I run a small and medium-sized factory exporting household goods, with three years of experience in cross-border B2B export. Previously, I always found freight forwarders and handled customs declaration, foreign exchange settlement and tax refund on my own.

Last month, two of my containers were detained due to incorrect commodity code classification, I lost more than RMB 80,000 in port detention fees alone, and the tax refund was issued more than a month late, which brought huge pressure on advance capital. Now my business volume has grown, with a stable shipment of 5 to 6 containers per month. I want to find a professional export agent to handle these operations, but after comparing more than a dozen agencies, the quotes differ by almost double.

Some claim to guarantee customs inspection clearance, while others only accept declaration of conventional categories. I do not know how to make a judgment, and I am afraid of stepping into pitfalls and losing money again. I would like to ask how to choose a foreign trade export agent, what core points must be verified, and how to avoid unreliable institutions.

The three most common misunderstandings when selecting export agents in the industry are: only focusing on quote levels, crediting verbal promises, and failing to verify qualification and risk control capabilities. Many merchants only choose the agent with the lowest quote, unaware that low-price agents often add hidden costs in subsequent links, and even simplify compliance review to grab orders, burying risks such as incorrect classification and inconsistent documents.

Once such risks break out,the chain reaction will include customs detention, port detention, fines and late fees. In severe cases,it will also affect the enterprise's customs credit rating, leading to targeted inspection of all subsequent exports, and even tax recovery due to non-compliant tax refunds, bringing unbearable losses to small and medium-sized merchants.

The core method of physical risk isolation, first of all,is to verify the agent's port operation qualification and risk control system, require the other party to provide customs clearance error rate data in the past six months, and confirm that it has practical operation capacity at the corresponding port, rather than subcontracting orders to earn price differences. Secondly, specify detailed agreements on all fees in the contract, all quotes must be put down in writing to eliminate the possibility of hidden charges. Finally, require the other party to clarify the response time limit and responsibility division for abnormal problems,so as to avoid mutual buck-passing after problems occur.

The exclusive loss reduction tip is that during the screening stage, you should require the other party to provide past operation cases of exports of the same category, confirm that it has handled the customs clearance and tax refund processes of the corresponding category, and at the same time require the other party to publicize its own customs credit rating, and avoid agents with low credit ratings and violation records. Do not trust publicity such as "guaranteed inspection clearance" and "low-price tax refund". Compliance is the core prerequisite for controlling export costs.

When selecting an agent, you need to check the agent's customs clearance error rate and customs filing qualification, and focus on confirming whether its review process for code classification is standardized. Many low-price agents will simplify the classification review link and directly declare according to the code reported by the merchant. Once the classification is wrong, it will directly lead to order deletion and re-declaration, valuation disputes, and even be identified as false declaration, affecting the enterprise's own customs credit rating.

You should confirm whether the agent has a pre-review link, complete the code pre-classification and document verification before shipment, rather than making up the review after shipment. At the same time, confirm whether it has linkage capacity for customs clearance at national ports. If you have demands for shipment at multiple ports, confirm that the agent can operate directly at the corresponding ports, rather than reselling orders to third parties, so as to avoid abnormalities caused by information transmission errors.

You should confirm the qualification of the logistics service provider cooperating with the export agent, as well as its control ability over shipping space and distribution nodes. Many agents do not control logistics resources themselves, and cannot allocate shipping space preferentially when space is tight and containers are rolled over, leading to shipment delay. You also need to confirm whether the responsibility division for container detention fees and port detention fees is clear, and whether the agent can assist in applying for extended free storage and free container periods to reduce additional costs under abnormal circumstances.

If you have demands for port change or transshipment, confirm in advance whether the agent can quickly coordinate with the shipping company to complete the port change operation, and whether there is a mature abnormal handling plan, so as to avoid additional expenditure caused by unfamiliar processes. At the same time, confirm the cargo ownership control process, so that the cargo ownership is under your control throughout the whole process, and avoid the risk of the agent releasing the goods without permission.

You should confirm whether the export agent can provide a tax planning scheme that meets your business needs, for example, whether it can operate VAT deferral for exports to Europe to reduce capital occupation costs. Check the agent's tax compliance qualification to avoid the agent making profits through non-compliant tax differences, which will bring you subsequent tax inspection risks.

If you are engaged in cross-border B2B export, confirm that the agent can help you sort out the pricing logic of cross-border transactions, avoid tax risks related to base erosion and profit shifting, make advance planning according to the tax requirements of different destination countries, and avoid goods being detained due to non-compliance with destination country tax regulations. Also confirm whether the agent's fee includes tax consulting services, so as to avoid additional tax service fees later.

You should confirm the compliance operation process of the export agent for foreign exchange receipt and payment, whether it supports cross-border RMB payment and multiple settlement methods, and whether it can match the payment needs of your different customers. Check whether the agent has a compliant settlement and account reconciliation process, so as to avoid being inspected by the foreign exchange regulatory authority due to non-compliant foreign exchange receipt and payment, which will affect your subsequent cross-border foreign exchange receipt and payment business.

If you have demands for receiving payments from offshore accounts, confirm that the agent can handle fund transfer from offshore to onshore in compliance with current foreign exchange management requirements, and there will be no suspended accounts or inability to settle foreign exchange. Also confirm the agent's exchange rate optimization scheme, which can help you lock the exchange rate within a reasonable range and reduce losses caused by exchange rate fluctuations.

When selecting an export agent, you should confirm its operation process and time limit for export tax refund, as well as its control requirements for tax refund compliance. Confirm whether the agent can achieve consistency of four streams (contract stream, goods stream, fund stream, invoice stream), which meets the inspection requirements of tax authorities, so as to avoid tax correspondence adjustment caused by incomplete documents or inconsistent capital flow, which delays tax refund or even makes tax refund impossible.

Confirm the agent's tax refund advance rules. If you need to advance the tax refund in advance, specify the conditions, time limit and rate of the advance in the contract, so as to avoid vague agreements leading to subsequent disputes. Also confirm whether the agent's document filing process is standardized, which can respond to irregular inspections of tax authorities, help you keep complete compliance materials, and reduce tax refund risks.

Before signing the agency agreement, confirm that the agreement clearly defines the responsibility division, and there is a clear agreement on the responsibility attribution for abnormal situations. For example, the agent shall bear the corresponding losses for customs detention and fines caused by the agent's operation errors. Check the clauses on cargo right transfer in the agreement to confirm that the cargo right belongs to you throughout the whole process, and the agent only provides operation services and will not dispose of the goods without permission.

For business with letter of credit collection, confirm that the agent can assist in reviewing the letter of credit terms and identify soft clauses in advance, so as to avoid inability to receive payment due to soft clauses. Also confirm the intellectual property clauses in the agreement. If your products have their own intellectual property rights, confirm that the agent can assist in the connection of intellectual property customs filing, so as to avoid infringement risks.
