause in the contract in advance to clarify the responsibility division of both parties and avoid unnecessary legal disputes. For branded goods imports, verify intellectual property customs protection filing in advance and confirm the validity of authorization documents to avoid cargo detention by customs

When using a Hong Kong agency company for import operations, declaration information may have errors due to information asymmetry between the mainland and overseas, leading to a higher inspection probability than declarations by mainland entities. Prepare complete cargo information in advance, including commercial invoices, packing lists, product specifications, and brand authorization documents, and cooperate with customs inspection.
If a container inspection is required, contact the freight yard in advance to prepare for container unpacking and complete the inspection on the same day as much as possible to avoid additional unpacking fees and storage fees. If customs requires testing and appraisal, provide product composition instructions and test reports in a timely manner to speed up the appraisal process. If there is a dispute over the appraisal result, apply for a second test within the specified time to avoid being directly judged as unqualified goods

Adjust the role positioning of the Hong Kong agency company according to the trade terms. For FOB terms, the buyer is responsible for import customs declaration, and the Hong Kong agency can only be responsible for settlement and overseas cargo pickup.
For CIF terms, the seller is responsible for transportation, and the Hong Kong agency can be responsible for the entire logistics connection. Adjust the import pace according to the inventory of domestic warehouses, adopt batch import methods to reduce inventory occupation costs.
For high-frequency and small-quantity goods, adopt the Hong Kong transit consolidation model, integrate multiple small batches of goods and import them uniformly to reduce unit logistics costs. For long-term operations, build a fixed dual-entity linkage structure to reduce communication costs and compliance costs for each operation and improve the overall supply chain efficiency
